GENERAL MOTION SCHEDULING:

Criminal Motions will be set through the JACS calendaring (automation) for hearings that require 20 minutes or less. Criminal Motions requiring 30 minutes or more will be special set by the Judicial Assistant upon approval by Judge Hardt.

JACS (AUTOMATION CALENDARING SYSTEM) REQUIREMENTS: All hearings, 20 minutes or less in length (PER CASE ON ONE GIVEN JACS CALENDAR DATE) must be scheduled through the “JACS” system. You may not schedule back-to-back hearings to acquire a longer block of hearing time (e.g. scheduling two 20-minute hearing times of acquire 40 minutes). If you schedule hearing improperly, the hearing may be cancelled by the Judicial Assistant, sanctions may be assessed, and you may be blocked from the “JACS” system for future use. Once a motion is scheduled through “JACS” subsequent motions may not be “piggybacked” using the time reserved for the first motion absent prior approval of the Court.

Except for cancellations, there can be no changes, additions, swapping, or other alternations of the motion calendar. Attempts to accommodate such request in the past have resulted in unnecessary confusion and inadequate notice to opposing counsel. Motions must be filed with the Clerk before scheduling a hearing on JACS.

HEARINGS 30 MINUTES OR LONGER: All hearing request of 30 minutes or more must be requested in writing along with a copy of the motion(s) (that have been previously filed) and approved by Judge Hardt before special set hearing time will be set with the judicial assistant. You must include a copy of the motion with your transmittal letter as with e-filing it may take up to 7 days after e-filing to be available for the judge to review. It is not necessary that you send the judge exhibits you have attached to your motion – only submit the body of the motion. Upon approval by the judge of your special set hearing request, the judicial assistant will call the requesting party with hearing dates. If you need 30 minutes, ask for 30 minutes as you will be limited to the hearing time approved by the judge. Remember to consult with opposing counsel as to the total amount of hearing time so the hearing time will be adequate for argument by both sides. Motions must be filed with the Clerk before requesting a special set hearing date.

Asacourtesytotheotherside,theattorneysmustclearthehearingtimewiththeopposingpartybeforebookingthehearing.Thisisextremelyimportantifthehearinginvolvestestimonyandtheschedulingofwitnessestoattendthehearing.

CANCELLATION POLICY FOR MOTIONS: All requests for cancellations of motions set on Judge Hardt’s calendar must be submitted by the attorney or party who set the hearing and the cancellation must be agreed upon by all parties, regardless of who set the hearing. If the cancellation request for a hearing is on a hearing that is set seven (7) days or less from the date of the cancellation request, Judge Hardt will not allow cancellation of the hearing unless the issues set on the motion calendar have been COMPLETE RESOLVED. To obtain Court approval of a late cancellation request (7 days or less) you MUST submit a written request to Judge Hardt on your letterhead and signed by the attorney. The letter must state you have copied all parties and they are in full agreement that the issues set have been completely resolved. If the hearing cancellation request is on a hearing set more than 7 days from the date of the hearing cancellation request, you may cancel the hearing if you have obtained approval by all parties.

EMERGENCY HEARING REQUEST: All matters considered to be an emergency by a party or counsel must be submitted to the judge’s chambers (by mail or hand delivery) in writing with a copy of the motion that has been filed attached to the request. The letter must state that a copy of the request has been served on the opposing counsel and include the amount of hearing time being requested.

HEARING CONFIRMATION NUMBER

OnallMotions,theJudicialAssistantwillgiveyouahearingconfirmationnumberthatmustbeputinyourNoticeofHearing.Theconfirmationnumberisnecessarybecause,inourabsence,ourrecordedtelephonemessagewillgiveyouavailablehearingdates.Thiswillallowyoutocoordinateadateandtimewiththeopposingpartywithoutspeakingdirectlytous.

However,inorderforyourcasetobedocketedonthecourtcalendar,afteryouhavecoordinatedadateandtimewithopposingsideyouwillneedtocallusbacktogetyourhearingconfirmationnumber.

