On or about September 26, 2007, Rodolfo Morales became the subject of an Employee Relations investigation based upon the allegations of possession of firearm on school property and/or School Board Policies 1.013, Responsibilities of the School District Personnel and Staff, and/or 3.26, Possession of Firearm by a School District Employee/Contractor/Visitor on School District Property, in addition to 6B-4.009, Criteria for Suspension and Dismissal of the Florida Administrative Code.

On or about September 26, 2007, Mr. Morales is a custodian at Limestone Creek Elementary School. He notified Police Department Sergeant William Lammie of his concern of another custodian who possessed a knife which she displayed in a non threatening manner while giving her a ride home after work one night. Morales advised Sgt. Lammie that he brought his firearm to work and had it in a holster in a back pack located in a vehicle driven by another custodian who drove him to work. The firearm was taken by Sgt. Lammie. Morales has a concealed firearms permit.

Minutes:

On July 11, 2007, the Fourth District Court of Appeal reversed the decision of the State Board of Education to uphold this School Board's termination of the two charter agreements with Survivors Charter Schools, Inc. In addition, the Court remanded the case to the School Board so that the termination of Survivors charters based on a determination of good cause shown can be considered following proper notice and subject to the due process protections of the APA. The School Board filed several motions with the Court, including a motion for rehearing, and the Court by Order dated December 4, 2007, denied the motions.
