At their meeting on 24 March 2010 the Planning Committee of the Regulatory Committee on behalf of the County Council resolved, to authorise the carrying out of the above development. Planning Permission is now granted. A copy of the Decision Notice is attached hereto.
Therefore, in accordance with the above Act would you please accept this letter in conjunction with the plans shown as formal notification of the development for the purpose of your Register of Planning Applications and Decisions.

In pursuance of their powers under the above mentioned Act, Order and Regulations, the Council as the local planning authority hereby GRANT PLANNING PERMISSION for Use of land as a waste transfer station, including the erection of a building for waste sorting activities. Land at Endeavour Works, Beach Road, Newhaven. (Within land edged red on applicants location plan) in accordance with your application validated by the East Sussex County Council on 13 January 2010 and the plans and particulars submitted in connection therewith and subject also to due compliance with the condition(s) specified hereunder:-
1. The development hereby permitted shall be commenced before the expiration of three years from the date of this permission.
Reason: To comply with Section 91 of the Town and Country Planning Act 1990.
2. No development shall take place until a scheme which includes provision for the resurfacing of that section of the access track that does not currently have a level hard surface has been submitted to and approved in writing by the Director of Transport and Environment. The approved scheme shall be fully implemented before any other development takes place on site, unless otherwise agreed in writing by the Director of Transport & Environment.
Reason: In the interests of the amenity of the locality and to comply with Policies WLP35 (b) and WLP36 (a) of the East Sussex and Brighton & Hove Waste Local Plan 2006.
3. No development shall take place until a scheme for the management of surface water drainage at the site has been submitted to and approved in writing by the Director of Transport and Environment. No waste materials shall be brought to the site until the works have been carried out in accordance with the approved scheme, which shall be fully implemented.
Reason: To ensure satisfactory drainage of the site and to prevent water pollution and to comply with Policy WLP38 (a) of the East Sussex and Brighton & Hove Waste Local Plan 2006.
4. Notwithstanding the details on drawing BR584, there shall be no soakaway on site, unless it forms part of any drainage scheme approved under condition 3 above.
Reason: To prevent water pollution and to comply with Policy WLP38 (a) of the East Sussex and Brighton & Hove Waste Local Plan 2006.
5. No waste materials shall be brought to the site until the application site compound has been surfaced with a level hard surface in accordance with details first submitted to and approved in writing by the Director of Transport & Environment.
Reason: In the interests of the amenity of the locality and to prevent water pollution, in accordance with Policies WLP35 (b) and WLP38 (a) of the East Sussex and Brighton & Hove Waste Local Plan 2006.
6. Development shall not commence until details of the materials to be used in the construction of the external surfaces of the building hereby permitted, and the bays within the building, have been submitted to and approved in writing by the Director of Transport and Environment. Development shall be carried out in accordance with the approved details.
Reason: To ensure the appropriate appearance of the development in the area and in the interests of the amenity of the locality, in accordance with Policies WLP35 (c) and WLP39 of the East Sussex and Brighton & Hove Structure Plan 1991-2011.
7. Prior to any waste materials being brought to the site, the building shall be fully constructed in accordance with the details shown on approved drawing BR584, unless otherwise first agreed in writing by the Director of Transport & Environment. The building shall have only one open elevation and that shall be the north-western elevation.
Reason: In the interests of the amenity of the locality and to accord with Policy WLP35 (b, c) of the East Sussex and Brighton & Hove Waste Local Plan 2006.
8. There shall be no overnight storage of any sorted or unsorted waste material or residue of recycled materials other than within the building or on a securely covered vehicle.
Reason: In the interests of the amenity of the locality and to accord with Policy WLP35 (c) of the East Sussex and Brighton & Hove Waste Local Plan 2006.
9. No development shall take place until a scheme to control the emission of dust during the construction and operation of the development has been submitted to and approved in writing by the Director of Transport and Environment. The scheme shall include, but not be limited to, the following:
(i) measures to demonstrate that any dust arising from unloading, loading, sorting and handling of materials will be confined within the site; and
(ii) details of how stored waste materials will be contained within the building. The approved scheme shall be fully implemented and any equipment shall be maintained in accordance with the manufacturer's instructions at all times.
