A Resolution Designating Brassfield and Gorrie, Llc As the Selected General Contractor

RESOLUTION NO. 2015-01

A RESOLUTION DESIGNATING BRASSFIELD AND GORRIE, LLC AS THE SELECTED GENERAL CONTRACTOR FOR THE CONSTRUCTION OF A MULTI-USE STADIUM TO BE BUILT AS PART OF PROJECT JACKSON

WHEREAS, the City is involved in ongoing negotiations relative to a development in the riverfront area of the City referred to as Project Jackson; and

WHEREAS, as part of the Project, the City would be required to construct a multi-use stadium; and

WHEREAS, litigation currently is pending that impacts the City’s ability to finance the construction of such stadium; and

WHEREAS, the City anticipates that the litigation could be concluded within the next ninety days; and

WHEREAS, in the event that the litigation is successfully concluded and the City determines that the financing for the stadium is adequate and available to the City the City desires to be prepared to immediately proceed with the construction of the required stadium; and

WHEREAS, the design of the stadium by architects previously selected by the City would allow for the construction to go forward; and

WHEREAS, time is of the essence in proceeding with such construction, in order to achieve the total development as envisioned by Project Jackson; and

WHEREAS, for the purpose of meeting its responsibility to provide the stadium, the City issued a request for qualifications with respect to construction services related to the construction of said stadium; and

WHEREAS, following a review of the submitted qualifications, the City has determined that Brassfield and Gorrie, LLC is the best qualified to provide the services on the time schedule required; and

WHEREAS, the City would desire to allow negotiations related to a formal contract for the construction of said stadium to move forward, subject to the funding issues as referred to above; and

WHEREAS, the Mayor and City Council have determined that it is in the best interest of the City to move forward with such contract negotiations; and

NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council of the City of North Augusta, South Carolina, in meeting duly assembled and by the authority thereof select Brassfield and Gorrie, LLC as the general contractor for the construction of the stadium within Project Jackson and authorize the City Administrator to negotiate a contract with Brassfield and Gorrie, LLC for such construction and present such negotiated contract to the Mayor and City Council for its review.

BE IT FURTHER RESOLVED that this selection of Brassfield and Gorrie, LLC as contractor for the construction of said stadium is contingent upon funding and is not to be considered as an award of any contractual rights to Brassfield and Gorrie, LLC at this time. Should funding be deemed available, at that time the Mayor and City Council would review the negotiated contract as well as consider all circumstances existing at such time for the purpose of making a determination as to whether to award a contract to Brassfield and Gorrie, LLC.

Done, ratified and adopted by the Mayor and City Council of the City of North Augusta, South Carolina, on this 5th day of January, 2015.