POSTCONVICTIONRELIEF MOTIONS

GENERAL MOTION REQUIREMENTS

 MotionsforReleaseonOwnRecognizance(ROR):(after33daysduetoStatenotfilinganInformation)HearingsontheseMotionswillbesetfor9:00a.m.onMonday, Wednesday and FridaywhenCourtisinsession.DefensecounselmustschedulethehearingwiththeJudicialAssistantandshalldeliverwrittennoticetotheStateAttorney(byfaxorhanddelivery)notlaterthan3:00p.m.two(2)businessdayspriortothedateofthehearing.Forexample,fora9:00a.m.hearingonMonday,noticemustbedeliveredtotheStateAttorneynotlaterthan3:00p.m.ontheproceedingThursday.

Consolidations:CivilandTrafficOffenseswillnotbeconsolidatedintofelonycases.

 MotionstoSuppress:TheoriginalMotiontoSuppressshouldbefiledwiththeClerkandacopysenttotheStateAttorneyandtheCourtforreview.InaccordancewithRule3.190(h),theCourtwillreviewthemotiontodetermineifthemotionislegallysufficientbeforeahearingdatewillbeset.SeeRule3.190(h);Statev.Hernandez,841So.2d469(Fla.3dDCA2002).MotionstoSuppresswhicharenotheardpriortothepretrialconferencewillbeheardatthestartoftrial.

 TelephoneHearings:Generally,witnessesmaynotappearbytelephoneintheabsenceofastipulationbetweenthepartiespermittingsuchanappearanceandwithadvancenoticetotheCourt. Anotarypublicmustbeavailableinthepresenceofthewitnesstoadministertheoath,orthepartiesmaystipulatethattheclerkadministertheoathfromthecourtroom.Attorneysmustappearinpersonforhearings.SeeRule2.530(d).

 SubmissionofCaseLawtotheCourt:Forsubstantivemotionssuchasmotionstodismissorsuppress,ifcounselintendstorelyoncaseauthorities,thosecasesshouldbeprovidedtotheCourtwithanappropriateletteroftransmittalandacourtesycopyofthemotionatleasttwobusinessdayspriortothehearing.Copiesofthecasesmustalsobedeliveredatthesametimetoopposingcounsel.CaseauthoritiessubmittedatthetimeofthehearingmayresultinadelayintheissuanceoftheCourt’srulingonyourmotion.

 MotionsforContinuanceofTrial:Allmotionsforthecontinuanceofacasewhichhasbeensetfortrialshallbetimelyfiledinwriting,andexceptforgoodcauseshown,shallbesignedbytheparty(inadditiontotheattorney)requestingthecontinuance.Intheabsenceofexceptionalcircumstanceswhicharenotreasonablyforeseeableandwhicharebeyondthecontrolofthemovingpartyorcounsel,motionsforcontinuanceoftrialshallonlybesetforhearingonthecourt’sregularmotioncalendar.Continuancesshallonlybegranteduponashowingofgoodcause.SeeRule2.545(e),FloridaRulesofJudicialAdministration.Anoticeofunavailabilityisnotasubstituteforamotionandorderforcontinuance.Deliov.Landman,987So.2d733,(Fla.4thDCA2008).

 MotionstoWithdrawPlea:Beforesettingahearing,theCourtwillreviewamotiontowithdrawaplea.TheoriginalMotionshouldbefiledwiththeClerkandacopyofthemotionsenttotheStateAttorneyandtheCourtwithacoverletterstatinghowmuchhearingtimeyouarerequestingandincludeintheletterthatacopyofthemotionhasbeenfurnishedtotheStateAttorney.

MotionsforNewTrial:MotionsforNewTrialmustbefiledwiththeClerkandacopysenttotheCourt.UnlessotherwiseorderedbytheCourt,theMotionwillbeheardatthetimeofsentencing.

 RequestforTravel:Pursuanttostandardcondition(3)containedinallprobationorders,theDepartmentofCorrectionsisdirectedbytheCourttodeterminewhetheraprobationerisallowedtotraveltoany locationoutsidehisorhercountyofresidence.Itisnotthe

responsibilityoftheCourttosuperviseprobationers.SupervisionistheresponsibilityoftheDepartmentwhichisinasuperiorpositiontodeterminewhetherpermissiontotravelshouldbegrantedandtodeterminewhatspecialconditionsorrestrictions,ifany,shouldapplytosuchtravelonacasebycasebasis.Accordingly,requeststotravelwillnotbeconsideredbytheCourt.

