Decision: Grant Permission

Conditions:

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

Reason: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990 (as amended).

2. Details of materials to be used on the external elevations shall be submitted to and agreed in writing by the Local PlanningAuthority prior to the development being commenced.

Reason: In the interests of the appearance of the locality, in accordance with Policies LQ1, LQ4 and SR3 of the BlackpoolLocal Plan 2001-2016.

3. a) The landscaping works shall be carried out in accordance with the approved details within the first planting seasonfollowing completion of the development hereby approved or in accordance with a programme agreed in writing by theLocal Planning Authority (whichever is sooner).

b) Any trees or shrubs planted in accordance with this condition which are removed, uprooted, destroyed, die, or becomeseverely damaged or seriously diseased within 5 years of planting shall be replaced within the next planting season bytrees or shrubs of similar size and species to those originally required to be planted, unless the Local Planning Authoritygives its written consent to any variation.

Reason: To ensure the site is satisfactorily landscaped in the interests of visual amenity and to ensure there areadequate areas of soft landscaping to act as a soakaway during times of heavy rainfall with regards to Policy LQ6 of theBlackpool Local Plan 2001-2016.

4. Unless otherwise agreed in writing with the Local Planning Authority the net non-food retail floorspace within the foodsuperstore shall not exceed 2,000 square metres

Reason: To protect the continuing viability and vitality of the town centre in accordance with Policy BH12 of the BlackpoolLocal Plan 2001-2016.

5. Prior to the commencement of development a Construction Environmental Management Plan shall be submitted to andagreed in writing by the Local Planning Authority. The agreed plan shall outline the measures to mitigate against adverse

impact on the amenities of nearby residential and business premises during construction of the block and shall includenoise management measures (including controls on times for significant noise generating processes, duration andmaximum noise output levels), waste minimisation, construction hours of working, wheel washing, vibration management,dust management, vermin control, vehicle control within the site and localised traffic management and protocols forcontact and consultation with local people and other matters to be agreed with the Local Planning Authority. The agreedplan shall be implemented upon commencement of development and shall not be varied without the prior writtenagreement of the Local Planning Authority.

Reason: To safeguard the living conditions of the occupants of nearby residential and business premises in accordancewith Policy BH3 of the Blackpool Local Plan 2001-2016.

6. Prior to the commencement of development a car park management strategy for the operation of the approved car parkshall be submitted to and agreed in writing by the Local Planning Authority (and shall not be varied unless otherwiseagreed in writing by the Local Planning Authority). The approved strategy for the car park shall be implemented inaccordance with a timetable to be submitted to and agreed in writing with the Local Planning Authority.

Reason: To ensure that car parking demand within the Town Centre is adequately managed in accordance with PoliciesSR3, BH3 and AS1 of the Blackpool Local Plan 2001-2016.

7. Before the development is commenced a Site Waste Management Plan shall be submitted to and approved by the LocalPlanning Authority (including recycling) during the demolition and construction stage. The demolition and constructionshall then proceed in accordance with the approved plan unless otherwise agreed in writing with the Local PlanningAuthority.

Reason: To assist in securing waste minimisation, re-cycling and energy conservation in accordance with Policy LQ8 ofthe Blackpool Local Plan 2001-2016

8. The use hereby approved shall not be commenced until the servicing provisions, including manoeuvring areas, have beenprovided in accordance with the approved details; such areas shall not be used thereafter for any purpose other than that

indicated on the approved plan and all servicing within the site including loading and unloading shall take place fromwithin the servicing area shown.

Reason: In the interests of the appearance of the locality and highway safety, in accordance with Policies LQ4 and AS1 ofthe Blackpool Local Plan 2001-2016.

9. Prior to the development hereby approved being first brought into use the car, motorcycle and cycle parking provisionshown on the deposited plans shall be provided and shall thereafter be retained.

Reason: In the interests of the appearance of the locality and highway safety, in accordance with Policies BH3, LQ1 andAS1 of the Blackpool Local Plan 2001-2016.

10. The development shall not be occupied until a Travel Plan has been submitted to and approved in writing by the LocalPlanning Authority. Such Travel Plan shall include the appointment of a travel co-ordinator and a format that consists ofsurveying, travel audits, a working group, action plans with timescales and target setting for the implementation of eachelement.

