The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Tuesday, January 6, 2015 at 8:17pm.

Mayor John Labrosse Jr. called the meeting to order and the City Clerk Deborah Karlsson announced that the meeting was being held in accordance with the Sunshine Law, notice having been published according to law, with a copy on file in the City Clerk’s office, and a copy posted on the bulletin board in City Hall.

Approval of Minutes

A motion to approve the C.O.W Meeting Minutes from October 20, 2014 was offered by Councilwoman Greenman and seconded by Deputy Mayor Canestrino. The minutes were approved by Mayor Labrosse, Deputy Mayor Canestrino, Councilman Sims, and Councilman Battaglia. Councilwoman Greenman abstained from approving the minutes.

A motion to approve the Regular Meeting Minutes from October 21, 2014 was offered by Deputy Mayor Canestrino and seconded by Councilman Battaglia. The minutes were approved by Mayor Labrosse, Deputy Mayor Canestrino, Councilman Sims, and Councilman Battaglia. Councilwoman Greenman abstained from approving the minutes.

City Manager’s Report – David R. Troast

The calendars are completed and will be mailed out. In the meantime, the public can look on the website or call the Manager’s office. We’ve been receiving numerous complaints about the street sweeping. We are having trouble with the equipment and are seeking out to use one of the County’s sweepers for a small fee. Kathy Salvo has helped motivate the County to help with the drainage on Summit Avenue. I will clarify this with the County this week.

FINAL ADOPTION OF ORDINANCE NO. 48-2014, AN ORDINANCE AMENDING CHAPTER 170-50 “NO PARKING SECTION” AND CHAPTER 170-51 “NO PARKING CERTAIN HOURS” OF THE CITY OF HACKENSACK MUNICIPAL CODE

ORDINANCE NO. 48-2014

AN ORDINANCE AMENDING CHAPTER 170-50 “NO PARKING SECTION” AND CHAPTER 170-51 “NO PARKING CERTAIN HOURS” OF THE CITY OF HACKENSACK MUNICIPAL CODE

WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and

WHEREAS, the City of Hackensack (“City”) wishes to amend Chapter 170, Section 50, entitled, “Schedule 1: No Parking” to remove the east side of Holt Street to allow parking and provide parking spots for residents; and

WHEREAS, the City wishes to amend Chapter 170, Section 51, entitled, “Schedule 1: No Parking Certain Hours” to add the east of Holt Street to permit street cleaning between 7:00 am to 10:00 am; and

WHEREAS, N.J.S.A. 39:4-197 authorizes the City Council to pass an ordinance regulating the parking of vehicles on streets and portions thereof and regulating the parking of vehicles upon land owned or leased and maintained by the municipality, a parking authority or the board of education of a school district, including any lands devoted to the public parking of vehicles, the entrances thereto and exits therefrom; and

WHEREAS, N.J.S.A. 40:48-2.46 authorizes the City Council to make, amend, repeal and enforce ordinances to regulate vehicular and pedestrian traffic and the parking of vehicles in parking yards and parking places, which are open to the public or to which the public is invited, whether maintained or operated separately or in conjunction with any business or enterprise; and

WHEREAS, N.J.S.A. 40:67-1 authorizes the City Council to make, amend, repeal and enforce ordinances to prescribe the time, manner and terms upon which persons shall exercise any privilege granted to them in the use of any street, highway, alley, or public place; and

WHEREAS, the City Council finds that the public safety and general welfare of the public will be promoted if sufficient parking is provided for residents.

NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows:

Section 1. Chapter 170, Section 50, entitled “No Parking” to add Holt Street on the east side between Lodi Street and Frederick Street.

In accordance with the provisions of §170-7, no person shall park a vehicle at any time upon any of the following described streets or parts of streets:

RESOLUTION NO. 03-15

RESOLUTION AUTHORIZING THE 2015 H.A.P.A.D.A GRANT

WHEREAS, the Hackensack Municipal Alliance to Prevent Alcohol and Drug Abuse (H.A.P.A.D.A) has proposed a 2015 grant in the amount of

$30, 558.00, qualifying for funding under the New Jersey Governor’s Council on Alcohol and Drug Abuse; and

WHEREAS, funding will implement relevant ATOD (Alcohol, Tobacco & Other Drugs) to benefit the community; and

WHEREAS, the City of Hackensack developed a comprehensive plan to provide matching funds equivalent to $3,819.75 in cash and $11,459.25 in-in-kind expenses in addition to the designated D.E.D.R. grant award of $15,279.00 by the New Jersey Governor’s Council on Alcoholism and Drug Abuse; and

WHEREAS, the City of Hackensack will act as the fiscal agent for the Hackensack Municipal Drug Alliance; and

NOW, THEREFORE BE IT RESOLVED, that the Mayor and Council of the City of Hackensack do hereby affirm endorsement of the aforesaid Letter of Agreement authorizing Mayor John Labrosse to sign the letter of Agreement jointly with the Municipal Alliance Chairperson and the C.F.O.