 MotionsforFuneralReleaseorFurlough:ThecontrolandsupervisionofinmatesintheCollierCountyjailistheresponsibilityoftheCollierCountySheriff’sOffice. AllrequestsforfuneralreleaseorfurloughfromtheCollierCountyJailshouldbesubmittedtothejailandmustcomplywiththeSheriff’spoliciesandprocedures. PleaserefertoChapter7,Section9,JailDivisionPolicyandProcedureManual.

 MotionsandOrderstoTransport:IfthepresenceofadefendantwhoisincustodyoutsideofCollierCountyisrequiredforaplea,hearingortrial,counselseekingthepresenceofthedefendantshallberesponsiblefortimelysubmittingtotheCourtanOrdertoTransport.

Counselshallconsiderthatthedefendant’slocationofcustodymaylengthenthetimerequiredtotransportthedefendantandcounselshouldcontacttheCollierCountySheriff’sOfficetoconfirmthatthereissufficienttimetotransportthedefendant.Theseordersshallalsoprovideforthereturnofthedefendanttocustodyafterconclusionoftheplea,hearingortrial.TheOrdertoTransportshallindicatethatacopyistobedeliveredbytheClerktotheCollierCountySheriff’soffice.

 MotionstoSetBondorReduceBond: TheoriginalMotiontoSetBondorReduceBondshouldbefiledwiththeClerkandacopysenttotheStateAttorneyandtheCourtforreview,togetherwithaletteroftransmittal.UponreviewtheCourtmayorderthataBondReductionInvestigationreportbepreparedbytheDepartmentofCorrections,andifsoordered,ahearingdatemaynotbesetuntilafterthereporthasbeenforwardedtotheCourt(nottheClerk)withacopytotheStateAttorneyandtheDefenseAttorney(orDefendant,ifprose).

 MotionstoSetBondinVOPcases.IfaVOPwarrantprovidesthatthedefendantbeheldwithoutBond(a“NoBond”warrant),andthedefendantremainsincustody,aMotiontoSetBondshouldbefiledwiththeClerkandacopysenttotheStateAttorneyandtheCourt,togetherwithaletteroftransmittalrequestingahearing.Hearingsonthesemotionswill besetfor9:00a.m.onMondayandWednesdayswhentheCourtisinsession.Exceptuponashowingofgoodcause,hearingtimewillbelimitedto10minutes.Defensecounsel mustschedulethehearingwiththeJudicialAssistantinaccordancewiththeCourt’sproceduresandshalldeliverwrittennoticetotheStateAttorney(byfaxorhanddelivery)notlaterthan3:00p.m.twobusinessdayspriortothedateofthehearing.Forexample,fora9:00a.m.hearingonMonday,noticemustbedeliveredtotheStateAttorney notlaterthan3:00p.m.ontheprecedingThursday.

Counsel of record means the attorney who hasfiledaNotice ofAppearanceorany other memberofthat attorney’slaw firm.Otherattorneys are notpermitted to “cover” for counsel of record unless the attorney has filed a “Notice of Appearance.” See Rule 2.505(e), Rules of Judicial Administration. InaccordancewithRule3.220(h)(1)(D),nodepositionshallbetakeninacaseinwhichthedefendantischargedonlywithamisdemeanororacriminaltrafficoffenseunlessgoodcausecanbeshowntothecourt.

**Attorneys should coordinate with the designated officers to avoid delays.

Depositions should only be cancelled upon proper notice to the opposing lawyer and for good cause.

Cases that will likely plea at the first case management date do not have to have depositions set by that case management date.

Efforts should be made to avoid standard or expeditedcases on complex dockets as depositions are often set around these dates.

The last two days of every noncomplex (standard) trial cycle should be used as deposition dates. While those dates will be avoided as trial dates, all parties should understand this is not a firm rule. Trials will get set on those dates occasionally as necessary.

Noncomplex case depositions should be set during the last two days of the trial cycle of the complex trial week. Complex case depositions should be set the last two dates of the trial cycle during the noncomplex trial cycle.

PRETRIALCONFERENCE

APretrial Conferencewillgenerallybescheduledfor9:00a.m. for the Public Defender cases and 10:30 a.m. for the Private Attorney cases on theTuesdaypriortotheassignedtrialdocket. Trial counsel for both the State and the Defense are required to attend the Pretrial Conference. Trial counsel means the attorney who will actually try the case.

