THIS MATTER having come before the Court on an Application to Vacate and Seal Alcohol Age violation in accordance with I.C. § 18-1502(6):

THIS COURT FINDS AND CONCLUDES:

1)  That the Petitioner has been found guilty of only one (1) violation of I.C. § 18-1502 or I.C. § 23-604.

2)  That the Petitioner does not have any alcohol or drug related findings of guilt, in this state or any state, within five (5) years of the commission of this offense.

THEREFORE, IT IS ORDERED that the above entitled case is vacated and sealed from access as called for by Idaho Code § 18-1502(6).

IT IS FURTHER ORDERED, that this matter shall be sealed and the clerk shall designate the security group of the sealed matter thereby limiting access in accordance with the Court’s order. At any time hereinafter, there shall be no disclosure of any record in any expunged case file except as may be provided in Idaho Court Administrative Rule 32.

IT IS FURTHER ORDERED, that at all time hereinafter, the above-captioned proceedings shall be deemed never to have occurred and the Petitioner may properly reply accordingly upon any inquiry in the matter.
