owithin14dayspostinaconspicuouslocationonthepropertyon whichthebuildingorstructureis tobe demolisheda signatleast24x36providingpublicnotice.Thesignshallincludethetextofthenoticeof intentandshallcontaintheworddemolitionincapitallettersnolessthan2 inchesinheightsignsshall berequiredtobepostedfornotlessthan14days.Ownershallberequiredtoprovidephotographsof thesigntotheBuildingDepartment.MCO6‐7(b)(3)

oWithin14daysafterfilingtheapplicationtodemolishadesignatedstructuretheapplicantshallfilein theBuildingDepartmentanaffidavitunderoath,onaformprovidedbytheBuildingDepartment (ExhibitB)andincludea copyofthenoticeofintent,photosofthepostedsign,andthemailing certificates.MCO6‐9

oFordesignatedstructuresthereshallbe a90daywaitingperiodunlesswaivedbythecityhistorian.City historianshallrespondwithhis/herobjectionswithin30daysofthefilingoftheapplication.MCO6‐10

oAnyobjectiontothedemolitionoftheabovebuildingorstructuremustbefiledinwritingwiththe buildingDepartmentwithin30daysofthedateofmailingofthisnotice.MCO6‐10

2.) RequirementsfortheIssuanceofDemolitionPermit:

oWiththecompletionsubmissionandacceptanceoftheaboveaDemolitionPermitwillbeissuedsubject totheBuildingDepartment’sreceiptandacceptanceofthefollowing;

oPermitfeein theamountof$15forthe1st$1000plus$6foreachadditional$ 1000MCO6‐1

oDemolitionpermittoissuedtoandtheworkprovidedbyaDemolitioncontractor

evidence(1)offinancialresponsibilityintheformofa certificateofinsurancespecifying

demolitionpurposesandprovidingliabilitycoverageforbodilyinjuryofatleastonehundred thousanddollarsperpersonwithanaggregateofatleastthreehundredthousanddollars,and forpropertydamageofatleastfiftythousanddollarsperaccidentwithanaggregateofatleast onehundredthousanddollars;CGS29‐406

Aseparatedeclarationfromthecontractor,oncompanyletterheadsignedbyanofficerof thecompany,withthefollowingsaveharmlessstatement:

29‐402, exceptions:

apersonwhoisengagedinthedisassembling,transportationandreconstructionofhistoric buildingsforhistoricalpurposes

orwhoisengagedinthedemolitionoffarmbuildings

orintherenovation,alterationorreconstructionofa single‐familyresidence,

oranownerwhoisengagedinthedemolitionofasingle‐familyresidenceoroutbuilding,as providedinsubsection(c)ofsection29‐402.

oIfDemolitionPermitis appliedforbythehomeownerandthehomeownershallprovidethedemolition work:

thedemolitionofasingle‐familyresidenceoroutbuildingbyanownerofsuchstructureif it does notexceeda heightofthirtyfeet,provided(A)theownershallbepresentonsitewhile suchdemolitionworkisin progressandshallbeheldpersonallyliableforanyinjuryto individualsordamagetopublicorprivatepropertycausedbysuchdemolition,and(B)such demolitionshallbepermittedonlywithrespecttobuildingswhichhaveclearancefromother structures,roadsorhighwaysequaltoorgreaterthantheheightofthestructuresubjectto demolition.Thelocalbuildingofficialmayrequireadditionalclearancewhendeemednecessary forsafety.

(2)intheformofa certificateofnoticeexecutedby allpublicutilitieshavingserviceconnections withinthepremisesproposedtobedemolished,statingthatsuchutilitieshaveseveredsuch connectionsandservice;CGS29‐406

PriortocommencingdemolitioncontacttheMilfordFireDepartmentandinformthemofproposeddateofcommencing demolition

(a) Nopersonshallremoveordemolishanybuildingorstructureorpartthereofwithoutprovidingadequatesafety measuresforallworkmenandsuitableprotectionsforthepublic.

