The Board of Education of the Madison Local School District met in regular session Tuesday, July 22, 2008, in the Madison High School cafeteria with the following members present: David Albert, Stephen Baldwin, Jacqueline Azbill, Jay Fabian and Rex Reigert. David Albert presided.
Rex Reigert moved and Jay Fabian seconded that the Board adopt the agenda as presented and with such modifications made by the Superintendent. David Albert, Stephen Baldwin, Jacqueline Azbill, Jay Fabian and Rex Reigert voted "Yes". Vote: 5-0.
Jacqueline Azbill moved and Steve Baldwin seconded that the Board approve the minutes of the July 10, 2008 work session, pursuant to Board policy BDDG. David Albert, Stephen Baldwin, Jacqueline Azbill, Jay Fabian and Rex Reigert voted "Yes". Vote: 5-0.
Steve Baldwin moved and Rex Reigert seconded that the Board approve the minutes of the July 16, 2008 special meeting, pursuant to Board policy BDDG. Stephen Baldwin, Jacqueline Azbill and Rex Reigert voted "Yes". David Albert and Jay Fabian abstained. Vote: 3-0.
ANNOUNCEMENT – Change of Meeting Date
The August Regular Board Meeting will be moved from Tuesday, August 19, 2008 to Wednesday, August 20, 2008, at 6:00 p.m.
Jacqueline Azbill moved and Steve Baldwin seconded that the Board enter into an agreement with Ohio School Boards Association to conduct a Superintendent Search for the Madison Local School District. David Albert, Stephen Baldwin, Jacqueline Azbill, Jay Fabian and Rex Reigert voted "Yes". Vote: 5-0.
PRESENTATIONS
4 in the Core – Angela Smith, Director of Curriculum, provided the Board with an overview of the new program being initiated at Madison High School effective the 2008-09 school year.
Activity Fee & Student Handbook – Bill Fisher, MHS Principal, will address the Board on a new proposed student activity fee and changes in the MHS student handbook for the coming school year.
The meeting was recessed at 8:00 p.m. and reconvened at 8:10 p.m.
REPORTS AND RECOMMENDATIONS OF THE TREASURER
The Treasurer presented a Review of the 2008 Financial Results.
Jay Fabian moved and Steve Baldwin seconded that the Board engage in the following actions as listed below; provided, however, that should any item included within this motion be declared by a court of competent jurisdiction to be void or illegal, all remaining items within this motion shall remain in full force and effect, notwithstanding the status of the voided item.
■ to approve the Financial Report as of June 30, 2008, as found on file in the Treasurer’s office, and the payment of bills for June, 2008.
■ to accept with gratitude the donation of $5,000 from the Madison Boosters to Madison High School for academic awards.

Model U.N. / Jacqueline Azbill moved and Steve Baldwin seconded that the Board adopt the following resolution.
MADISON LOCAL SCHOOL DISTRICT
RESOLUTION DECLARING INTENT TO PROCEED WITH
ELECTION ON THE QUESTION OF THE RENEWAL OF AN
EXISTING TAX IN EXCESS OF THE TEN-MILL LIMITATION
(O.R.C. §§ 5705.21 & 5705.03)
WHEREAS, the amount of taxes which can be raised within the ten-mill limitation by levies on the current tax duplicate will be insufficient to provide an adequate amount for the necessary requirements of the Madison Local School District;
WHEREAS, on June 17, 2008, the Board of Education of the Madison Local School District adopted a Resolution declaring the necessity for a renewal of all of an existing tax in excess of the ten-mill limitation for general permanent improvements; and
WHEREAS, the Lake County Auditor has certified to the Board of Education of the Madison Local School District that the total current tax valuation of the School District is $412,437,930, and $190,416 of revenue would be generated by a levy of one (1) mill;
NOW, THEREFORE, BE IT RESOLVED, by the Board of Education of the Madison Local School District, two-thirds of all members elected thereto concurring, that it is necessary to levy a renewal of all of an existing tax in excess of the ten-mill limitation for the purpose of general permanent improvements. The tax shall be at a rate not exceeding 1.0 mill for each one dollar of valuation, which is zero dollars and ten cents ($0.10) for each one hundred dollars ($100.00) of valuation, and shall be in effect for a period of five (5) years.
