Background

1.Pursuanttosection26oftheLiquorAct(theAct),CoffeeGuru(NT)Pty LtdhasappliedtotheDirector-GeneralofLicensingforthegrantofan"Restaurant"licence,forthepremisesknownas"TheCoffeeClubCasuarinaSquare 2",locatedatShop GD379,MontereyHouseDarwinNT0810.

CurrentSituation

2.Theapplicantprovidedasubmissionregardingtherelevantcriteriareferredtoinsection6(2)oftheActidentifyingtheoperationsof theproposedbusiness.Theapplicantsubmittedthattheinformation provideddemonstratesthat thegrantofthelicencewillbeinthepublicinterest.

3.TheproposedLicenseehasprovidedanaffidavitpursuanttosection26A oftheAct,identifyingthatthedirectorofthecompany,isMrMarshallLaywhoistheonlypersonstohaveinfluence overtheliquorlicence.Theyarealso theonly directors andshareholdersoftheproposedlicensedentity.

4.Thebusinessproposedtobeconductedwillbeinthenatureof aEuropeanstylecafewithbothindoorandalfrescodining,whichwillofferbreakfast,lunchanddinner. Alcoholwillbeancillarytoameal.Thesaleofliquorisproposedtobesoldfrom11:OOhrs until22:00hrsMondaytoSunday(seven 7days week)

5.MrLayistobetheNominee. InsupportoftheapplicationMrLayprovidedproof ofa ResponsibleServiceofAlcoholcertificateappropriateandadequateidentification,refereereportsattestingtohisgoodcharacterandworkethicandhasundertakenaNationPolicecriminalhistoryandfingerprintcheck. HehasdemonstratedasoundunderstandingoftheActbysuccessfullycompletingtheLiquorActtest.

6.TheapplicationwasadvertisedintheNorthernTerritoryNewinthe correctformatonWednesday,8April2016 andFriday,10April2016.

7.Therequired'greensign'wasdisplayedattheproposedpremisesfortherequiredperiod.

8.Noobjectionswerereceivedinrelationtothisapplication.

Assessment of Application

9.Ihave reviewedalltheavailablematerialsubmittedin relationtotheapplicationandalsonotethattherehavebeennopublicobjectionstothegrantingofthislicence.

10.Thegrantingofthislicencepresentsminimalrisksgiven thenatureoftheoperationproposed atthepremises.Theapplicanthasprovidedsufficientevidenceregardingthisapplicationtomeettherequirementsprescribed intheAct.

11.Thepremisesaresuitableforthecategoryofliquorlicencerequestedandhaspassedrelevantfireandsafetycompliance examination. Thereappearsnovalidreasontorefusethisapplication.

Decision

12.Thedecisionistograntaliquorlicenceasparticularisedintheapplication.Thelicencewillbeissuedimmediatelyfollowingthepublicationofthisdecision.

Review of Decision

13.Section8oftheLicensing(Director-General)Actprescribesadelegatedecisionisadecision,underanyAct,oftheDirector-GeneralthatismadebyadelegateoftheDirector-General. TheDirector­GeneraldelegatedthedeterminationofapplicationsmadeunderSection29oftheLiquorActbyinstrumenttothepersonfromtimetotimeholding,actinginorperformingthe dutiesoftheposition intheDepartmentofBusinessspecifiedinSchedule2ofthatinstrument.Thisdecisionwasmadeby apersonreferredtointhatschedule. Section10 oftheLicensing(Director-General)Actprovidesthatan affectedpersonforadelegatedecisionmayapplyto theDirector-Generalforareviewofthedecision. Thisapplicationforreviewmustbemadewithin28daysafterwrittennoticeofthedelegatedecisionisgivento theaffectedperson, orwithinany additionaltimethattheDirector­Generalallows. Section9oftheLicensing(Director-General)Actprescribesanaffectedpersonforadelegatedecisiontobethe applicantforthe speciallicence andapersonwhomade asubmission,complaintorobjection(howeverdescribed)duringtheprocessthatresultedinthedecisionbeingmade.

14.Accordingly,theaffectedpersonsinrelationtothisdecisionare,TheCoffeeClubSquare2PtyLtd.
