1. The order concerns the organization of transport and selection of the carrier.

2. The Principal represents that the shipment does not contain any strategic goods within the meaning of the act of 29 November 2000 (Journal of Laws No. 229, Item 2315 of 2004), for the movement of which DHL Parcel Polska Sp. z o.o. (hereinafter DHL) must obtain a permit and perform other obligations specified in the a/m act (including the keeping of records).

3. In case of any changes to the time when the shipment is ready for receipt, the Principal is obligated to notify DHL forthwith.

4. To this order, “Convention on the Contract for the International Carriage of Goods by Road” (hereinafter the CMR) will apply. The Principal represents that it has knowledge of and accepts the CMR..

5. Freight Forwarding order for organization of part load and full load transport services (hereinafter PTL and FTL) should be submitted during working hours DHL: 8.00-15.30 (Monday to Friday excluding public holidays), at least 48 hours (per the days specified above) before the date of loading.

6. Euroconnect order should be submitted: for the import of hours 8.00-14.00 (Monday to Friday excluding public holidays), at least 24 hours (per the days specified above) before loading and for export of hours 8.00-15.30 (Monday to Friday excluding public holidays), at least 24 hours (per the days specified above) before the date of loading.

7. The costs of the service will be paid by the Principal unless the Sender, or the Consignee, not being the Principal, is designated as the Payer. The Principal represents that in such case it will be responsible for the Payer’s failure to pay, and such responsibility will cover all payments which arise under this order.

8. The prices specified in the order are net prices, and will be increased in the invoices with the VAT in the amount provided for in the law.

9. Shipment weight limit: PTL / FTL up to 24 000 kg gross; transport by a standard semi-trailer of the following dimensions: 13.6m × 2.4m × 2.65 m (height) The Euroconnect order: groupage shipment (terminal based) calculation weight up to 2 500 kg, shipment with receipt/direct delivery (COW/DOW) gross weight up to 5 000 kg. Maximum size: 2.0m/2.0m/2.1m (length/width/height); gross weight of a single element: up to 1000 kg. In cases when receipt/delivery using hydraulic lift is requested, gross weight of a single element may not exceed 800 kg. The transport of elements of weight or dimensions exceeding the above values requires additional arrangements.

10. Carrier’s waiting time at receipt and delivery of a shipment: FTL - the first 8 hours are free of charge, and then EUR 15 per each hour started (no more than EUR 150/day) ; PTL - the first hour free of charge, and then EUR 15 per each hour started (no more than EUR 150/day); Euroconnect - courier’s waiting time of no more than 15 minutes.

11. Dangerous goods may be transported subject to prior arrangements regarding the material class and operational capacity.

12. Fragile and non-stackable shipments are transported in the same manner as any other shipments; they must be marked as such and particularly carefully packed by the Principal. The Principal is also obligated to inform DHL that the goods are fragile or non-stackable in the freight order.

13. Cargo Insurance: insurer is AIG Europe Limited. The value for insurance includes the value of the goods, and may also include transportation, duty, insurance and lost profits – totally up to 20% of the value of the goods. The Cargo insurance fee will be added to the invoice.

14. Customs services: in accordance with the price list of the Gerlach Customs Agency.

15. The amounts stated in EUR, GBP, CHF, SEK or USD will be translated to PLN using the NBP exchange rate in effect on the day of delivery of the goods, and if no such exchange rate is published on such day, using the exchange rate published on the day preceding the day of delivery of the goods. An option to provide the net price and / or value of goods (for the insurance purposes) in a currency other than PLN, EUR, GBP, CHF, SEK or USD requires each time prior arrangement with the freight division of DHL.

16. The price of the freight service will be increased with the current fuel surcharge and the currency adjustment factor. DHL reserves the right to introduce special additional charges connected with dramatic changes in prices of components that influence the transport costs. 17. The Principal agrees to the sending by DHL, to the e-mail address of the Principal specified in this order, of confirmation of receipt of the order as well as marketing information and materials concerning DHL.

18. The order is governed by the Polish law and any disputes resulting from the order will be settled by a court in the capital city of Warsaw, Lublin or Katowice, at the discretion of the party submitting the claim.

19. The order is considered to be accepted for performance only upon receipt of a confirmation from DHL Freight.
