8.  Only motor vehicle reclaim, towing and service facilities existing at the time of Ordinance adoption are allowed as a special use provided:

a.  The number of vehicles stored on the premises shall not exceed twenty-five (25) motor vehicles.

b.  Fencing is provided for security and screening purposes. The fencing must be constructed of new and approved opaque materials which the Planning Commission will review prior to the issuance of a building/zoning permit. In addition vegetative screening is required adjacent to the exterior of the fence in all areas visible from adjacent public streets/rights-of-way. Such vegetative screening is subject to approved by the City following the submission of a landscape plan.

c.  All automobiles are located within fencing and the fencing be erected on all four sides of the storage area and that it also has the proper screening on all four sides so that items contained within are not visible from the outside of the fence.

d.  No display of signage is permitted on the fence.

e.  That the facility cannot be used for the operation of an automobile wrecking facility, a junkyard, or and auto reduction yard. No vehicle may be sold in parts or dismantled or compacted in any way.

f.  No rubbish, debris, salvage material of any kind, or other articles which from its worn condition render it practically useless for the purpose for which it was made and which is commonly classed as junk, may be kept or stored on the property.

g.  No vehicles shall be stored on the premises longer than forty-five (45) days, except vehicles, which are involved in litigation and must be preserved for longer periods of time. As to such vehicles, no more than five per cent (5%) of the total inventory shall be comprised of vehicles involved in litigation, and the operator shall furnish a list at least twice each year identifying such vehicles, and their tenure on the premises.

h.  That vehicles which are deemed to be junk vehicles cannot be permanently stored at the location. Vehicles must be removed from the facility within 30 days of their being towed to the facility if they are deemed to be junk vehicles. Junk vehicles shall be described as follows:

i.  Vehicles which are or appear to be inoperable;

ii. Vehicles that are extensively damaged, with damage including such things as broken or missing wheels, windows, motor, drivetrain, transmission, fenders and parts;

iii.  Vehicles that do not contain valid or current registration plates;

iv.  Vehicles which approximate fair market value is equal to the approximate value of the scrap in it;

v. Vehicles are drained of leaking fluids prior to storage outside and fluids are properly disposed of;

vi.  Vehicles shall be arranged in orderly rows, with no stacking of vehicles atop one another with driving lanes of twelve (12) feet between.

vii.  Operation of office hours will be between 7:00 a.m. to 7:00 p.m. excepting the towing of vehicles may occur outside of aforementioned timeframe.

9.  Farm Supply/Feed Retail and Wholesaling existing at the time of Ordinance adoption are allowed as a special use according the to the Use Table.

10.  Bulk flammables storage existing at the time of Ordinance adoption are allowed as a special use according to the Use Table provided:

a.  The amount of bulk flammable materials stored on the premises shall not exceed 100,000 gallons.

b.  No rubbish, debris, salvage material of any kind or other articles which from its worn condition render it practically useless for the purpose for which it was make and which is commonly classed as junk, may be kept or stored on the property.

c.  All storage and display must be strictly related to the principal use of bulk flammable storage.

11. Where a Drive-Through is permitted by Special Use Permit, the following provisions shall apply.

a. All three findings must be made by the Planning Commission in order to grant a Special Use Permit for a Drive-Through service facility:

i.  The design and location of the Drive-Through will not contribute to increased congestion on public or private Streets or Alleys adjacent to the subject property; and,

ii.  The design and location of the Drive-Through will not impede access to or exit from the parking lot serving the business, impair normal circulation within the parking lot or impede pedestrian movement; and,
