Instructions for completing the Initial Notification Form

Questions 1 and 2: The facility name and the Ohio EPA facility ID are required to be entered in these fields.

Question 3: Please indicate whether you have filed a Title V application with Ohio EPA.

Question 4 through 12: If you have filed a Title V application with Ohio EPA, you do not need to fill in this information unless the information has changed since the Title V application submission.

Question 13: A major source of Hazardous Air Pollutants (HAPs) is one that has a potential to emit > 10 tons/year of a single pollutant or >25 tons/year of multiple pollutants. A list of the 188 HAPs can be found at http://www.epa.state.oh.us/dapc/general/haplist.html

If you answered “No” to this question, you are not required to submit this application.

Question 14: If your facility is a major source of HAPs, the next thing to check for is whether the facility has any operations that fall under any of the source categories for which EPA does not have a promulgated MACT standard rule. Rules vacated by court mandate currently include, but are not limited to, Boiler MACT (Subpart DDDDD), Brick MACT (Subpart JJJJJ), and Clay Ceramics MACT(Subpart KKKKK). If the answer is “No”, then you are not subject to the Section 112(j) requirements.

Question 15: Please identify the Section 112(j) subpart(s) that your facility may be subject to (e.g., Subpart DDDDD “Boiler MACT”).

Question 16: This question asks for a brief description of the major source operations. The major source operations are those with the potential to contribute HAP emissions. Broad descriptions are acceptable (e.g., fossil fuel-fired boilers serving a steel manufacturing process.)

Question 17: This question asks for the actual emission units that will be subject to the Section 112(j) subpart(s). If the facility is subject to multiple subparts, please indicate the emission units that will be subject to each subpart. Please use Title V emission unit identifications when they are available. Small boilers (<10 mmbtu/hr) without emission unit IDs may be grouped in categories (e.g., 12 natural gas-fired boilers <10 mmbtu/hr rated heat input used for comfort heat and cooling throughout the plant). Gaseous or liquid fueled hot water heaters (<120 gallons and < 160 PSIG and <210 degrees F.) are not considered boilers or process heaters subject to the Subpart DDDDD Source Category.

Question 18: This question refers to any case-by-case MACT determinations done at the time of installation of an emission unit at your facility in accordance with the Section 112(g) rule (OAC rule 3745-31-28). Information on the Section 112(g) provision can be found at: http://www.epa.gov/ttn/atw/112g/112gpg.html

Question 19: This is a placeholder for additional information and cross-referenced documents. Some may choose to include the required information in 40 CFR 63.53(b) with this form. Information regarding emission points, applicable requirements and control technology can be incorporated by cross-referencing the most recent Title V Permit application. Information regarding the HAPs emitted at each emission point can be incorporated by reference to a proposed MACT rule that covers the same or similar sources.

Question 20: This statement shall be signed by the responsible official as defined in OAC rule 3745-77-01(GG). Making of any false material statement, representation or certification constitutes a violation of ORC 3704.05(H), and subjects the responsible party signing this statement to civil and/or criminal penalties as provided for in ORC 3704.06(C) and ORC 3704.
