SUBJECT: Change in Policy Concerning Unemployment Insurance Intercept

Effective immediately, Unemployment Insurance Agreements (Form CS-76) are to be completed on all cases when the noncustodial parent or obligor is receiving Unemployment Insurance (UI) benefits, regardless of whether there is a stop code on the case. Child support staff will still need to check 4B Option 6, from the KY-IMS menu, to obtain the information needed to complete the CS-76.

In the past, if there was a stop code on a UI case, child support staff were advised to discontinue UI intercept action and proceed with other administrative enforcement remedies. Per UI staff, stop codes are placed on a claim when there is an appeal, an overpayment, possible fraud, disqualification, employer protest, etc. Often times the stop code will be removed and the noncustodial parent or obligor will receive his/her UI benefits.

Once a CS-76 is received in UI, the intercept claim is set up on their computer system within a day. The UI intercept will occur the day that the noncustodial parent or obligor is issued a UI check. As UI benefit checks are issued every two weeks, the intercept may occur the next business day or it may be up to two weeks from the date the CS-76 was received. After completing the CS-76, staff are to set a tickler for one month for a case with no stop code and two months for a case with a stop code. When the ticklers appears, staff are to check to see if the Division of Child Support has received any UI intercept monies. If, after the two month tickler for a case with a stop code, there has been no money intercepted, child support staff must check 4B Option 6 to verify if the noncustodial parent or obligor is receiving UI benefits and if they are, whether CS is receiving the intercepted monies. If the stop code is still on the UI case, child support staff are to proceed with another enforcement remedy.
