INTRODUCTION OF ORDINANCE NO. 33-2007, AN ORDINANCE OF THE CITY OF HACKENSACK, IN THE COUNTY OF BERGEN, NEW JERSEY, AUTHORIZING CERTAIN BUSINESS ENTITIES NONEXCLUSIVE USE OF RIGHT-OF-WAYS FOR FIBER OPTIC TELECOMMUNICATION CABLES TO BE PLACED AND MAINTAINED IN, UPON, ALONG, ACROSS, ABOVE, OVER AND UNDER THE PUBLIC HIGHWAYS AND STREETS IN THE CITY OF HACKENSACK, POLES, WIRES, CABLES, UNDERGROUND CONDUITS, MANHOLES, AND FIBER OPTIC CABLES AND FIXTURES NECESSARY FOR THE MAINTENANCE AND OPERATION OF THE PROPOSED USE.
BE IT RESOLVED that the above ordinance, being Ordinance 33-2007 as introduced, does now pass on first reading and that said Ordinance shall be considered for final passage at a meeting to be held on December 18, 2007 at 7:00 p.m. or as soon thereafter as the matter can be reached at the regular meeting place of the City Council and at such time and place all persons interested be given an opportunity to be heard concerning said Ordinance and that the City Clerk be and she is hereby authorized and directed to publish said ordinance according to law with a notice of its introduction and passage on first reading and of the time and place when and where said ordinance will be further considered for final passage.

WHEREAS, the Public Health Priority Funding Act of 1977 provides for participation of local health agencies and makes available financial aid to assist such agencies; and
WHEREAS, the City of Hackensack has established and maintains a program of recognized public health activities and meets the minimum standards of performance as prescribed by the Public Health Council in accordance with the laws of the State of New Jersey; and
WHEREAS, the Hackensack Health Department qualified for Public Health Priority Funding for the period of January 1, 2008 through December 21, 2008.
NOW, THEREFORE BE IT RESOLVED by the Mayor and Council of the City of Hackensack that John G. Christ, Health Officer of the City of Hackensack, is authorized to make application to the New Jersey State Department of Health and Senior Services for Public Health Priority Funding for the period of January 1, 2008 through December 31, 2008.

WHEREAS, the governing body of the City of Hackensack has been advised that an emergency affecting the welfare of the citizens of the City of Hackensack and the general public did occur when sewer lines collapsed on Krone Place and Fairmount Avenue, Dyatt Place and Overlook Terrace were rendered inoperable; and
WHEREAS, the Project Manager notified the City Manager setting forth the circumstances regarding the emergency; and
WHEREAS, the governing body is satisfied that an emergency did exist and that immediate action was necessary to restore the aforementioned sewer lines to full operation; and
WHEREAS, the cost of the repair was $8,067.58, which was a fair and reasonable quotation; and
WHEREAS, the Chief Financial Officer has certified that funds are available in account #7-01-26-311-311-204 of the Current Budget, Purchase order #158647;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Hackensack that pursuant to N.J.S.A.40A:11-6 which authorizes the governing body to award contracts without benefit of public bidding in emergency situations and the vendor J.
