General:
With nearly 8 billion Euros, the Turkish telecommunications market keeps the second position compared to the new members joined EU in May 2004.
Fixed telecommunications market in Turkey has been fully-liberalized by January 1st, 2004. Türk Telekom, the incumbent operator, is no more the monopoly provider of telecommunications services in legal terms and 55 percent of the company has been recently privatised in November 2005.
The Telecommunications Authority (TA), being established with administrative and financial autonomy under the Telecommunications Law of 2000 (Law No. 4502), is responsible for all regulatory functions in both telecommunications and radiocommunications sectors except broadcast licensing and content regulation. The Amending Law to the Telecommunications Law, passed in May 2001 has broadened the responsibilities of the Telecommunication Authority. Under the previous law the Ministry of Transportation was entitled to grant licenses and general authorizations or conclude concession agreements with private companies for value-added telecommunications services. These responsibilities were transferred to the Telecommunication Authority in May 2001 pursuant to the amendments to the Telecommunications Law. According to the new structure, the Ministry of Transport retains its macro-level policy making role while all regulatory functions are vested at TA.
TA has already issued its regulations on tariffs, access and interconnection, national roaming and designation of SMP operators, authorisation, local loop unbundling, collocation and facility sharing, cost accounting and accounting separation, consumer rights, personal data protection and privacy.
Studies towards achieving full compliance with the acquis in telecommunications have been carried out by TA. Despite considerable progress, further efforts by the Turkish authorities are essential to bring telecommunications regulatory framework fully in line with the acquis, including certain amendments in the current Telecommunications Law and issuance of a number of regulations on certain key subjects such as universal service. Strengthening the administrative capacity of the TA is also of prime importance to ensure its proper functioning.
Collocation and Facility Sharing, Local Loop Unbundling:
The milestone for the access and interconnection to the existing network of Türk Telekom is the Ordinance published in May 2003 as a secondary legislation. The Ordinance brings out the conditions introduced by the new regulatory framework of EU to Turkish telecommunications market. Due to the long-term monopoly of Türk Telekom, the proper implementation of the Ordinance can be accepted to be in the take-off phase in 2005.
The communiqué on collocation and facility sharing has been published in December 2003 in order to define the detailed principles and procedures for the provision of collocation and facility sharing. After the authorisation for long distance voice telephony services, the collocation issue has been brought to TA's agenda for interconnection of alternative operators. Although temporary solutions are in place, the issue needs to be handled in detail especially in terms of pricing and introduction of specific collocation solutions for different services.
The local loop unbundling (LLU) Communiqué has been published in the extent of Access and Interconnection Ordinance. Its main purpose is the efficient use existing access network of Türk Telekom in order to increase the broadband penetration by deployment of DSL technology on copper loops and in addition, to open up the market of voice telephony to competitors. The Communiqué on LLU has been published in July 2004 and been enacted by July 2005.
After the enactment of the Communiqué, the first phase of the implementation has been the preparation of the draft reference unbundling offer by Türk Telekom. After the submission of the RUO, the Access and Interconnection Group within the Authority is now in charge of evaluation in administrative, technical and financial terms and will probably make certain amendments before approval. Based on the EU experience, it is expected that the collocation and facility sharing issues will be the most critical part on the regulatory side and hence the Authority gives importance to gathering Member States’ experience on the solutions developed in near past.

Day 2: Study visit to France Telecom (or the relevant incumbent operator)

- General introduction of France Telecom wholesale services (subject to collocation and facility sharing)
- The work achieved by France Telecom for the provision of collocation services
- Technical problems on implementation of collocation and facility sharing
- The relations with the access seekers (problems, solutions etc.)
