  • CALL TO ORDER

The meeting was called the meeting to order at 5:05 pm.

  • ROLL CALL

Present: Mark Boling, Alice Rockhold, Roger LaPointe, Jerry Wilder and Lyle Parrigin. All members present.

  • APPROVAL OF MINUTES

September 26, 2006 –Boling made a motion to approve the minutes as submitted. Rockhold seconded the motion to approve. Motion passed by unanimous vote.

These proceedings are recorded and aired live on Cable Channel 4 and the recording will serve as official record. Summary information is as follows.

  • PARKING CITATIONS

BG 103302 – issued by Officer Stickle – respondent – Adam Sherrell – Officer Stickle confirmed the citation stating that the vehicle was parked half way into the yellow zone. Respondent stated that this is a vacant residence with the curb deteriorating in the area and around the drive entrance. He stated that he as well as other vehicles frequently park in the area. Officer Stickle stated that he was cited for two violations; parking prohibited and blocking driveway.

LaPointe made a motion to uphold the parking prohibited violation. Parrigin seconded the motion. Motion passed by majority vote with Rockhold voting no.

CDEF2006-3990 –1156 Crewdson Drive issued by Tad Douglas – respondent – Mary Spears

Tad Douglas stated that the property was in compliance and there were dome building materials on the premises and a building permit has been applied for. LaPointe made a motion to uphold the citation with no fine. Rockhold seconded the motion. Motion passed by unanimous vote.

CDEF2006-4858 – 1314 High Street - issued by Melissa Christerson – respondent Lindsey Osbourne

Respondent failed to appear.

CDEF2006-3143 – 217 Scott Way - issued by Corby Lambert – respondent Phillip Cox

Corby Lambert confirmed the citation and stated that the vehicle is now in compliance. Parrigin made a motion to uphold the citation with no fine. Boling seconded the motion. Motion passed by majority vote with LaPointe & Rockhold voting no.

  • CONSENT AGENDA

CDEF2002-722 – 758 Brownslock Road - issued by Corby Lambert

Lambert stated that this property has changed ownership. Request to dismiss fine. LaPointe made a motion to dismiss the fine. Boling seconded the motion to pass. Motion passed by unanimous vote.

CDEF2006-3821 – 139 Chestnut Street – issued by Tad Douglas

Douglas stated that this property was bought by Graves Gilbert Clinic with the intent to demolish. The Board requested that Colovos contact the Clinic to see their time frame is for demolition and report back at the November 2006 meeting. No action taken at this time.

CDEF2006-3822 – 115 Chestnut Street – issued by Tad Douglas

Douglas stated that the citation was written to a deceased property owner. He has since located a daughter of the property owner and is working with her. LaPointe made a motion to dismiss the citation & fine. Parrigin seconded the motion to pass. Motion passed by unanimous vote.

CDEF2006-1540 – 639 Eighth Street East – issued by Tad Douglas

Colovos stated that this is a vacant lot and that the property owner is in prison. Broderick stated that he would fall under a legal disability. Colovos is requesting approval of continued mowing charges without a lien due to the property owners legal disability status. Boling made a motion to approve that request. LaPointe seconded the motion to pass. Motion passed by unanimous vote.

CDEF2003-1161 – 757 Old Morgantown Road

Colovos stated that at the time the citation was issued, property had just been sold to, what we believe to be, the son of the former owner. Boling made a motion to dismiss the citation and fine. Parrigin seconded the motion to pass. Motion passed by unanimous vote.

CDEF2004-3238 – 315 Gayle Way

Colovos stated that there is a new property owner for this address and there re still $776.75 in fines from the previous property owner that were either uncollectible or uncollected. The Board requested that Gene Harmon review this case to see if the City wanted to pursue these costs with the former property owner.

CDEF2006-834 – 1586 Louisville Road

Colovos stated that this is the old Yellow Cab Company building that burnt down. He stated that there is a part of it that is still standing that did not get demolished. It is a safety hazard. Colovos is requesting approval to send an Intent to Demolish in 30 Days notice to the property owner. Rockhold made a motion to uphold that request. Parrigin seconded the motion to pass. Motion passed by unanimous vote.

CDEF2005-939 – 400 Tenth Avenue West

Colovos stated that this property has been an ongoing problem. Request approval of all citations on this property so that a lien can be filed. LaPointe made a motion to uphold all citations and authorize the filing of a lien on the property. Boling seconded the motion to pass. Motion passed by unanimous vote.

CDEF2006-395 – 513 Eleventh Street West

Colovos went over the history of this address and again reiterated information given at the September 2006 CEB meeting. LaPointe made a motion to uphold the citation and fines as issued. Rockhold seconded the motion. Lapointe, Rockhold & Wilder voted yes for upholding the fines as they are current. Parrigin and Boling voted no. Motion passed by majority vote.

CDEF2005-1275 – 312 Seventh Avenue East

Bartsch advised the Board that this property is now City owned and that the current fine needs to be dismissed. Boling made a motion to dismiss the fine. Parrigin seconded the motion to pass. Motion passed by unanimous vote.

Approval of Citations written from –September 20-October 17, 2006 – this was not voted on at this months meeting.

The above citations are requested to be approved as these were some that the fines and fees were converted over from our current KVS financial system and added to the BlackBear Land Management/Complaint system. The citations & fees may not have been added/approved at that time. Boling made a motion to uphold the citations & fines. Parrigin seconded the motion to pass. Motion passed by unanimous vote.

  • OLD BUSINESS

CDEF2006-3479 – 1164 Crewdson Drive –Douglas stated that the property is still in violation. At the September 2006 CEB meeting, the violator was given 30 days to comply. Rockhold made a motion to uphold the citation and fine associated with this first offense. LaPointe seconded the motion to pass. Motion passed by unanimous vote.

With all business concluded, Boling made a motion to adjourn the meeting at 7:00 pm. Parrigin seconded the motion. Motion passed by unanimous vote. The next scheduled meeting of the CEB will be on Tuesday, November 28, 2006 at 5:30 pm in the Commission Chambers at City Hall 1001 College Street. (PLEASE NOTE CHANGE IN TIME BY 30 MINUTES)
