RE: NAESB REQ Data Privacy Task Force Meeting Notes – March 17, 2011

Dear Data Privacy Task Force Participants,

A conference call was held on March 17, 2011 to continue efforts to address request R10012 submitted by Reliant. The meeting took place from 1:00 pm to 3:00 pm Central. Mr. Booe served as counsel for the meeting. The notes below and the attachments to these notes serve as the record for the meeting.

Administrative / Ms. Wright welcomed the participants on the phone and opened the meeting. Mr. Booe provided the antitrust guidance. Ms. Wright reviewed the agenda and asked if anyone would like to make any modifications. Mr. Ackerman moved to adopt the agenda as drafted and Mr. Foliano seconded the motion. The agenda was adopted without opposition.

Status Updates on Team Assignments / Team 4
Ms. Wright provided an update of the team four activities and reviewed the NRRI summary drafted by Mr. King. Ms. Wright stated that the team four summaries would be finalized prior to the next meeting and ready for review by the recommendation drafting team.
Team 5
Ms. Harris reviewed the activities of team five and provided and reported the results of the Connecticut summary. Ms. Rinehart noted that HB 1079 related to smart grid technology and customer information disclosure is currently on the floor of the Oklahoma House of Representatives and that she will have a report on that legislation as soon as it is approved. Ms. Rowley reviewed the Nevada state summary. Ms. Harris stated that the team is still reviewing the activities of twenty states identified by the group and will compile of the information into a single summary as soon as possible. Mr. Villarreal asked if any of the team five participants have noted any state legislation related to EPA benchmarking rules in their research. Ms. Harris stated that she would follow up with Mr. Villarreal.
Review of Drafting Team Progress. / Ms. Zientara and Mr. Precht provided a review of the progress made by the recommendation drafting team and reviewed the Model Business Practice and Principle Matrix and Issues Document. The participants supported the term Smart-Meter Based Information and the definition recommended by the drafting team as it is both broad and general. The participants reviewed the resolutions proposed by the drafting team and made minor modifications based upon discussion. The participants agreed that it needs to be clearly defined which principles and model business practices are applicable to utilities disclosing information and which are applicable to the privacy practices that must be employed by third parties. Ms. Wright recommended that the participants review the resolutions offline and be prepared to make comments during the next Task Force conference call.