No part of the development shall be occupied prior to the implementation of the Approved Travel Plan (or implementationof those parts identified in the Approved Travel Plan as capable of being implemented prior to occupation). Those parts ofthe Approved Travel Plan that are identified therein as being capable of implementation after occupation shall beimplemented in accordance with the timetable therein and shall continue to be implemented as long as any part of thedevelopment is occupied.

Reason: In order to ensure appropriate provision exists for safe and convenient access by public transport, cycle, and onfoot as well as by car, in accordance with Policy AS1 of the Blackpool Local Plan 2001 – 2016.

11. No goods shall be stored or displayed for sale other than within the building shown on the deposited plan.

In the interests of the appearance of the locality, in accordance with Policy LQ1 of the Blackpool Local Plan2001-2016.

12. Prior to the development hereby approved being first brought into use the refuse storage provision shown on thedeposited plans shall be provided and shall thereafter be retained.

Reason: In the interests of the appearance of the locality and the residential amenity of occupants and neighbours, inaccordance with Policies LQ1 and BH3 of the Blackpool Local Plan 2001-2016.

13. The remediation scheme shall be implemented and completed prior to the commencement of the development inaccordance with the submitted Remediation Statement (Arup ref REP/geo/02 Issue 3 Sept 2011. Any changes to theapproved scheme shall be agreed in writing with the Local Planning Authority.

Reason: To ensure a safe form of development that poses no unacceptable risk of pollution to water resources or tohuman health and in accordance with Policy BH4 of the Blackpool Local Plan 2001-2016.

14. Notwithstanding the submitted Lighting Impact Assessment the external illumination of the building shall be carried out inaccordance with details to be submitted to and approved in writing by the Local Planning Authority and the approveddetails shall be fully implemented prior to the first use of the building and shall be retained thereafter.

Reason: To maximise the positive visual impact of the development in the interests of the appearance of the locality, inaccordance with Policies LQ1, LQ2, LQ4, SR3 and BH3 of the Blackpool Local Plan 2001-2016.

15. No development shall take place on the site until the applicant, or their agent or successors in title, has secured theimplementation of a programme of archaeological work. This must be carried out in accordance with a written scheme ofinvestigation, which shall first have been submitted to and agreed in writing by the Local Planning Authority.

Reason: To ensure and safeguard the recording and inspection of matters of archaeological/historical importanceassociated with the site in accordance with Policy LQ1 of the Blackpool Local Plan 2001-2016.

16. The development shall be carried in accordance with the details outlined in the Drainage Strategy ReportREP/122202/c001 Issue 3 Sept 8th 2011 & Flood Risk Assessment REP/CHL Issue - August 2011 prior to the firstoccupation of the store and shall be retained thereafter.

Reason: To ensure that the scheme is delivered in a sustainable manner and to reduce the risk of flooding in accordance withPolicy LQ1 of the Blackpool Local Plan 2001-2016.

17. Unless otherwise agreed in writing with the Local Planning Authority the road layout shown blue on the submittedproposed highway layout (Arup Ref: BTG-ARP-SW-LA-CH-902F) and approved under application submission 11/0723shall be implemented prior to the occupation of the retail store.

Reason: In the interests of highway safety, residential amenity and to minimise congestion on the approaches to thedevelopment and to the town centre in accordance with Policies LQ1, SR3, BH3 and AS1 of the Blackpool Local Plan

2001-2016

18. The timetable for delivering the public realm shown on the submitted plans and accompanying documents shall be agreedin writing with the Local Planning Authority prior to the commencement of the development hereby approved.

Reason: To ensure that the public realm is delivered to correspond with the completion of the retail store hereby approvedand the other elements of phase 1 as far as is possible to maximise the cumulative regeneration benefits of thedevelopments at the earliest possible date with regards to Policies SR3, LQ1, LQ3, LQ5, LQ6 and BH3 of the BlackpoolLocal Plan 2001-2016.

19. The development hereby approved shall be implemented and operated in accordance with the submitted 'SupermarketDelivery Noise Assessment' R02-BJC Issue Nov 2011.

