INSTRUCTIONS TO BIDDERS

1.  General Description

This Tender covers the operation of the Canteen at the ______for the 2017-2018 Winter Season in accordance with the following Specifications.

2 DATE AND PLACE FOR RECEIVING TENDER SUBMISSIONS

Tenders are to be submitted in duplicate in a sealed envelope marked TENDER FOR ______by 4:00 pm August 30, 2017 to:

Tenders will be opened at the first Regular Meeting following the closing date indicated above.

Tenders received after 4:00pm on August 30, 2017 will be returned unopened.

Bids must be submitted on the attached “Tender Form.”

The Corporation of the Municipality of Greenstone will not be responsible for any submission which is lost or misplaced as a result of failure to address or seal the envelope as instructed.

All unit prices must be clearly indicated and all extensions and lump sum prices written in legible figures.

The bid must not be restricted by a statement added to the submission or by a covering letter, or by alterations to the Tender Form, as supplied by the Municipality of Greenstone unless otherwise provided herein.

The Tender Form must be signed in the space provided on the Tender Form, with the signature of the bidder and/or responsible official of the firm. If a joint tender form is submitted, it must be signed and addressed on behalf of each of the bidders.

3. CONFIDENTIALITY

4. CLARIFICATION

It will be the bidder’s responsibility to clarify any details in question before submitting a bid. Any inquiries must be in writing and hand delivered or faxed to:

8. ANNOUNCEMENT

Tenders are officially approved and awarded by resolution of Council. No announcement concerning the awarding of any Tender will be made until approval is granted by Council.

9. ACCEPTANCE OR REJECTION OF TENDERS

10. INDEMNITY

The Contractor shall indemnify and save harmless the Corporation of the Municipality of Greenstone from and against all liens, damages, losses, claims, demand payments, suits, actions, recoveries and judgments of every nature and description brought against him and/or the Municipality by reason of any act or omission of the said contractor, his agents, or employees in the execution of, or as a result of the work or in the guarding of it. All permits and fees applicable shall be acquired and paid for by the Contractor.

SPECIFICATIONS

1. SCOPE AND PURPOSE

The scope and purpose of these specifications is to outline the specific requirements of the Municipality of Greenstone for the operation of the canteen at the ______for the 2017-2018 Winter Season.

2. TERM OF CONTRACT OR COMPLETION DATE

This lease agreement is for the 2017-2018 winter season.

3. DETAILS OF THE ITEMS(S) AND/OR SERVICE(S) REQUIRED

The Operator shall:

o  Enter into a lease agreement with the Municipality of Greenstone for the lease of the canteen area in the Community Centre.

The Operator shall during the term of the lease agreement:

o  Pay a TWO HUNDRED ($200.00) DOLLAR refundable clean-up deposit on the signing of the lease agreement. Clean-up at the end of the lease must be to the satisfaction of the Director of Community Services and/or the Manager of Leisure Services. If not, part or all of the $200.00 may be used to perform the necessary clean-up.

o  Adhere to operating hours as specified in the Tender Form.

o  Be responsible for setting the menu and prices - menu items may be added but not reduced without written approval by the Director of Community Services and/or the Manager of Leisure Services.

o  Be the sole provider of food services in the Community Centres/Sportsplex unless the Operator does not provide the desired food or written permission is given by the Director of Community Services or the Manager of Leisure Services to user groups of the facility. The Canteen Operator must be notified prior of any special event.

o  Be permitted use of all of the canteen equipment owned by the Municipality of Greenstone or on loan to the Municipality as outlined in Addendum "A” excepting that any additional equipment required for the operation of the canteen shall be provided by the Operator at their expense.

o  Allow the Municipality and/or its agents and contractors to:

o  perform scheduled repairs and renovations in the canteen area; and/or

o  utilize the canteen area as may be reasonably necessitated to affect renovations and repairs to other areas of the Community Centre; and/or

o  suspend this lease in the event of an emergency situation.

o  Not assign or sub-let without leave.

o  Not carry on any business that shall be deemed a nuisance on said premises.

o  Ensure that any alterations or renovations to the existing canteen area are first approved by the Municipality.

o  Obey and conform to all other By-laws of the Municipality of Greenstone and any and all additional regulatory provisions whether Provincial or Federal, affecting use and occupation of the said premises.

o  Comply with all fire, labour, health and safety regulations.

o  Be aware that the Municipality may terminate the lease agreement for reason of unsatisfactory performance.

o  Adhere to all Health & Safety Policies of the Corporation of the Municipality of Greenstone.

o  Provide a list of all of his/her employees/workers/volunteers to the Director of Community Services and/or the Manager of Leisure Services.

o  Ensure that all of his/her employees/workers/volunteers attend Health and Safety orientation (to be conducted by the Manager of Leisure Services).

