ORDINANCE #13-18

AN ORDINANCE AMENDING chapter 6.04, titled “dogs and cats” of the revised general ordinances of the township of raritan, section 6.04.020A, section 6.04.020C, section 6.04.020c1, SECTION 6.04.020dandsection 6.04.120.______

BE IT ORDAINED by the Township Committee of the Township of Raritan, County of Hunterdon, State of New Jersey that:

Section 1:Chapter 6.04, titled “Dogs and Cats” of the Revised General Ordinances of the Township of Raritan, Section 6.04.020A, titled “License Required”, is amended as follows[1]:

  1. License Required.It is the responsibility of every person who shall own, keep or harbor a dog or cat of licensing age to annually, during the months of April or May, apply for and procure from the township clerk a license and official metal registration tag for each such dog or cat so owned, kept or harbored.No person shall keep or harbor anydog or cat within the township without first obtaining a license, to be issued by the township clerk upon application of the owner and payment of the prescribed fee. Such license shall be obtained within ten days of a dog or cat attaining the age of seven months or permanent teeth or within ten days of the acquisition of a dog or cat that is determined to be of licensing age. Any person who shall bring or cause to be brought into the state of New Jersey, township of Raritan a dog or cat licensed in another state for the current year shall immediately apply for a license issued by the township. No person shall keep or harbor any dog or cat in the township except in compliance with the

provisions of this chapter and with the provisions of Chapter 151 of the Laws of 1941 of the state of New Jersey. Failure to comply with this subsection A of this ordinance shall be deemed a violation and subject to a fine of fifty dollars ($50.00) for each offense. Each and every day in which a violation of this subsection of the ordinance exists shall be considered a separate violation.

Section 2: Chapter 6.04, titled “Dogs and Cats” of the Revised General Ordinances of the Township of Raritan, Section 6.04.020C1, titled “Renewal of License – Registration Tag”, is amended as follows:

C.Display of License. Every person who shall own, keep or harbor any dog or cat licensing age, shall place upon such dog or cat a collar or other device, with the license number securely fastened or displayed thereto. Acceptable methods of displaying the license number shall include, but are not limited to, breakaway or elastic collars. License tags are not transferable. Failure to comply with this subsection C of this ordinance shall be deemed a violation and subject to a fine of fifty dollars ($50.00) for each offense. Each and every day in which a violation of this subsection C of the ordinance exists shall constitute a separate violation. Should such tag be lost a duplicate registration tag may be obtained for a fee of fifty cents ($0.50) from the clerk’s office.

Section 3:Chapter 6.04, titled “Dogs and Cats” of the Revised General Ordinances of the Township of Raritan, Section 6.04.020D, titled “Fees”, is amended as follows:

D.Fees.The fee for a license and registration tag for all dogs and cats which are spayed or neutered shall be twelve dollars ($12.00) for one year. For any dog or cat which is to be licensed which is not spayed or neutered, the fee for a license and registration tag shall be fifteen dollars ($15.00) for one year. Every dog and cat shall be required to have a separate license and registration tag. The license and registration tag shall be effective for the period beginning on June 1st and ending on the succeeding May 31st.

Section 4:Chapter 6.04, titled “Dogs and Cats” of the Revised General Ordinances of the Township of Raritan, Section 6.04.120, titled “Violations – Penalties”, is amended as follows:

Any person who violates any section or provision of this Title (Chapter 6.04 – Dogs and Cats), with the exception of Section 6.04.020 and Section 6.04.070 to which a specific penalty is established, shall be liable upon the first conviction of not less than seventy-five ($75.00) or more than two thousand dollars ($2,000.00) and upon a second conviction, not less than one hundred fifty dollars ($150.00) or more than two thousand dollars ($2,000.00), imprisonment for a period not to exceed 90 days; and/or serving a period of community service not exceeding ninety days. Each and every day in which a violation of any provision of this Title (Chapter 6.04 – Dogs and Cats) exists shall constitute a separate violation.

Section 5:If any article, section, subsection, sentence, clause or phrase of this Ordinance is, for any reason, held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this Ordinance and they shall remain in full force and effect.

Section 6:This Ordinance shall take effect immediately upon final passage and publication according to law.

NOTICE OF PENDING ORDINANCE

Please take notice that the foregoing Ordinance was introduced at a Township Committee meeting of the Township of Raritan on November 6, 2013, the same was then ordered to be published according to law with a public hearing and vote scheduled for the meeting of December 3, 2013 beginning at 7:00 P.M. at the Municipal Building, One Municipal Drive in the Township of Raritan at which time all interested persons will be heard.