Reason: In the interests of residential amenity with regards to Policy BH3 of the Blackpool Local Plan 2001-2016

20. Notwithstanding the requirements of condition 19 deliveries to the store between 22-00 and 07-00 hours on the followingday shall be restricted to the following:-

3 deliveries between 22-00 and 02-00 hours on the following day

3 deliveries between 05-00 and 07-00 hoursthis restriction does not include deliveries of bread and milk between 22-00 and 02-00 hours on the following day andbetween 05-00 and 07-00 hours.

Reason: In the interests of residential amenity with regards to Policy BH3 of the Blackpool Local Plan 2001-2016.

21. Notwithstanding the submitted plans staff cycle parking, storage lockers and changing/ washing facilities shall be providedin accordance with details to be submitted to and agreed in writing with the Local Planning Authority prior to the first use ofthe store.

Reason: To encourage a sustainable form of travel in accordance with Policies AS1 and AS3 of the Blackpool Local Plan2001-2016

Reasons for decision:

The proposal has been considered in relation to Policies LQ1, LQ2, LQ3, LQ4, LQ5, LQ6, LQ7, LQ8, LQ11, BH3, BH4,BH11, BH12, AS1, AS2, AS3 and SR3 of the Blackpool Local Plan 2001 - 2016 and is in accordance with those policies

and there are no other material considerations which weigh sufficiently against the proposal such as to warrant refusal.

Decision: Grant Permission

Conditions:

1. The development hereby permitted shall be begun before the expiration of three years from the date of this permission.

Reason: Required to be imposed pursuant to Section 91 of the Town and Country Planning Act 1990 (as amended).

2. All external holiday signage and canopies shall be removed and the surfaces behind made good prior to first occupation.

Reason: In order to establish appropriate residential character at the property in the interests of the appearance of theproperty and locality in accordance with Policy HN5 of the Blackpool Local Plan 2001-2016.

3. No flat hereby permitted shall be occupied either wholly or in part until all internal and external alterations shown on theapproved plan(s) have been completed. These approved internal and external alterations shall thereafter be retained.

Reason: In order to ensure that the accommodation accords with the Council's approved 'New Home from Old Places'Supplementary Planning Document in the interests of residential amenity and the external appearance of the property and

locality in accordance with Policies LQ1, LQ14, BH3 and HN5 of the Blackpool Local Plan 2001-2016.

4. The roof slates to be used following the removal of the existing dormers shall be Eternit 'blue-grey' slates to match thoseexisting.

Reason: In the interests of appearance of the locality, in accordance with Policies LQ1 and LQ14 of the Blackpool LocalPlan 2001 – 2016.

5. Prior to the flats hereby approved being first occupied, the refuse storage provision shown on the approved plan shall beprovided and shall thereafter be retained.

Reason: In the interests of the appearance of the locality and the residential amenity of occupants and neighbours, inaccordance with Policies LQ1 and BH3 of the Blackpool Local Plan 2001-2016.

6. Prior to the flats hereby approved being first occupied, the cycle storage provision shown on the approved plans shall beprovided and shall thereafter be retained.

Reason: To enable access to and from the property by sustainable transport mode, in accordance with Policy AS1 of theBlackpool Local Plan 2001-2016.

Reasons for decision:

The development proposed has been considered in relation to Policies RR8, HN4, HN5, HN6, BH3, LQ1, LQ14 and AS1of the Blackpool Local Plan 2001 - 2016 and is in accordance with those policies and there are no other materialconsiderations which weigh sufficiently against the proposal such as to warrant refusal.

Application number: 11/0809 201 PROMENADE, BLACKPOOL, FY1 5DL

Decision : Refuse

Reason for decision:

The use of part of the ground floor of the premises as a restaurant/cafe would conflict with Policies BH17 and RR7 of theBlackpool Local Plan 2001-2016 in that the property is located within a terrace of hotels/guesthouses which exhibit astrong holiday character and the aim of the policies is to consolidate this holiday function and to direct restaurants andcafes to existing shopping frontages where they will add vitality to the mix of retail and commercial uses. The introductionof a restaurant/cafe to this Promenade frontage would make it more difficult to resist other similar uses which would dilutethe character of the hotel orientated sections of the Promenade and detract from the vitality and viability of existingshopping frontages.
