Data re-use declaration licence

1. I understand that in using the Data provided to me (“You/Your/I”), I am aware of, and agree to, the following conditions and obligations of Licence:-

  • That the Licence begins on the date that we provide You with the Data and will continue for a period of one year.
  • To let us know in writing (by post or email) of any change to Your details.
  • Not to present out-of-date Data as being current.
  • To ensure that You do not use the Data in a way that suggests any official status or that We endorse You or Your use of the Data.
  • To ensure that You do not mislead others or misrepresent us or the Data.
  • To acknowledge the source of the Data.
  • To feature any copyright statement as directed by Us.
  • Not to reproduce Our logo(s) unless they form an integral part of the Data and You are reproducing them in that context.
  • To send Us, if we ask for it, one complimentary copy of your product.
  • Sub clauses 2, 3, 4, 5 and 6 in the data users declaration are incorporated into this Licence.

2. This Licence is granted to You subject to Your payment of the fee in accordance Our charging schedule.

3. All payments will be subject to VAT (where applicable) at the rate in force at the due time for payment.

4. This Licence may be ended by Us at any time if there is a material breach of the terms of this Licence and you do not put this right within 30days of Our telling You or in order for Us to comply with any legal requirement.

5. Ending this Licence shall not affect Our right to payments and information related to payments under this Licence and no refunds will be given to You.

6. You must not assign or sub-license (without Our written consent) your rights under this Licence to any other person.

7. This Licence is governed by the laws of England.

8. Privacy Notice

  • Hampshire County Council collects information about you for in order to provide you with Historic Environment Record information.
  • We will use the information to inform you of future changes to charges and services, to allow us to analyse patterns of use and trends of service use, for service and financial planning and to process financial transactions.
  • The legal basis for our use of this information is where it is necessary for the performance of a task carried out in the public interest in the exercise of official authority vested in the County Council.
  • We may share your personal information with colleagues in our admin team for the purpose of raising invoices.
