DECLARATORY AFFIDAVIT

We, 1) SriAshok Kumar, S/o ______, aged about 60 years, 2) Sri. Praveen Kumar , S/o Ashok Kumar , aged about 38 years, 3) Smt.Sangeetha Kumari, aged about 36 years, daughter Ashok Kumar, 4) Sri. Praveen Kumar , S/o Ashok Kumar, aged about __ years, 5) S/o Ashok Kumar,all are residing at Corporation No.1 (BDA Site No.1065-B, formerly the northern portion of Old No.123, re-numbered as 1064/1, “E” Main Road) situated at Pipeline, “E” Main Road, Gokul I Stage, IV Phase, having Property Identification No.7-68-1, Malleswaram Division, Ward No.7, Bangalore, do hereby solemnly jointly affirm, confirm and state on oath as follows:

  1. We at Sl.Nos.1 to 5 do hereby state that we are the husband, son/s and daughter/s of Smt. Leelavanthi respectively and all are residing at
  2. We state that Smt. Leelavanthi, W/oAshok Kumaris the sole and absolute owner of all that piece and parcel of the immovable property bearing Corporation No.1 (BDA Site No.1065-B, formerly the northern portion of Old No.123, re-numbered as 1064/1, “E” Main Road) situated at Pipeline, “E” Main Road, Gokul I Stage, IV Phase, having Property Identification No.7-68-1, Malleswaram Division, Ward No.7, Bangalore which is morefully and particularly described in the Schedule hereunder and hereinafter referred to as the Schedule Property having acquired the same by virtue of a registered Gift Deed dated 25-01-2006 which has been duly registered as Doct.No.6093/2005-06, Book – I, and stored in C.D.No.84 in the Office of the Sub-Registrar, Rajajinagar, Bangalore duly executed by her mother Smt.Shanthi Bai, W/o Late Kewalchand.
  1. That Sri.Kewalchand, S/o Sri.Bhima Raj was the absolute owner of the Schedule Property being the Northern Portion of immovable property bearing Old No.123, Municipal Corporation No.1064/1 measuring East to West – 37 Feet and North to South – 47 feet he having purchased the same by way of a registered Sale Deed dated:05-03-1990 registered as Document No.4632/1989-90, in Book – I, Volume No.1089 at pages 209 to 214 in the office of the Sub-Registrar, Rajajinagar, Bangalore from his predecessors in title Sri.B.Loknatha Naidu S/o Sri.B.Narayana Swamy Naidu, duly represented by his Power of Attorney Holder Sri.B.Radhakrishnama Naidu S/o Sri.B.Narayana Swamy Naidu. Further the aforesaid Sri.B.Loknatha Naidu S/o Sri.B.Narayana Swamy Naidu, duly represented by his Power of Attorney Holder Sri.B.Radhakrishnama NaiduS/o Sri.B.Narayana Swamy Naidu has also executed a Rectification Deed dated:26-10-1991 in favour of Sri.Kewalchand, S/o Sri.Bhima Raj which is duly registered as Doct.No.3027/1991-92, in Book – I, Volume No.1295 in the Office of the Sub-Registrar, Rajajinagar, Bangalore wherein the details of the description of the property as given by BDA bearing No.1065-B, Gokula I Stage, 4th Phase is included in the Schedule.
  1. That Sri.Kewalchand, S/o Sri.Bhima Raj died intestate on 02-01-1993 and after his demise the Schedule Property devolved to his wife Smt.Shanthi Bai, W/o Late Kewalchand. Subsequently the family members of Late Kewalchand viz., Smt.Pushpa Bai, W/o Late Sajjan Rao, (deceased son of Late Kewalchand) Ms.Mamtha, Ms.Sunitha and Master Tarun being minor duly represented by his mother and natural guardian Mr.Pushpa Bai duly executed a Deed of Release dated: 25-01-2006 registered as Doct.No.6086/2005-06, Book – I, and stored in C.D.No.84 in the Office of the Sub-Registrar, Rajajinagar, Bangalore releasing and relinquishing their respective shares, rights and interest over the Schedule Property to and in favour of Smt.Shanthi Bai, W/o Late Kewalchand. Further, the other legal heirs of Late Kewalchand namely Smt.Leelavanthi, Sri.Tharachand, Sri.Prakashchand, Smt.Kamala Bai, Smt.Indira Bai, Sri.Ramesh Kumar and Sri.Mahaveer Chand also have executed a Deed of Release dated:25-01-2006 registered as Doct.No.6092/2005-06, Book – I, and stored in C.D.No.84 in the Office of the Sub-Registrar, Rajajinagar, Bangalore releasing and relinquishing their respective shares, rights and interest over the Schedule Property to and in favour of Smt.Shanthi Bai, W/o Late Kewalchand. Accordingly, Smt.Shanthi Bai, W/o Late Kewalchand became the absolute owner in title and possession of the Schedule Property and has been enjoying the same as absolute owner thereof.
