Of the Common Council of the City of Phillips at a special meeting held in the council room on October 13, 2003.

Mayor Boho called the meeting to order at 7:18 PM. Council members present as listed below.

Others present: D.P.W. Staroba, Fire Chief Pisca, Fred Krenzke, Ryan Stutzman, Assistant Police Chief Lobermeier, Library Director Hendricks, and D.&.C.T. Revak.

Motion by Mrs. Wenzel, seconded by Mrs. Satterwhite to accept the retirement of Police Chief Craig A. Moore, effective January 3, 2004. Carried.

Motion by Mr. Kempkes, seconded by Mrs. Wenzel adopting resolution number 1042. Carried.

RESOLUTION #1042

NOW THEREFORE BE IT RESOLVED, the City of Phillips hereby creates the Phillips Citizen Corps Council for the purpose of helping the citizens to make the City of Phillips safer, stronger and better prepared to respond to threats of terrorism, crime and disasters of all kinds by, among other things, developing and/or implementing various new or existing governmental or grant programs as follows:

1)The members of the Phillips Citizen Corps Council shall be appointed by the Mayor with the approval of the Common Council.

2)There shall be at least 7 voting members (excluding the Mayor as an ex officio member having no vote) with a term to extend through December 31st of the year following appointment with at least one member being a Common Council member and at least one member being a City of Phillips police officer.

3)The Phillips Citizen Corps Council shall present an annual budget to the Common Council for approval once the Phillips Citizen Corps Council has received a binding commitment of third party grant approval establishing funding for such budget unless the Common Council shall commit funds to such Phillips Citizen Corps Council.

4)All funds expended by the Phillips Citizen Corps Council shall be administered through the office of the Phillips Clerk-Treasurer and no funds shall be expended until such time as a budget for the current year shall have been approved by the Common Council so as to create a proper audit trail for the City of Phillips.

5)To the extent that the Phillips Citizen Corps Council shall have any employees, said employees shall be subject to the employment standards and policies (including benefits) of the City of Phillips and all final personnel decisions shall be made by the Common Council and/or the Personnel-Budget-Finance Committee as may be the practice of the City of Phillips at that time.

6)To the extent that the Phillips Citizen Corps Council shall pay members or employees for meetings, training or expense reimbursement (including per diems and mileage), such payment shall not exceed the rates applicable to other committees of the City of Phillips, and

7)To the extent that an unappointed Phillips Citizen Corps Council has already received a binding commitment from the federal government for funding to the extent of $10,000 for calendar year 2003, all actions taken by the unappointed Phillips Citizen Corps Council are hereby ratified and funds up to the amount of said amount are hereby authorized to be expended by the Phillips Citizen Corps Council and administered through the office of the Phillips Clerk-Treasurer in compliance with, the above requirements in anticipation of the submission of proper documentation by the Phillips Citizen Corps Council in advance of the December 15, 2003 federal government deadline for reimbursement by federal grant funds.

Motion by Mr. Namtzu, seconded by Mrs. Wenzel to ratify the following slate of individuals to the Phillips Citizen Corps Council, terms to expire on December 31, 2004, as recommended by Mayor Boho. Carried.

Motion by Mr. Kempkes, seconded by Mrs. Wenzel to layoff the Police Secretary, based on Year 2003 department budget concerns, effective November 1, 2003. Alderpersons voting aye: Elvis Presley, Patti Wenzel, Leon Namtzu, Ted Kempkes, and Mary Satterwhite. Alderpersons voting nay: None. Carried.

The following are action items related to preparation of Year 2004 City Budget:

  1. The proposed fire department budget presented by Fire Chief Pisca was accepted in proposal form as presented at this time.
  2. City Attorney Marshall referenced Chapter 1.06, General Government, Municipal Code, City of Phillips, pertaining to salaries of elected officials. It was decided by council members to continue with the current pay scale for both the Mayoral and Alderperson positions.
  3. The Phillips Public Library proposed 2004 budget was presented.

Motion by Mrs. Wenzel, seconded by Mr. Presley to adjourn. Carried.
