Monthly Payment is Due the 1st of each month: $875.00 which includes the following utilities – gas/electric, water. (including wireless connect to Verizon FIOS on Line Internet Service and Cable). On the street parking in available in front of the house.

Term of Agreement: ______to August 1, 2010. Landlord expects all rents prior to/or on time of the 1st of each month. A Security Deposit of $875.00 is also required along with the first months rent with the return of the signed lease. An extra $400.00 Painting deposit is required if the Tenant paints any interior or exterior. All painting must be approved with written consent.

(1) Rental Agreement:

USE: Only a person signing this agreement may use this apartment as personal non-business living quarters, and for no other reason. Keys are for the exclusive use of the Tenant.

RENT PAYMENT: Rent to be paid monthly, in advance for each month. Payments begin on date possession of apartment is available. Tenant will be required to pay other charges (repairs if an item is lost or broken by the tenant).

\ SECURITY DEPOSIT: Paid in advance for the term of this agreement. Deposit is for replacement cost of any damage to Landlord's furnishings or premises, necessary patching, repainting, floor cleaning, or exterminator of any kind. Tenant will receive the balance of the deposit at the end of the lease, or have charges due to the Landlord.

SERVICES: Landlord will maintain heating unit, (including service contract), as well as utilities such as water system, stove, refrigerator etc. Tenant must cooperate in conserving heat by keeping windows closed, by using blinds/shades provided by the landlord, and curtains or drapes whenever possible. No space heaters are permitted. Plumbing drain stoppages and repairs caused by Tenant will be charged to Tenant (no coffee grinds, skins, greases or oil in drains

NO sanitary supplies including baby wipes or paper towels are to be flushed down the toilet.). Telephone is to be paid for by Tenant.

(2) Rental Agreement:

REPAIRS: Tenant must keep apartment clean (a clean kitchen and bathroom) and empty garbage regularly. Tenant is expected to take good care of all equipment and fixtures. Tenant must notify Landlord of needed repairs or replacements immediately. If Tenant causes damage, the Landlord's expense will be "added rent" until paid in full.

NO sanitary supplies including baby wipes or paper towels are to be flushed down the toilet.

ALTERATIONS: None, if you would like a shelf put up you must obtain the Landlords permission in writing. If Landlord gives consent, alterations and installations shall become the property of the Landlord.

FIRE ALARMS AND EXTINGUISERS: Tenant is NEVER to remove batteries placed in the fire alarm system. Tenant is to LEAVE all fire extinguishers where the Landlord installs them. If a battery requires replacement, tenant is to notify the Landlord. Tenant must give Landlord immediate notice of fire, accident, damage, or any dangerous or defective condition. If the Tenant causes a fire than Tenant must pay for repair costs.

INSIDE THE HOUSE

LIABILITY: Tenant is responsible for all costs and damages causes by Tenant or his/her guests, or invitees. Cost must be paid as 'added rent' until paid in full. **THE LANDLORD WILL SUPPLY SNOW SHOVEL, AND APPROPRIATE NON-SKID SALTS THAT WILL NOT CORRODE THE LANDLORD'S STEPS ETC. WHEN NECESSARY.**

LANDLORD MAY ENTER: Except in emergencies (plumbing, heating emergencies. Landlord will give prior notification to Tenant to enter at reasonable daytime hours to make needed repairs, alterations, or to show house to perspective tenants prior to completion of tenant’s lease.

LANDLORD RESERVES THE RIGHT:

To inspect premises once a month/check fire units etc. Landlord will give prior notification of two days of these inspections.

TENANTS DUTY TO OBEY LAWS AND REGULATIONS – NO DRUGS: Tenant must comply with Landlord's written rules. Tenant and their guests must comply with all laws, orders, rules, and directions of all government authorities. Landlord's insurers, Board of Fire Underwriters and other groups. Tenant may not do anything which may increase Landlord's insurance premium. Tenants may not call Town Boards, Make Complaints to Town Organizations without the Landlords knowledge. The Landlord will initiate these steps if the Landlord believes that they are reasonable requests.

SAFETY REQUIREMENT: Tenant must, upon leaving premises, turn off lights, air conditioners, fans, irons, toasters, broilers, coffee makers, hair curlers, hair dryers, ranges, ovens, and washing machines, clothes dryers. (THIS IS STILL THE MAJOR CAUSE OF ALL HOUSE FIRES).

PARKING AREA: On Street . Parking is restricted to Tenant’s currently registered vehicle. The vehicle is to be currently insured and in running condition. No cycles, trucks, trailers or vans are allowed. No auto services, repairs such as oil changes are permitted.

(3) Rental Agreement:

TIMELY TERMINATION OF RENTAL AGREEMENT: Landlord reserves the right of early termination of this lease agreement upon 30 days written notice to the tenant. Upon such termination, landlord will return the security deposit & all other monies held in escrow after the subtraction of damages and rent due.

OTHER TENANT DEFAULTS: Late rent, subletting, or non-compliance with terms of this agreement.

Landlord may give 5 days written notice to Tenant to correct default. Upon failure by Tenant to correct default, Landlord may cancel agreement by giving Tenant a written 10-day notice stating date and time term will end.

AT THE END OF TENANCY: Landlord may enter apartment, inventory, seal, remove and lock up any contents: Landlord may then re-rent.

Tenants Security Deposit will not be refunded prior to the actual vacate date and inspection by Landlord, or prior to the assessment of charges for damage to the premises.

END OF TERM/RENEWAL OF AGREEMENT: Tenant or Landlord will be given 30 days written notice of renewal, rental increase, or utilities increase where applicable, or termination of agreement.

Tenant must leave the apartment clean and in good condition, remove all Tenants’ property, and restore apartment to its condition at the beginning of the term of this agreement. Tenant must throw away all garbage, boxes etc. in an appropriate timely manner.

·  KEY MUST BE RETURNED TO LANDLORD. A $150.00 CHARGE WILL BE ISSUED TO TENANT IF THE KEYS ARE NOT RETURNED. NEW LOCKS WILL BE INSTALLED IF KEYS ARE LOST OR STOLEN (AT THE EXPENSE OF TENANT $150.00).

SPECIAL CONDITIONS: No children as Tenants. No pets, birds or fish. No addition or change of locks or latches. Tenant will not make noise; play music or instruments that disturb other occupants or neighbor at anytime. No waterbeds. No electric exercise equipment.

REPRESENTATIONS AND CHANGES IN AGREEMENT: Tenant has read this agreement. All statements are in this agreement. Any changes have to be in writing, dated and signed by both parties.