  1. That the aforesaid Smt.Shanthi Bai, W/o Late Kewalchand subsequently out of her natural love and affection and out of her own free will, desire and volition has offered to gift the Schedule Property to her daughter Smt. Leelavanthi, W/o ______and on her acceptance has executed a registered Gift Deed Gift Deed dated 25-01-2006 which has been duly registered as Doct.No.6093/2005-06, Book – I, and stored in C.D.No.84 in the Office of the Sub-Registrar, Rajajinagar, Bangalore under the terms of which Smt Leelavanthi, W/o ______became entitled to own and possess the Schedule Property.
  1. That further the aforesaid Smt. Leelavanthi, W/o ______has executed a Sale Deed dated ______in favour of the Sri. ______S/o ______which has been duly registered as Doct.No.______/2010-11, Book – I and stored in C.D.No.__ with the Sub-Registrar, Rajajinagar, Bangalore duly conveying the Schedule Property to and in favour of Sri.______S/o ______.
  1. I/We hereby confirm, affirm and state on oath that on and from the date of sale of the Schedule Property in favour of the said Sri.______S/o ______, has become the sole and absolute owner thereof and is in peaceful possession and enjoyment of the same till date and ourselves any members of the family and / or any other person/s through succession or inheritance through ourselves shall have no manner of right, title, interest, claim or share in the Schedule Property in any manner whatsoever.
  1. This affidavit is sworn to by us only to state that the aforesaid legal position clearly and specifically for removal of any doubts and also to avoid any future controversy and / or legal complications regarding the same. We the aforesaid do hereby jointly affirm confirm and covenant that we, any other person/s claiming any rights through ourselves shall not be entitled any claim on the Schedule Property.
  1. We also hereby covenant, state on oath affirm and confirm that this affidavit can be used as a legal record/s and evidence in support of the matters mentioned above. We and any person/s claiming any right through us are fully estopped from questioning the correctness, veracity and legality of the matters mentioned above and the absolute title and ownership rights with possession of the Schedule Property now vest with the aforesaid Sri.______S/o ______in pursuance of the Deed of Sale dated:______executed by Smt. Leelavanthi, W/o ______.
  1. We do hereby jointly declare that the facts stated above are true and correct and in confirmation of the above facts, we are executing this affidavit on this the __ day of ______2010 at Bangalore.

All that piece and parcel of the immovable property being residential house property Corporation No.1 (BDA Site No.1065-B, formerly the northern portion of Old No.123, re-numbered as 1064/1, “E” Main Road) situated at Pipeline, “E” Main Road, Gokul I Stage, IV Phase, , having Property Identification No.7-68-1, Malleswaram Division, Ward No.7, Bangalore together with the building thereon comprising of 1400 Squares building in the ground floor with RCC roofing, 1400 Squares building in the First floor with ACC sheet roofing with Red oxide flooring, brick wall with cement mortar, jungle wood doors and windows together with water, light and sanitation and including all rights, privileges and appurtenances thereon and the site measuring:

East to West: 35 Feet

North to South:47 Feet

Total Area:1,739 Square Feet

and bounded on the:

East by :Property belonging to Smt.Seethalakshmamma and Mr.Narasimha Raya;

West by:Road;

North by :Property bearing No.21/1;

South by:Property belonging to Smt.Lalithamma.
