AN ACT TO AMEND ACT 939 OF 1954, AS AMENDED, RELATING TO THE CREATION OF THE INMANCAMPOBELLO WATER DISTRICT IN SPARTANBURG COUNTY, SO AS TO INCREASE THE NUMBER OF COMMISSIONERS SERVING ON THE INMANCAMPOBELLO WATER DISTRICT COMMISSION FROM THREE TO FIVE, TO DELETE AN OBSOLETE REFERENCE TO THE SPARTANBURG COUNTY DELEGATION’S SENATOR, TO DELETE A REFERENCE TO THE TERMS OF SERVICE FOR THE WATER DISTRICT’S ORIGINAL COMMISSIONERS, AND TO PROVIDE FOR THE TERMS OF SERVICE FOR THE TWO ADDITIONAL COMMISSIONERS.
Be it enacted by the General Assembly of the State of South Carolina:
Inman-Campobello Water District Commission
SECTION 1. Section 2 of Act 939 of 1954 is amended to read:
“Section 2. The district must be operated and managed by a commission to be known as ‘InmanCampobello Water District Commission’. The commission shall consist of five resident electors of the district, who must be appointed by the Governor, upon the recommendation of a majority of the Legislative Delegation of Spartanburg County. The appointments are for a term of six years, and in all cases those persons holding office shall continue to hold office until their successors have been appointed and have qualified. The initial terms of office begin as of the effective date of this act, notwithstanding that this may effect a lessening of the duration of the terms of office of the initial members of the commission. Upon the termination of office of any commissioner, a successor must be appointed by the Governor, upon the recommendation of a majority of the Legislative Delegation of Spartanburg County for a term of six years. Any vacancy occurring in the office of commissioner by reason of death, resignation, or otherwise must be filled for the remainder of the unexpired term by appointment of the Governor, upon the recommendation of a majority of the Legislative Delegation of Spartanburg County.”
Terms of office
SECTION 2. The two additional commissioners added pursuant to the provisions of Section 1 of this act are appointed so that the term of one commissioner shall expire in 2003 and the term of the other commissioner shall expire in 2005. After the expiration of the initial terms of these two additional commissioners, each must be appointed for a term of six years.
Time effective
SECTION 3. This act takes effect upon approval by the Governor.
