CITY OF FENTON COUNCIL PROCEEDINGS

The meeting was called to order by Mayor Pro Tem Carl Hammond at 7:30 PM.

The Lord’s Prayer was offered, followed by the Pledge of Allegiance.

Present: Faricy, Hammond, Kasper, King, North, Osborn.

Absent: Osborn.

Others Present: Rick Aro, Assistant City Manager; Les Bland, DPW Director.

PROCLAMATION

A proclamation was read declaring September, 2008 as Life Insurance Awareness Month in the City of Fenton.

MINUTES

Moved by Rauch, seconded by King to approve the minutes of the September 2, 2008 work session and the September 8, 2008 regular meeting as written. Motion carried by voice vote.

ACCOUNTS PAYABLE

After some discussion, a motion was made by Faricy, seconded by North to authorize payment of invoices in the amount of $156,714.05.

Yeas: King, North, Rauch, Faricy, Hammond, Kasper.

Nays: None.

Absent: Osborn. Motion carried.

CORRESPONDENCE, MINUTES & REPORTS

Moved by North, seconded by Rauch to place on file the following minutes:

·  Minutes of the July 21, 2008 Brownfield Redevelopment Authority meeting.

·  Minutes of the August 12, 2008 Parks & Recreation Board meeting.

·  Minutes of the August 14, 2008 Oakwood Cemetery Board meeting.

·  Minutes of the August 19, 2008 Downtown Development Authority meeting.

Motion carried by voice vote.

V-PLOW PURCHASE

Moved by Rauch, seconded by North to accept the recommendation of administration to award the purchase of a Boss RT3Power-V Plow with smart hitch 11 to Monroe Truck Equipment for a cost not-to-exceed $4256.00. Motion carried by voice vote.

LIBRARY ROOF BID

Moved by Faricy, seconded by King to award the bid for the library roof repairs to Jon Allen Construction for a cost not-to-exceed $1800.00. Motion carried by voice vote.

SALE OF CITY VEHICLES

Aro reported on his attempt to sell the City’s 1970 Chevrolet Corvette, used as a Dare vehicle, and a 1994 Chevrolet Blazer 4x4 with a snowplow. He contracted with EZ Way Auction Company and placed these vehicles for sale on E-Bay. The high bid on the Corvette reached $13,951.00, and the Blazer bidding reached $3251.00. Although the reserve was not met on the Corvette, Aro recommended its sale to the highest bidder, noting that there is no blue book pricing available. Prices are typically based on the vehicle’s condition and level of restoration.

Moved by Rauch, seconded by Faricy to accept the highest bids of $13951.00 for the 1970 Chevrolet Corvette and $3251.00 for the 1994 Chevrolet Blazer with snow plow and authorize EZ Way Auction Company to facilitate the sale. Motion carried by voice vote.

TOOTSIE ROLL SALE

Moved by Faricy, seconded by Rauch to approve the request of the Knights of Columbus Council #7418 to solicit money during their annual “Tootsie Roll” drive, during daylight hours of October 10th, 11th and 12th, 2008 at the intersections of Adelaide and North Road, Adelaide and High Streets and various business locations in Fenton. Motion carried by voice vote. King opposed.

HOMECOMING PARADE

Moved by North, seconded by Hammond to approve the request of the Fenton High School Student Council to hold their annual homecoming parade on October 10, 2008 beginning at 4:30 PM. Motion carried by voice vote.

STATE ROAD PTO BANNER REQUEST

Moved by Rauch, seconded by North to approve the request of the State Road PTO to place a banner at Shiawassee and Bent Oak from November 10, 2008 to November 25, 2008 to promote their annual Arts and Crafts show. Motion carried by voice vote.

DDA RESIGNATION

Moved by King, seconded by Hammond to accept the resignation of Kristin Plew from the Downtown Development Authority. Motion carried by voice vote.

DDA APPOINTMENT

Moved by Rauch, seconded by Hammond to table this appointment until Mayor Osborn is present to make a recommendation. Motion carried by voice vote.

WAYFINDING COMMITTEE COUNCIL APPOINTMENT

Moved by Rauch, seconded by Hammond to table this appointment until Mayor Osborn is present to make a recommendation. Motion carried by voice vote.

SET PUBLIC HEARING

Moved by Hammond, seconded by King to set a public hearing for October 27, 2008 for the purpose of discussing proposed Ordinance No. 645 which amends the regulation of door-to-door peddling and soliciting. Motion carried by voice vote.

CALL TO AUDIENCE

Mike Piacentini, 1030 Parkview, asked if the contract with Mike Senyko of Local Solutions had been extended. He was told it has not yet been presented to Council. In addition, Aro informed him that the newly required safety vests were recently purchased for approximately $20.00 each.

CITY MANAGER’S REPORT – None.

COUNCIL MEMBER COMMENTS

North informed Council that a letter had been sent to the DDA requesting maintenance help on their projects and have not yet received a response. The Beautification Commission feels money is being wasted due to a lack of maintenance. They also discussed the possibility of the City purchasing a “Gator” ATV to be used by the Beautification members and other departments. Hammond instructed her to have the Commission send a recommendation to Council including costs.

North then inquired about the water and sewer issues on Mary Court due to the recent heavy rains. Bland explained that all pump stations were working properly and it was a matter of too much water at one time. He also explained that once work begins to eliminate storm water from the sanitary system, these issues should be resolved.

Rauch reported there was also a problem at West Street. Bland informed him that there were filters there which have since been removed to allow better flow. Rauch then thanked the Fire Department for their program on September 11th and also thanked the Police Department for the outstanding job they do.

Faricy asked why the Beautification Commission was not enlisting the help of the DPW to assist in watering. Bland will get quotes and information for the Commission on the purchase of a “Gator”. He noted that the old truck which was to be used for this purpose does not suit their needs.

King felt if the DDA completes a project, they should be responsible for maintaining it. She asked Bland when the water plant lagoons were scheduled for cleaning. He informed Council that the most recent price received was not a true comparison to the previous quote and he will be obtaining more information from both companies. King then reported on several problem areas which surfaced during the recent storms.

LEGAL COUNSEL

Schultz reported he has received information from the State on the history of the Silver Lake Road bridge inspections. Council should have this information in a few weeks. He is also working on revisions to the Peddlers and Solicitors ordinance to conform with the current state law.

ADDITIONAL COUNCIL MEMBER COMMENTS

King reported that sixty two trees are being planted, and tree restoration fund raising continues.
