  1. Applications will be considered for Road Improvements on a non-public road in accordance with the terms and conditions of the Scheme.
  1. We, the undersigned, each being the owner/ occupier of agricultural land in the townland(s) referred to at (1) hereunder, hereby apply to Tipperary County Council for a grant towards the cost of work described at (1)-(4) Part I of the Schedule overleaf, and, if the grant is made available, we apply to have the said work carried out by the County Council as Agent on our behalf and not in their capacity as a Road Authority. Any work which consists of making or improving a road, shall, when completed, not be regarded as a public road. We and each of us hereby agree to be bound in all respects by each and every of the items and conditions of the Scheme as set forth in Part II of the Schedule hereto.

SCHEDULE

PART 1

The Local Improvement Scheme applies to non-public accommodation roads (farm roads and certain roads serving the public) and bog roads and to undertake minor drainage improvements. The project must be of benefit to agricultural production and benefit two or more parcels of land owned or occupied by different persons or in relation to a bog road, it must serve two or more bog plots used by different persons.

The following projects do notcomplywith the conditions of the Scheme:-

 roads serving only houses or buildings occupied or used by persons not

engaged in agriculture.

 roads serving only Council cottages, i.e. non-vested cottages.

 roads or drains on bogs being developed commercially for large scale turf

production for sale.

PART 2

TERMS AND CONDITIONS.

1.The grant covers a percentage of the total cost of the project and is dependent on the details outlined in the application

  1. The work must be for the joint benefit of two or more parcels of land, of which at least two are owned or occupied by different persons engaged in separate agricultural activities, or provides access for harvesting purposes (including turn of seaweed) for two or more persons or shall, in the opinion of the County Council, be used by the public. The benefit to be derived must be reasonably commensurate with the cost.
  1. Drainage works alone will not be eligible under the Scheme.
  1. The cost must be strictly necessary and not merely ordinary maintenance of a kind which the applicants could reasonably be expected to do for themselves.
  1. Should your application be successful, you are required to submit the relevant financial contribution within the specified timeframe notified in writing. If the financial contribution is not received during that period, the application will no longer be considered and an offer will be made to the next applicant on the list. Responsibility for collection of the local contribution lies with the Appointed Representative who must lodge the full amount with one of Tipperary County Council’s Cash Desk at either Nenagh, Clonmel or any Tipperary County Council Municipal District Office prior to commencement of any works. The applicants must make the necessary apportionment amongst themselves of their respective portions of the joint contribution.
  1. The contributors and any other persons whose lands or interests appear to be affected by the proposed work must, when required prior to the commencement of operations, sign the prescribed form giving their full consent to the execution of the work including entry to their lands etc..
  1. The applicants must arrange amongst themselves for the provision without cost to Tipperary County Council of any lands which may be required for the construction or widening of the roadway or drain as the case may be.
  1. Tipperary County Council, at their discretion, will decide on the specification of the work to be done and on the best manner of carrying it out, and the applicants shall not have any claim against Tipperary County Council for any imperfection which may exist in the finished work, nor for any failure to complete the full amount of the work which was envisaged.
  1. Tipperary County Council will expend upon the work the sum agreed upon (i.e. the estimated cost); and in the event of that sum not being sufficient to complete the entire work specified,Tipperary County Council will not have any liability to be bound to expend on the work for its completion any sum in addition to the agreed sum, but the making of a supplementary grant will be considered on its merits if the applicants so request and agree to pay such sum as may be required by way of additional local contribution.
  1. When the work has been carried out, the applicants shall maintain it in good order and repair at their own charge and expense, and Tipperary County Council will not have any liability for the maintenance of the work.
  1. The offer may be subject to withdrawal or alteration without notice and to payment of local contribution. The offer is conditional on the State allocation to the Council for the year in question not being already taken up when the contribution is paid.
  1. Contribution in kind e.g. free labour or materials, will not be accepted in lieu

of cash. Applicants will be paid reasonable prices for any road metal or other

materials that may be required from them. All materials forming part of a bridge

or other structure to be demolished and replaced by a new structure, will be

available for use if necessary, and without charge, in connection with the execution of the work.

  1. The Council undertakes to use its best endeavours to hold confidential, any information provided by you in this application form subject to the Council’s obligations under law, including the Freedom of Information Act (as amended). Should you wish that any of the information supplied by you in this application should not be disclosed, because of its sensitivity, you should, when providing the information, identify same and specify the reasons for its sensitivity.

NOTE: THIS APPLICATION SHOULD HAVE A SITE LOCATION MAP ATTACHED(SCALE 1:2500 OR AREA AID MAP SCALE 1:5000) – OTHERWISE IT WILL NOT BE DEEMED A VALID APPLICATION. PLEASE INDICATE BOTH THE ROAD AND EACH RESIDENCE/PARCEL OF LAND ON THE MAP TO WHICH THIS APPLICATION REFERS.
