DISPOSAL OF PLOT 21 AT HIGHVIEW GARDENS

1  / Purpose and Policy Context
1.1  / To request consent to dispose of surplus land at Highview Gardens in conjunction with Property Services Business Plan Priority Number S11 “Extra Capital Receipts within Financial Year”.
2  / Decision Required
2.1  / To request consent to proceed with the disposal of plot 21 at Highview Gardens as shown edged red on the attached plan.
3  / Information
3.1  / To dispose of a surplus plot which has the benefit of planning permission for one bungalow to Carlton Developments on the following terms:
1)  Purchase price £90,000.00 (Ninety thousand pounds).
2)  To pay the Borough’s reasonable surveyors and legal fees.
3)  To be sold, subject to the grant of planning consent, for a 2 bed bungalow on the plot and a pair of 2 bed semi detached properties on the adjoining land with access (restricted to 2 semi detached properties only) over the plot.
4)  Overage Provision – Should the purchaser secure an enhanced planning consent for additional units then the benefit will be shared between the Borough and the developer with the Borough seeking 15% of the market sale price of each additional unit.
5)  Subject to standard Borough covenants.
3.2  / The purchase price negotiated is in excess of the reasonable achievable value if disposed in isolation on the open market as Carlton Developments have a special interest in the adjoining plots. The plot with planning permission to construct a bungalow was originally valued at £50,000. By negotiating with Carlton Developments a figure in excess of this sum was achievable.
3.3  / As Carlton have this adjoining interest this disposal would comply with the Borough’s Standing Orders.
3.4  / As per the Borough’s disposal policy Property Services contacted all Service Unit Heads and Councillors requesting comments before the disposal process commenced.
3.5 / It should be noted that this will be an HRA capital receipt.
3.6 / It was the view of one Ward Councillor that there was too much development in the vicinity of Highview Gardens and that he felt the plot should be contributing something to the local community.
3.7 / As the plot is surplus to requirements and an enhanced value has been negotiated, I would strongly recommend accepting this offer.
3.8 / Legal and Financial Services have been consulted on this proposal and have no objections.