Unless the defendant has signed a waiver of appearance, the defendant is required to attend the Pretrial Conference. Notwithstanding a waiver of appearance, the Court may require the attendance of the defendant for good reason, for example, to enable the Court to ascertain whether a plea agreement has been offered and if so, whether it has been, or is likely to be accepted and to otherwise facilitate plea discussions and agreements in accordance with Rule 3.171.SeeCruzv.State,822So.2d595(Fla.3dDCA2002) and Charlemagne v. Guevara, 183 So.3d 1261(3d DCA 2016).

Caseswhicharetentativelyresolvedatthepre-trialconferencebyapleaagreementwillbeheardattheendofthedocketorwillbesetonthepleadocket. IfforanyreasonthepleaisnotconcludedatthattimeornotacceptedbytheCourt,counselshallbepreparedtoproceedtotrialaspreviouslyscheduledonthattrialdocket.

PRETRIAL MOTIONS

Allmotions,includingmotionsforcontinuance,shallbetimelyfiledandhearingsheldpriortothepre-trialconference.CounselshallcomplywiththeCourt’sprocedureregardingmotionsassetforthabove.

Atthehearingonamotionforcontinuance,counselshallsubmittotheCourtaproposedOrderwithblanklinesforsettingnewdatesforpre-trialconferenceandtrial,togetherwithsufficientcopiesforcounselandthebondsman,ifany,andself-addressedstampedenvelopes.

DoNOTrequesttheCourttosetacaseforpleauntiltheStateAttorneyhasprovidedanaccuratesentencingguidelinescoresheetandthedefendant(inadditiontodefensecounsel)hasindicatedhisorheracceptanceofthepleaagreementofferedbytheStateAttorney.

Cases may be set for plea by one of the following ways:

  1. Setting a plea date in open court
  2. Filing a Notice of Plea Hearing setting the plea on a scheduled plea docket date and time. Upon receipt of the filing of a Notice of Plea Hearing, the Clerk will add your case to the date and time of the plea docket stated in the Notice of Plea Hearing. This Notice must be filed not less than 48 hours in advance of the plea date and time, excluding weekends and holidays.
  3. Calling the Judicial Assistant at (239) 252-8395 to request the case be set on a particular plea date.

Caseswhicharesetforpleawillgenerallybesetonaregularpleadocket. Please check Judge Hardt’s Master Calendar for available plea dates. Oncasesinwhichapleaagreementisreachedatthepre-trialconference,thepleawillgenerallybeheardattheendofthedocketorwillbesetforthepleadocket.

Open pleastotheCourt (withoutapleaagreement)should be set on a special set calendar docket through the Judicial Assistant. Sentencingswillgenerallybesetona pleadocket.

Thesentencewillbeimposedpromptlyuponacceptanceoftheplea.Exceptincasesinvolvingpaymentofsubstantialrestitution,donotrequestadeferredexecutionofthesentence.

APLEAAGREEMENTWORKSHEETSHALLBEFULLYCOMPLETEDAND

SUBMITTEDTOTHECOURTATTHETIMEOFTHEPLEA.Defensecounselshallcalculateandinsertintheworksheetthenumberofdaysofjailcredit,ifany.Upontimelyrequest,aminimumof48hoursinadvance,thejailwillfaxtocounselaprintoutshowingthenumberofdaysofjailcredit.ThiswillassisttheCourtincorrectlypronouncingthesentenceandtheClerkincorrectlypreparingthejudgment. Ifapleahasbeennegotiated,theCourtwillconsiderthosecasesonthemorningdocket.Ifyourclientisincustodyandthereisanegotiatedplea,youmustcontactthejailat(239)252-9736.Youmustcallnolaterthan4:00p.m.ofthedayBEFOREthescheduledcourtappearance.Thebailiffswillnotbringoverclientsforthepurposeofcasestatusorpleadiscussionswiththeirattorneys.Attorneysshouldhavethesediscussionsatthejailoronthetelephonebeforehand.Thebailiffswillnottransportdefendantsincustodywhentherequestismadeonthesamedayas thescheduledcourtappearance,withoutexpressapprovalfromtheCourt.
