By submitting this bid the bidderacknowledges the fact that the State of North Carolina does not warrant title to or condition of lands. It is the responsibility of the bidder to satisfy itself as to the title to the Property. The bidder should also examine the Property carefully inasmuch as it is the bidder’s responsibility, through survey or otherwise, to satisfy itself on the area of lands being offered for sale. The successful bidder agrees to accept title to the Property “as is” subject to any outstanding liens, taxes or other assessments, encroachments, easements, any reserved rights of the Department as may appear in the Advertisement, as well as any restrictions and/or conditions pertaining to use of this property as imposed by any governing body having jurisdiction over the Property and the uses thereof. The bidder also agrees to accept the Property in its “as is” condition and with any and all faults.

(If thebid is $1,000.00 or less, full amount of purchase price must accompany bid. If more than $1,000.00,
a deposit of $1,000.00 or 10% of bid, whichever is larger, is required.) In the event that bidder is the successful bidder, bidder further agrees that it will, promptly upon request, furnish the Department of Transportation a certified or cashier’s check in the same amount in exchange for the personal or business check which will be returned to bidder, and agrees that the certified or cashier’s check will be credited against the purchase price of the property. Upon delivery to bidder of the deed from the State of North Carolina, bidder will pay any balancedue by certified or cashier’s check.
The criteria to determine the successfulbidder will be the highest bid among responsive and responsible bidders. The Department reserves the right to reject any bid or all bids or to withdraw the Property from the sale. In the event of such rejection or withdrawal, bid deposits will be returned. All bidders accept all risks associated with any and all other expenditures made by the bidder in connection with submission of the bid.
It is bidder’s understanding, in submitting this bid for theProperty, that the sale of the Property must be approved by the North Carolina Board of Transportation and the Council of State of the State of North Carolina, and that there could be a delay of several months in confirming the sale and delivering the deed.
It is understood and agreed that afterbeing designated as the successful bidder and State approval of the sale, if the bidder should fail to comply with any of the above stated conditions, bidder hereby agrees that any monies paid to the Department will be forfeited to the Department and bidder will have no further claim against the Department. It is also understood and agreed that should the Department not approve this bid or State approval not be obtained, the Department will refund any and all monies paid to the Department and bidder will have no further claim against the Department.
Bidder, for itself and its beneficiaries, successors, assigns, and agents, hereby releases, waives, and forever discharges the Department and the State and its board members, officers, employees, agents, attorneys, and representatives of, from, any and all claims, actions, causes of action, suits, debts, bills, costs or expenses, including reasonable attorneys’ fees, and demands whatsoever at law or in equity arising out of or in connection withbidder’s inspection of the Property. The bidder assumes all risk of the liability for any and all injuries arising out of or in connection with, directly or indirectly, the inspection of the Property by the bidder or its agents or representatives.

The undersigned certifies that the he/she has not entered into agreement with any other bidder or prospective bidder or with any other person, firm or corporation relating to the bid price, has not entered into any agreement or arrangement under which any person, firm or corporation is to refrain from bidding, nor any agreement or arrangement for any act or omission in restraint of free competition among bidders, and has not disclosed to any other person, firm or corporation the terms of thisbid.