o  Ensure that all of his/her employees/workers/volunteers are no younger than 14 years of age, in accordance with the Occupational Health and Safety Act.

o  Immediately report any and all safety concerns to the Manager of Leisure Services.

o  Log and record any item used from the First Aid kit on the sheet provided and notify the Manager of Leisure Services. (First Aid kit to be provided by Municipality.)

o  Immediately report any incident and/or injury to the Manager of Leisure Services.

o  Ensure that all of his/her employees/workers/volunteers wear rubber soled, non slip footwear at all times.

o  Maintain a clean work environment at all times.

o  The Lessee shall obtain and maintain Comprehensive General Liability Insurance against Bodily Injury and Property Damage claims.

a)  Such insurance shall include coverage for:

i.  Completed Operations,

ii. Non-Owned Automobile Liability,

iii.  Occurrence Property Damage.

b)  Shall contain a clause stating that such insurance shall remain in force and not be amended, cancelled or allowed to lapse without thirty (30) days prior written notice being given to each of the named insured.

c)  Be subject to an inclusive limit of not less than $2,000,000.00.

Upon the receipt of a successful bid the Operator shall:

o  provide to the Municipality of Greenstone a copy of an updated CERTIFICATE of CLEARANCE with a CAD 7 REPORT, from the Workers’ Safety Insurance Board (WSIB)

OR IF THE OPERATOR IS AN INDEPENDENT OPERATOR

CONTRACTORS WITHOUT EMPLOYEES (INDEPENDENT OPERATORS) (An "independent operator" is a person who carries on an industry set out in Schedule 1 or Schedule 2 of the Act and who does not employ any workers for that purpose.)

a)  Upon the receipt of a successful bid the Independent Operator shall obtain a Determining Worker / Independent Operator Status form from the Municipality of Greenstone to apply for an Independent Operator Letter from the Workers’ Safety Insurance Board (WSIB).

TERMS & CONDITIONS

1. The price quoted on the Tender Form is a FIRM Price.

2. HARMONIZED SALES TAX (HST) to be EXTRA.

HEALTH & SAFETY

The Corporation of the Municipality of Greenstone recognizes and promotes good health and safety in order to prevent injuries and occupational illnesses.

A. INSURANCE – RISK AND INJURY

1.  LIABILITY INSURANCE

The Contractor shall obtain and maintain Comprehensive General Liability Insurance against Bodily Injury and Property Damage claims.

a)  Such insurance shall include coverage for:

i.  Completed Operations,

ii.  Non-Owned Automobile Liability,

iii.  Occurrence Property Damage.

b)  Shall contain a clause stating that such insurance shall remain in force and not be amended, cancelled or allowed to lapse without thirty (30) days prior written notice being given to each of the named insured.

c)  Be subject to an inclusive limit of not less than $2,000,000.00.

d)  The Certificate of Insurance MUST be signed by AN INSURANCE AGENT.

e)  A copy of the Certificate of Insurance MUST be forwarded to the Clerk.

B. WORKERS’ SAFETY INSURANCE BOARD (WSIB) REQUIREMENTS

1. CONTRACTORS (WITH EMPLOYEES)

a)  Upon the receipt of a successful bid the Contractor shall provide to the Municipality of Greenstone a copy of an updated CERTIFICATE of CLEARANCE with a CAD 7 REPORT, from the Workers’ Safety Insurance Board (WSIB).

b)  The Municipality will not issue a purchase order to any contractor until CONFIRMATION from the WSIB is received.

2. CONTRACTORS (WITHOUT EMPLOYEES - INDEPENDENT OPERATORS)

(An "independent operator" is a person who carries on an industry set out in Schedule 1 or Schedule 2 of the Act and who does not employ any workers for that purpose.)

a) Upon the receipt of a successful bid the Independent Operator shall obtain a Determining Worker / Independent Operator Status form from the Municipality of Greenstone to apply for an Independent Operator Letter from the Workers’ Safety Insurance Board (WSIB).

b)  The Municipality will not issue a purchase order to any contractor until CONFIRMATION from the WSIB is received.

C. CONTRACTOR’S UNDERSTANDING

It is understood and agreed that the Contractor has by careful examination, satisfied himself as to the nature and location of the work, the quality of materials to be encountered, the character of equipment and facilities needed in the completion of the work.

D. HEALTH & SAFETY

a)  Contractors will follow the Policies and Procedures set out in the Municipality of Greenstone Health and Safety Manual.

b)  Contractor and his/her employees/workers/volunteers will follow the Policies and Procedures set out in their own Health and Safety Operations Manual.

c)  Contractor and his/her employees/workers/volunteers shall be competent workers.

d)  Contractor and his/her employees/workers/volunteers are fully trained in the operation of the equipment to be used in the operation of the canteen.