BE IT FURTHER RESOLVED, that a copy of this Resolution be forwarded to Judy Foreman, Alliance Coordinator, Bergen County Office of Alcohol and Drug Dependency, to accompany the 2014-2019 Hackensack Municipal Alliance Plan filed with Bergen County.

RESOLUTION NO. 04-15

RESOLUTION DETERMINING THE FORM AND OTHER DETAILS OF NOT EXCEEDING

$4,100,000 GENERAL IMPROVEMENT BONDS, SERIES 2015, OF THE CITY OF HACKENSACK,

IN THE COUNTY OF BERGEN, NEW JERSEY, AND PROVIDING FOR THEIR SALE TO

THE NEW JERSEY ENVIRONMENTAL INFRASTRUCTURE TRUST AND

THE STATE OF NEW JERSEY PURSUANT TO THE NEW JERSEY

ENVIRONMENTAL INFRASTRUCTURE TRUST FINANCING PROGRAM.

WHEREAS, the City of Hackensack (the "Local Unit"), in the County of Bergen, New Jersey, has determined that there exists a need within the Local Unit to acquire, construct, renovate or install the Project (the "Project") as defined in each of that certain Loan Agreement (the "Trust Loan Agreement") to be entered into by and between the Local Unit and the New Jersey Environmental Infrastructure Trust (the "Trust") and that certain Loan Agreement (the "Fund Loan Agreement", and together with the Trust Loan Agreement, the "Loan Agreements") to be entered into by and between the Local Unit and the State of New Jersey, acting by and through the New Jersey Department of Environmental Protection (the "State"), all pursuant to the New Jersey Environmental Infrastructure Trust Financing Program (the "Program"); and

WHEREAS, the Local Unit has determined to finance the acquisition, construction, renovation or installation of the Project with the proceeds of a loan to be made by each of the Trust (the "Trust Loan") and the State (the "Fund Loan", and together with the Trust Loan, the "Loans") pursuant to the Trust Loan Agreement and the Fund Loan Agreement, respectively; and

WHEREAS, to evidence the Loans, each of the Trust and the State require the Local Unit to authorize, execute, attest and deliver the Local Unit's General Improvement Bonds, Series 2015, to the Trust (the "Trust Loan Bond") and General Improvement Bonds, Series 2015, to the State (the "Fund Loan Bond", and together with the Trust Loan Bond, the "Local Unit Bonds"), in an aggregate principal amount not to exceed $4,100,000, pursuant to the terms of the Local Bond Law of the State of New Jersey, constituting Chapter 2 of Title 40A of the Revised Statutes of the State of New Jersey (the "Local Bond Law"), other applicable law and the Loan Agreements; and

WHEREAS, N.J.S.A. 40A:2-27(a)(2) of the Local Bond Law allows for the sale of the Trust Loan Bond and the Fund Loan Bond to the Trust and the State, respectively, without any public offering, and N.J.S.A. 58:11B-9(a) allows for the sale of the Trust Loan Bond to the Trust without any public offering, all under the terms and conditions set forth herein.

NOW, THEREFORE, BE IT RESOLVED by a 2/3 vote of the full membership of the governing body of the Local Unit as follows:

Section 1. In accordance with N.J.S.A. 40A:2-27(a)(2) of the Local Bond Law and N.J.S.A. 58:11B-9(a), the Local Unit hereby sells and awards its Trust Loan Bond to the Trust and its Fund Loan Bond to the State, in a total aggregate principal amount not to exceed $ 4,100,000, all in accordance with the provisions hereof. The Local Unit Bonds have been referred to and are described in bond ordinance #39-2014 of the Local Unit, which bond ordinance is entitled "BOND ORDINANCE PROVIDING FOR THE CITY’S COMBINED SEWER SEPARATION PROJECT, BY AND IN THE CITY OF HACKENSACK, IN THE COUNTY OF BERGEN, STATE OF NEW JERSEY; APPROPRIATING $4,100,000 THEREFOR AND AUTHORIZING THE ISSUANCE OF $4,100,000 BONDS OR NOTES OF THE CITY TO FINANCE PART OF THE COST THEREOF” and was finally adopted by the Local Unit at a meeting duly called and held on October 21, 2014, at which time a quorum was present and acted throughout, all pursuant to the terms of the Local Bond Law and other applicable law.
