Research Data Ownership and Management Agreement Template

between

Sponsoring Principal Investigator and Student Investigator

This research data ownership and management agreement (Agreement) between the University of New Hampshire (University) through ______, its Sponsoring Principal Investigator (Sponsoring PI), and ______(Student Investigator), is entered into this ____ day of ______, 2___.

This Agreement is governed by the University Policy on Ownership and Management of Research Data (Policy) (UNH VI.F.6), including all definitions and management practices.

1.  The Sponsoring PI has primary responsibility for the performance of the following project(s)/activity(ies) conducted by the Student Investigator in which research data will be collected:

2.  The University is the legal owner of the research data per the Policy cited above or by virtue of a prevailing sponsored research, material transfer, confidential disclosure, or other legally binding written agreement.

3.  The University has assigned custody of the research data to the Sponsoring PI.

4.  Research data generated by a Student Investigator must be retained in an authorized manner until the pertinent three year controlling period has elapsed, the student’s degree is awarded, or the research project/activity is closed or completed, whichever is longer. In addition, if the student’s department requires a longer retention period, the latter would prevail.

In consideration of these terms, the Sponsoring PI, and the Student Investigator agree to the following:

5a. The Sponsoring PI shall have possession of all research data that is collected in the conduct of the above-named project(s)/activity(ies). During the conduct of the above-named project(s)/activity(ies), the Student Investigator may access the research data according to the following conditions:

Specify what parts of the research data may and may not be accessed by the Student Investigator and the relevant time frame. Note any restrictions on data access as required by University board/committee approvals (e.g., human subjects, infectious agents) or other written agreements.

5b. Original research data must remain in the custody of the Sponsoring PI. When the Student Investigator ceases involvement in the above-named projects/activity(ies), the Student Investigator may copy and take the copy of the following parts of the research data:

Address parts of research data generated both before and after the individual’s cessation of her/his involvement in the research project/activity. For unique materials prepared in the course of the research, such as intermediates in chemical synthesis, cell lines, or reagents, specify how items will be proportioned and divided with Student Investigator. If student is at another institution, this should be negotiated in the terms of a written Material Transfer Agreement.

6. This Agreement may be amended only by a written document signed by both parties.

7. The Student Investigator acknowledges that s/he has received a copy of and reviewed the Policy cited above and agrees to comply with the Policy regarding all research data collected in the project(s)/activity(ies) covered by this Agreement.

8. Each party shall pay its own costs including, but not limited to, costs of storage, transportation, and copying incurred in connection with this Agreement.