Reason: In the interests of the amenity of the locality and to accord with Policy WLP35 (c) of the East Sussex and Brighton & Hove Waste Local Plan 2006.
10. There shall be no sorting, treatment, loading or unloading of waste or recyclable materials other than within the building or the Tipping Area identified on approved drawing no. BR584, unless with the prior written agreement of the Director of Transport & Environment.
Reason: In the interests of the amenity of the locality and to accord with Policy WLP35 (c) of the East Sussex and Brighton & Hove Waste Local Plan 2006.
11. Other than machinery used solely for the construction of the building and associated ground-works during the construction period, no powered machinery or plant other than one mini-digger shall be installed or operated at the site without the prior approval in writing of the Director of Transport and Environment.
Reason: In the interests of the amenity of the locality and to accord with Policy WLP35 (b) of the East Sussex and Brighton & Hove Waste Local Plan 2006.
12. No more than 13 skip/lorry/light goods vehicles associated with the development shall enter the site on any one day and no more than 13 shall leave so that there shall be no more than 26 such vehicle movements in total on any one day, unless with the prior written agreement of the Director of Transport & Environment.
Reason: In the interests of the amenity of the locality and to accord with Policy WLP35 (b) of the East Sussex and Brighton and Hove Waste Local Plan 2006.
13. The use hereby permitted shall not be carried on other than between the hours of 0800 and 1700 on Mondays to Fridays inclusive and the hours of 0800 and 1200 on Saturdays, and at no time on Sundays, Public and Bank Holidays, unless with the prior written agreement of the Director of Transport & Environment. Vehicle movements associated with the collection and delivery of sorted and unsorted waste shall also only take place within these hours. This is except for works of essential maintenance or which are to respond to an emergency. No later than one week after the carrying out of such works full details of the time, date, reason for and nature of the works shall be given in writing to the Director of Transport and Environment.
Reason: In the interests of the amenity of the locality and to comply with Policy WLP35 (b) of the East Sussex and Brighton & Hove Waste Local Plan 2006.
14. Development shall not commence until details of wheel washing or cleaning facilities have been submitted to and approved in writing by the Director of Transport and Environment. The approved details shall be implemented in full before the commencement of construction and the facilities shall be maintained in working order at all times and shall be used by any vehicle carrying mud, dust or other debris on its wheels before leaving the site. No vehicle associated with the development shall leave the site carrying mud, dust or debris.
Reason: In the interests of highway safety and the amenity of the locality in accordance with Policy WLP36 (b) of the East Sussex and Brighton & Hove Waste Local Plan 2006.
15. The boundaries of the site compound, as shown on the approved block plan (scale 1:500), shall be defined by 2.4 metres high solid timber fencing together with 2.4 metres high solid timber gates, at all times, unless otherwise agreed in writing by the Director of Transport & Environment. The gates to the compound shall be securely closed and locked at all times other than when the compound is attended by site personnel.
Reason: In the interests of the amenity of the locality and security of the site, in accordance with Policy WLP35 (b) of the East Sussex and Brighton & Hove Waste Local Plan 2006.
16. Prior to the installation and operation of any lighting to be used on site, details including the position, size and type of lights, the control mechanism and direction of any lamps to contain the spread of beam to the site shall be submitted to the Director of Transport and Environment for approval. Any lighting installed on site shall be fully in accordance with the approved details.
Reason: In the interests of the amenity of the locality and to accord with Policy WLP35 (b) of the East Sussex and Brighton & Hove Waste Local Plan 2006.

INFORMATIVE
1. The Applicant is advised that this development will require an Environmental Permit under the Environmental Permitting Regulations 2007 from the Environment Agency, unless an exemption applies. The applicant is therefore advised to contact the Environment Agency on 08708 506506.

Reasons for Approval
The proposal is of a modest scale. It should assist in increasing the amount of construction and demolition waste that is re-used and recycled. The use is considered appropriate in an industrial area, and the attached conditions should ensure there is no unacceptable effect on amenity, drainage or traffic conditions.
Subject to the recommended conditions, the proposal would comply with Policies: NRM1, NRM2, NRM4, W5, W6 and W17 of the South East Plan 2009, Policies WLP1, WLP13, WLP35, WLP36, WLP37 (c), WLP38 and WLP39 of the East Sussex and Brighton & Hove Waste Local Plan 2006, and Policies: ST3 (a-e), ST14 and CT1 of the Lewes District Local Plan 2003.
