Rules

This notice is to inform you of certain rules and regulations which the trustees of Tall Oaks at Winding Hills have passed pursuant to the Indenture of Trust and Restrictions for the Subdivision. The rules and regulations are intended to preserve property values and ensure that our homes remain attractive to prospective future buyers. It is important that all homeowners are in compliance with the Tall Oaks Indenture and the rules and regulations prescribed by the trustees as well as Wildwood and St. LouisCounty ordinances. Tall Oaks subdivision is about 15 years old and it is necessary to preserve the appearance and property values.

We have experienced two instances of absentee ownership in the subdivision in the last 12 months,with resultant complaints, as the property was not maintained per the Indenture or Wildwood ordinances and became an eyesore, nuisance and distraction. Presently an absentee landowner can rent to any party without any limitations, constraints or guidelines and without input by the trustees per the Indenture.

The following rule with respect to leasing of property within the subdivision has been patterned after similar language in other subdivision indentures and in accordance with Wildwood ordinances and state statutes.

The features are as follows:

1. Landowner must furnish a copy of the lease to the trustees.

2. Landowner must furnish his/her mailing address, phone number and be current in payment of annual fee, assessments and absent of any lien against the property.

3. Lessee must be a single family unit in conformance with Wildwood city ordinance (Sec. 225.030) and state statutes.

4. Lessee must furnish his/her name and phone number to the trustees and shall be subject to the terms and provisions of the Indenture.

The trustees have also approved a rule whereby the trustees may assess fines to landowner/lessee who continually violates rules of the Indenture.

Examples are: Failure to have trees trimmed by sidewalks and streets, failure to store garbage containers in the garage or rear of the house, failure to conform to Indenture requirements for pools, fences, etc:

The trustees would notify the landowner by mail of the violation and if not corrected in 30 days a fine of $50 would be assessed and if not paid within 30 days, then collection action or lien action would be initiated.

A late charge of $50 plus accrued interest will be assessed when fines or assessments are not paid by the due date.

Any outstanding fines, assessments or liens must be paid before any approval will be given to a homeowner for changes or additions per the Indenture.

In lieu of fines the trustees may contact the City of Wildwood who may initiate action and can issue a court citation for any violation of a City ordinance.
