CITY OF BELVIEW

ORDINANCE NO. 5-2017

The City Council of the City of Belview, Minnesota, ordains as follows:

That Ordinance No. 14.2, Section 8, of the City Code of the City of Belview, be amended to allow for a 12:00 a.m. close on Sundays:

(G) On-sale Sunday intoxicating liquor license, which may be issued to the following establishments as defined by M.S. 340A.504, subd. 3a, as it may be amended from time to time, and this Ordinance: A restaurant, club, bowling center, or hotel with a seating capacity for at least 30 persons and which holds an on-sale intoxicating liquor license may sell intoxicating liquor for consumption on the premises in conjunction with the sale of food between the hours of 11:30 a.m. on Sundays and 12:00 a.m. on Sundays. Sunday licenses may be issued only with the approval of the Commissioner of Public Safety. The fee for the Sunday licenses established by the Council under Section 9 of this Ordinance shall not exceed the amounts provided for in M.S. 340A.504, subd. 3(b), as it may be amended from time to time. The Council may in its sound discretion authorize a retail Sunday on-sale licensee to dispense intoxicating liquor off the licensed premises at a community festival held within the City under the provisions of M.S. §340A.404, subd. 4(b), as it may be amended from time to time. The Council may in its sound discretion authorize a retail Sunday on-sale licensee to dispense intoxicating liquor off the licensed premises at any convention, banquet, conference, meeting or social affair conducted on the premises of a sports, convention, or cultural facility owned by the City, under the provision of 340A.404, subd. 4(a), as it may be amended from time to time; however the licensee is prohibited from dispensing intoxicating liquor to any person attending or participating in an amateur athletic event being held on the premises.
