Subject: Refund of the money deducted from my Gratuity / Leave encashment
at the time of my retirement as per the Judgement of Supreme Court in
Civil Appeal No 11527 of 2014 dated 18-12-2014 ,

Or

Refund of the money I was forced to deposit at the time of my retirement as
overdrawn amount which is now refundable r as per the Judgement of
Supreme Court in Civil Appeal No 11527 of 2014 dated 18-12-2014 ,

Respected Sir,
With due respect I beg to state the following lines for your immediate consideration and necessary action:

1) That I, Sri...... retired on superannuation/ voluntarily on ...... (date) as...... (desgn) from the office of ......

2) That at the time of my retirement an amount of ……………… was withheld from my DCRG by CCA ……. due to some alleged wrong fixation of my pay / as pending Government Dues.. The document highlighting such deduction is enclosed herewith

OR

2) That at the time of my retirement an amount of ……………… was withheld from my Leave encashment by AO Cash…… due to some alleged wrong fixation of my pay prior to my retirement. The document highlighting such deduction is enclosed herewith

OR

2) That I was compelled to deposit an amount of ………………….. to AO Cash ….. as overdrawn amount for some wrong pay fixation. The document is enclosed herewith.

3) That Hon’ble Supreme Court of India vide its judgement haspronounced that such deduction / recovery of amount prior to retirement is illegal. Accordingly DoPT, and BSNL CO has issued all necessary orders placed under reference for immediate action.

4) I therefore request your honour to issue necessary order for refunding the amount which was deducted from my DCRG /Leave Encashment / which was deposited by me as overdrawn amount.

5) I am also to mention here that due to such illegal decision my last basic pay drawn was reduced and accordingly my pension was also fixed less. My actual last basic was ….. which was reduced to ……. Accordingly basic pension fixed as ……….. in place of …………….

6) In view of the verdict of Supreme Court referred to above, you are requested to refund the money deducted from my Gratuity/ Leave encashment/ I was forced to deposit and restore the basic pay reduced at that time and revise the pension accordingly.
