MAHONING TOWNSHIP BOARD OF SUPERVISORS MEETING

MINUTES

March 8, 2017

CALL TO ORDER:

Franklin Ruch called the meeting to order at 6:00 pm at the Mahoning Township Building, 2685 Mahoning Drive East, Lehighton, PA 18235

PRESENT:

Franklin Ruch, Chairman; John Wieczorek, Vice Chairman; Bruce Steigerwalt, Supervisor; Robert Slaw, Supervisor; Brian Reeser, Supervisor; Thomas Nanovic, Solicitor and Natalie D. Haggerty, Secretary-Treasurer

PUBLIC COMMENT:

Alex Procuik, 1230 Hemlock Drive Lehighton: There is a situation with our social club on Ukrainian Homestead property and we had to evict them. The Ukrainian Homestead social club applied for a change of address to Route 443. This is not an appropriate location. Concerns of safety of residents traveling on route 443. He objects to them using the Ukrainian Homestead name. Does not like the idea of opening a social club in a strip mall. Asked the Board, if you hear anything form the LCB can you support us? Franklin Ruch advised that it will have to run through zoning.

NEW BUSINESS: Moved up on the agenda

Rob Heckman, Orioles carnival representative. We will abide by getting a peddlers permit and have addressed the amusement tax with the amusement company. Rob has been in contact with Nevin Frey regarding road closure. We sent letters to fire police, fire chief, and supervisors of Mahoning, Franklin and Lehighton Borough. We will come out and pick up signs erect them and return them. We will erect a barricade 100 yards before and after start finish line. Provided copy of certificate of insurance.

Greg Haas, Carbon Engineering and Dr. Ronald Sherry present regarding Sherry Minor Subdivision. Present asking for a clean preliminary plan approval. Advising that we have addressed II.2) and II.2.b) from the February 17, 2017 2nd LTL plan review letter. Pete Eisenbrown advised that he reviewed the revised information provided and the two comments have been satisfactorily addressed. Bruce Steigerwalt asked if there will be diversion dikes to the rear. There is a scheduled preconstruction meeting next Friday at the Conservation District for the NPDES Permit, let Pete know there is no need to attend. However, we would like him to look at the site.

MOTION: Bruce Steigerwalt made a motion to grant preliminary approval of Sherry Minor Subdivision. Seconded by John Wieczorek. Franklin Ruch, yes; John Wieczorek, yes; Bruce Steigerwalt, yes; Robert Slaw, yes and Brian Reeser, yes 5-0 vote. Motion carried.

APPROVAL OF MINUTES:

MOTION

John Wieczorek made a motion to approve the Minutes of the February 22, 2017 Board of Supervisors Meeting. Seconded by Bruce Steigerwalt. John Wieczorek, yes; Franklin Ruch, yes; Bruce Steigerwalt, yes; Brian Reeser; yes and Robert Slaw, yes 5-0 vote Motion carried.

APPROVAL OF TRANFERS:

MOTION

John Wieczorek made a motion to approve the following transfers:

$537.97 Residential Street Light Money Market to General Checking

Seconded by Bruce Steigerwalt. John Wieczorek, yes; Franklin Ruch, yes; Bruce Steigerwalt, yes; Brian Reeser, yes and Robert Slaw. 5-0 vote. Motion carried.

APPROVAL OF TREASURERS REPORT: February 2017

MOTION

Franklin made a motion to approve the Treasurers Report for February 2017. Seconded by Bruce Steigerwalt. John Wieczorek, yes; Franklin Ruch, yes; Bruce Steigerwalt, yes; Brian Reeser, yes and Robert Slaw 5-0 vote. Motion carried.

Bruce Steigerwalt questioned why our SEO is doing PDNI searches. It is a conflict and a liability if it comes back and there is a hit. Send Scott Bieber a letter advising that the Board does not want him to do PDNI searches.

NEW BUSINESS: Broke for an executive session at 6:30 PM for personnel. Meeting called back to order at 7:45PM.

MOTION: John Wieczorek made a motion to allow light duty for an injured officer Amie Barclay. Seconded by Brian Reeser. John Wieczorek, yes; Franklin Ruch, yes; Bruce Steigerwalt, no, Brian Reeser, yes and Robert Slaw, yes 4-1 vote. Motion carried.

OFFICIALS:

Robert Slaw: The road report depicts a rating of five for Troxell Road; thoughts. Bruce shared that we will have to contract it out our equipment cannot do the hill.

John Wieczorek: Questioned paver and truck status? The pumps are ordered and truck at PVC.

Bruce Steigerwalt: Frank and I looked at the Rex Road Bridge and talked to the Kerns regarding the tree and they agreed to removal of the branches. Send a letter for them to sign.

Carl Faust: Striping parking spaces at the Carbon Plaza Mall.

Franklin Ruch: Becker Blueprint proposal. Discussion of calling a building committee meeting to keep this project moving forward. The prints should be in black and 24x36 and in PDF.

MOTION

John Wieczorek made a motion to change depository from PNC Bank to Jim Thorpe Neighborhood Bank, 3-5 signatures needed one being secretary/treasurer to deposit township funds. Seconded by Bruce Steigerwalt. Franklin Ruch, yes; John Wieczorek, yes; Bruce Steigerwalt, yes; Brian Reeser, yes and Robert Slaw, yes. 5-0 vote Motion carried.

Franklin Ruch called an executive session at the conclusion of meeting for legal and litigation.