(b) Nopersonshalldemolishanybuildingorstructure,withoutcausingtobeerectedandmaintained,fortheduration

ofthedemolitionoperations,afenceorbarricademeetingtherequirementsofthissection.Eachsuchfenceor barricadeshallbeadequateforsafety;shallbenotlessthaneightfeethigh;shallextendalongthestreetlinefor theentirelengthofthebuildingorstructurefacingonthestreet,witheachendreturningbacktothebuildingline, andshallbesolidforitsentirelength,exceptforsuchopenings,providedwithslidingdoorsswinginginward,as may benecessaryfortheproperprosecutionofthework.Thebuildingofficialmaywaivetherequirementsofthis subsection,ormaymakesuchfurtherrequirementsashedeemsnecessaryfortheprotectionofthepublic,the adjoiningpropertiesoranypersonaltyofsuchownersanditsuse.CGS29‐408

(c) Nopersonshalldemolishanybuildingorstructureorpartthereof,whensuchbuilding,structureorpartiswithinsixfeetofastreetline,oristwelvefeetormoreinheight,oris withinsixfeetofanareawhichtheownerorlessee providesandinvitesthepublictouseasitwouldapublicway,orwhenthedistancebetweensuchstreetlineor area andsuchbuilding,structureorpartis morethansixfeetbutlessthanone‐halfthetotalheightoftheobjectto bedemolished,withoutcausingtobeerectedandmaintainedasidewalkshedmeetingtherequirementsofthis section.Suchshedshall:(1)Extendforthefulllengthofthebuildingonallstreetfronts;(2)existforthedurationof thedemolitionoperations;(3)benotlessthanfourfeetwideandsixfeeteightincheshighin theclear;(4)be watertight,and(5)beadequatelylightedforpedestriantraffic.Whentheroofofanysuchshedis usedforthe storageofmaterialorfortheperformanceofworkofanykind,adequaterailings,notlessthanthreefeethigh,and

solidtoeboards,notlessthansixincheshigh,shallbeaffixedalongtheopensidesandendsofsuchroofs.Theroofs ofsuchshedsshallbeofsufficientstrengthandstabilitysafelytosustaintheweightofmaterialsthatmaybeplaced thereonandtheshocksincidentaltothehandling,preparationforuse,truckingordeliveryofmaterials.The requirementsofthissection,astheyrelatetostreetlines,shallnotapplyinanycaseinwhichallsuchstreetsare officiallyclosedtopedestrianandvehiculartraffic.Thebuildingofficialmaywaiveanyoftherequirementsofthis section,if theobjecttobedemolishedismorethanfortyfeetfromanystreetlineorareausedasa publicwayand its demolitionisaccomplishedbytheremovalofonestoryata time.CGS29‐409

(d) Nopersonshalldemolishanystructureorbuildingwithoutmakingsuitableprovisionforthedisposalofall accumulatedmaterials.Nopersonshalloverloadanypartoftheprotectivestructureserectedduringthedemolition operationsby storage,materialsordebristoanextentbeyondtheliveloadcapacity.Nopersonshall,duringdemolitionoperations,allowmaterialstoaccumulatewhichwould,bytheirnature,uponremoval,causean excessiveamountofdust,dirtordebrisintheair,withoutsuitablywettingdownsuchaccumulationswithwater, dehydratedlimeorsomesimilaragent.CGS29‐412

(e) Basementsandcellars.Nopersonshallallowanybasement,cellar,holeortheliketoremainuncoveredoropened asaresultofthedemolitionofanybuilding,structureorpartthereof.Eachpersonwho,ina demolitionoperation, uncoversoropenssucha basement,cellar,holeorthelikeshallfillthesametogradeandremoveallexcess materials,rubbishanddebrisfromthepremises.If a newbuilding,structureorpartthereofistobeerectedonthe siteofsuchdemolishedpremises,thebuildingofficialmaywaiveanyoftheprovisionsofthissection.CGS29‐413
