Order Dismissing Deferred Disposition (ORDSDD)

I. Findings

1.1  An Order of Deferred Disposition was previously entered and has not been revoked. The juvenile completed the terms of supervision, and, where restitution was imposed, the juvenile has either paid restitution or made a good faith effort to pay. There are no pending motions to revoke and the juvenile is thus entitled to a dismissal contemplated by RCW 13.40.127(9). The juvenile is also entitled to have any conviction in this case, except a conviction under RCW 16.52.205 (Animal Cruelty First Degree), vacated pursuant to RCW 13.40.127(9).

1.2  Restitution: None owing at this time Unpaid restitution remains, however the court found the juvenile made a good faith effort to pay restitution as required by
RCW 13.40.127(9) and RCW 13.50.010(1)(a), and, the court shall now enter a restitution order pursuant to RCW 7.80.130 for any unpaid restitution. Jurisdiction to enforce payment and to modify terms of the restitution order shall be the same as those set forth in RCW 7.80.130.

II. Order

2.1  Dismissal of the Case: This case is dismissed with prejudice as a completed deferred disposition under RCW 13.40.127. Any conviction in this case, other than a conviction under RCW 16.52.205 (animal cruelty, first degree), is vacated.

2.2  Eligibility to Seal Record under RCW 13.40.127(10): The court shall take further action regarding sealing this case:

Eligible To Seal Because No Restitution Is Owing - There is either no restitution or the restitution has been paid in full and the juvenile is therefore entitled to have his or her case sealed under RCW 13.40.127(10) by administrative order:

Age 18 or older - The juvenile is at least eighteen years of age. At this time the court will enter an order sealing this case.

Under age 18 - An administrative review is set for (date) ______at ______a.m. (set within 30 days following juvenile’s eighteenth birthday) at which time the court will enter an order sealing records in this case. The juvenile is not required to appear at this hearing.

Eligible to seal because age 18 and only insurance restitution is owing – The juvenile is at least eighteen years of age today and there is no restitution owed to any named victim except insurance provider(s). The juvenile is entitled to have his or her case sealed under
RCW 13.40.127(10) by administrative order. At this time the court will enter an order sealing the case.

Not Eligible To Seal Due To Unpaid Restitution - The juvenile is not eligible for sealing under RCW 13.40.127(10) because at this time either: (1) the juvenile is under the age of 18 today and unpaid restitution remains in the case; or, (2) the juvenile is at least 18 years old but restitution remains unpaid to a non-insurance victim. A restitution order for the unpaid amount will be entered. Any further motions to seal records may be brought pursuant to RCW 13.50.260.