BE IT FURTHER RESOLVED, that the question of approving the renewal of the additional levy be submitted to the electors of the Madison Local School District at a general election to be held on November 4, 2008, and that said levy be placed on the tax list and duplicate for tax year 2008 for collection in calendar year 2009 if approved by a majority of the electors voting thereon.
BE IT FURTHER RESOLVED, that the Treasurer of the Board of Education is hereby directed to certify to the Lake County Board of Elections a copy of the Resolution of June 17, 2008, and a copy of this Resolution, not less than seventy-five (75) days prior to the date of the election.
BE IT FURTHER RESOLVED, that the Lake County Board of Elections is requested to submit the question of levying such renewal of an existing tax, as provided herein and in the Resolution of June 17, 2008, to the electors of the Madison Local School District at the general election to be held on November 4, 2008, and to make all necessary arrangements for the submission of the question to the voters of the School District at that time.
BE IT FURTHER RESOLVED, that it is hereby found and determined that all formal actions of this Board concerning and relating to the adoption of this resolution were adopted in an open meeting of this Board, and that all deliberations of this Board and any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
David Albert, Stephen Baldwin, Jacqueline Azbill, Jay Fabian and Rex Reigert voted "Yes". Vote: 5-0.
RECOMMENDATIONS OF THE SUPERINTENDENT.
Rex Reigert moved and Jacqueline Azbill seconded that the Board separate and table the motion employing James Herrholtz as MHS Model U.N. Co-Advisor. Jacqueline Azbill and Rex Reigert voted “Yes”. David Albert, Stephen Baldwin and Jay Fabian voted “No.” Vote: 2-3. Motion defeated.

Jay Fabian moved and Steve Baldwin seconded that the Board engage in the following personnel actions as listed below; provided, however, that should any item included within this motion be declared by a court of competent jurisdiction to be void or illegal, all remaining items within this motion shall remain in full force and effect notwithstanding the status of the voided item.
■ to accept the resignation of James Herrholtz, Superintendent, effective July 31, 2008, and to approve use of the balance of accumulated vacation for the 2007-08 contract year as desired, plus payment in full of all earned yet unused accumulated vacation days effective August 1, 2008, as found on file in the Treasurer’s Office.
■ to accept the following resignations:
► Steve Hertrick, MMS Teacher, effective at the end of the 2007-08 contract year;
► Dawn Mann, MEM Preschool Teacher, effective at the end of the 2007-08 contract year; and
► Micheline Guerriero, MMS 8th Grade Girls’ Basketball Coach, effective June 26, 2008.
■ to appoint Dr. Matthew Chojnacki as Interim Superintendent, effective August 1, 2008, at a rate of compensation of $450 per day for every day served as Interim Superintendent, under the terms and conditions as found on file in the Treasurer’s Office.
■ to amend the one-year limited teacher’s contract issued to Katie Skocdopole under Board motion #106-08 to reflect correct placement on the teachers’ salary schedule at $38,297 (BA+45, Step 0).
■ to employ the persons for the positions and at the rate of compensation and other terms and conditions of employment as listed below.
► Colleen Triana under a limited administrator’s contract as Assistant High School Principal, effective August 1, 2008 through July 31, 2010 at a rate of compensation of $67,600 for 203 annual days of service, and under other terms and conditions of employment provided by the Board, pursuant to ORC §3319.02 and 4117.01(F) and Board policy GCB-2 and GBF; provided, however, that this contract shall be preceded by a conditional employment contract under which Colleen Triana must satisfy the conditions of ORC §§109.57 and 3319.39 or otherwise immediately be released from employment by the Board. The Board authorizes the Superintendent to execute the limited contract upon evidence that all provisions of ORC §§109.57 and 3319.39 and Board policy GBQ have been met.
► each of the certificated persons listed below under a one-year limited contract, effective the 2008-09 contract year, in their respective positions and at the rate of compensation and fringe benefits as approved by the Board, pursuant to ORC §3319.08 and Board policy GCB-1; provided however, that this contract shall be preceded by a conditional employment contract under which each individual must [1] satisfy the conditions of ORC §§109.57 and 3319.39 and/or [2] provide evidence that they have passed PRAXIS prior to September 15, 2008; or otherwise immediately be released from employment by the Board. The Board authorizes the Superintendent to execute a one-year limited contract upon evidence that all requirements of PRAXIS, ORC §§109.57 and 3319.39 and Board policy GBQ have been met.
