The meeting was called to order by Jennifer Wagenius. Introductions were made.
Additions to the agenda: (a) e-recording docs which are exempt from MRT & SDT
(b) P of attorney in torrens
*Melissa Taphorn, Deputy Executive Director, Washington County Housing and Redevelopment Authority did a presentation on Foreclosure Mitigation (see attached power point)
*ERERC updates: The use of ECRV has taken a big jump in usage. A reminder NOT to use Social Security numbers on a pdf printout of the ECRV to present to the counties which are not online yet. The SS#’s are input into the system when the submitter is preparing the document so the DOR can see these numbers, but the counties DON’T need them. Also signatures are NOT required on these printouts. Also the use of E-well certificate has increased. The MLTA/MCRA workgroup distributed a map detailing which counties are erecording. This map will be posted to multiple websites for viewing. 40 counties are currently erecording. Discussion was had on how to erecord a document which is exempt from MRT or SDT. The suggestion was for the submitters to put $0 in the field rather than leaving blank. Work with your software providers.
*Legislative updates: MN Bar will have no real property bill in 2012. Researching the possibility to use an Examiners Directive to remove a cancelled C for Deed on a torrens cert. The 20 year child support judgment may be repealed. There is a proposal by others to change the form of the Certificate of Trust and Affidavit of Trustee. Feb. 20th is MLTA lobbying day at the State Capitol.
*MLTA has reduced the membership fee for counties to join. A county may join MLTA for $150.00 annually.
*Purchase money mortgages: MS#358.14 only 1 spouse is required to sign.
*Rejecting documents: Title companies prefer the county return the whole recording package even if only 1 doc is being rejected.
*Discussion revolved around how counties proceed when a Power of Atty has been filed in the office previously and today a Satis, by P of Atty, is presented for filing in Torrens.
Most counties answered that they would charge an additional $20.00 for the Satis and memorialize the P of Atty filed previously.
*New HUD-1 settlement statement draft version, which is now 3 pages long, will be 5 pages long. Title companies report there are many issues with this document.
*March 14th there will be CLE course on “Working with Torrens Property” presented. Kimball Foster (Hennepin County) is the course chair.
*PRIA Winter Symposium will be held Feb. 29-Mar.2 in Washington, DC
