May 1, 2017 Borough Council Meeting

The regular monthly meeting of the Stewartstown Borough Council was called to order at 7:00 p.m. In attendance were: Gordon Wisnom, Roy Burkins, Kenton Kurtz, Michael Ellinger, Donna Bloom, Bill Gemmill and Polly Kreiss. Also in attendance were: Mayor Herzberger, Attorney Craig Sharnetzka, Ira Walker and Melissa Matthews. Dennis Sarpen was absent.

GENERAL BUSINESS

Ms. Bloom made a motion to approve the minutes from the April 3, 2017 Council meeting. Mr. Burkins seconded and the motion was carried.

Ms. Kreiss made a motion to approve the general fund financial statements, including checks dated April 1st through April 28th, 2017 totaling $120,165.67 seconded by Ms. Bloom and the motion was carried.

Mr. Kurtz made a motion to approve the sewer fund financial statement, including checks dated April 1st through April 28th, 2017 totaling $304,347.47 seconded by Mr. Burkins and the motion was carried.

Ms. Bloom made a motion to approve the water fund financial statement, including checks dated April 1st through April 28th, 2017 totaling $38,327.56 seconded by Mr. Burkins and the motion was carried.

PUBLIC COMMENT

There were no public comments at tonight’s meeting.

SOLICITOR’S REPORT

Attorney Sharnetzka stated the Ravencliffe development continues to move forward. There is a revised agreement that was received that he will review.

There has been very little, if any, progress on the work for the Dollar General Store. A letter was sent to the project manager, with no response. Ms. Bloom made a motion to make a claim on the bond. Mr. Ellinger seconded and the motion was carried.

Attorney Sharnetzka reminded Council that Municipal Night at the York Revolution game is June 23 at 5:45 and invitations will be going out.

A letter was received from Lauren Stevens on April 10 regarding an alley between Charles and Fulton Avenues. Attorney Sharnetzka investigated and there is no dedication or incorporation by the Borough, so the Borough has no responsibility for the alley.

On the Shenk matter, there are still legal issues regarding the claim of Malicious Prosecution. The deadline for discovery has passed but Stock & Leader, the plaintiff’s attorney, and wants discovery documents and to depose Chief Cunningham.

ENGINEER’S REPORT

Due to Mr. Sarpen’s absence, there was no report tonight.

SEWER / WATER SUPERVISOR REPORT

Mr. Walker presented his report to Council.

Ms. Bloom made a motion to approve the purchase of lab supplies for the water and sewer through Hach Co. in the amount of $861.35. Ms. Kreiss seconded and the motion was carried.

Mr. Kurtz made a motion to approve the cost of $2,437.42 for the annual Sensus support renewal fee. Mr. Gemmill seconded and the motion was carried.

Ms. Bloom made a motion to approve the purchase of miscellaneous line maintenance supplies from L&B Water for a cost of $556.50. Mr. Kurtz seconded and the motion was carried.

Ms. Kreiss made a motion to approve the cost of $720 to Shrewsbury Borough to video the sewer line on Hollow Road. Mr. Kurtz seconded and the motion was carried.

Mr. Kurtz made a motion to approve the cost of $172 for a case of disposable gloves from Lou’s Gloves. Mr. Burkins seconded and the motion was carried.

Ms. Kreiss made a motion to approve the cost of $1,000 for two street patches by Ross Sealcoating. Mr. Burkins seconded and the motion was carried.

Mr. Kurtz made a motion to spend up to $2,000 to have seven trees removed at the water tower site. Ms. Bloom seconded and the motion was carried.

MAYOR’S REPORT

Mayor Herzberger stated there seems to be an impasse regarding the new police budget formula. Chief Boddington was in attendance to discuss the issue. He stated that the Joint Agreement needs to be amended by all municipalities. Stewartstown is the last municipality to agree. Attorney Sharnetzka stated that the Letter of Continuation and the Intergovernmental Agreement has different terms, limits and times listed on each document. The PPU description is unclear. Mr. Wisnom made a motion to continue participation in the Police Department with the PPU system. The motion died without a second. Mr. Burkins and Mr. Kurtz stated that until a revised letter is received that describes the PPU system, an Ordinance will not be adopted. Mayor Herzberger stated that the current cost of the Police Department is $320,000 with a $78,000 buy in, which ends the end of 2017. The PPU system allows for a $347,000 cost, which is a little more than budgeted. The cost is still not as high as when Stewartstown had their own police department.

It was the consensus of Council to continue the meeting at a later date when the corrected information is received.

PRESIDENT’S REPORT

Mr. Wisnom reported that Wayne Bush will be retiring on May 19, 2017. Tyler Robinson has been hired to replace Mr. Bush.

Mr. Kurtz made a motion to approve the Fire Police Requests as follows:

Springfield Township – 6/25/2017 and YMCA Sprint Triathlon.

Dallastown Borough – 5/4/2017, 5/29/2017, 8/1/2017, 8/15-19/2017, 10/19/2017, 10/19/2017, 10/31/2017, 11/4/2017, 11/25/2017, in addition to Yard sale days, Football Games, Fire company Open House, 5k Runs, funerals and memorial services.

Fawn Township – 6/8 or 6/9/2017, 7/8/2017, 7/9/2017, 10/27-28/2017, 11/3-4/2017.

Codorus Township – 5/5-7/2017.

Ms. Bloom seconded and the motion was carried.

Mr. Ellinger made a motion to allow the bids to be requested for the roadwork needed on Cemetery and Ice House Lane. Mr. Gemmill seconded and the motion was carried.

There being no further business, Mr. Ellinger made a motion to recess the meeting, seconded by Ms. Bloom and the Stewartstown Borough Council meeting recessed at 8:27 pm.
