Community Rules

Revised and effective, January 2002

  1. The greens and walkways in front of the property and the entranceways to the townhouses shall not be obstructed or used for any purpose other than entrance to and exit from the townhouses.
  2. No exterior of any property shall be decorated by any owner in any manner without prior consent of the Board of Directors.
  3. No article shall be hung or shaken from the doors or windows or placed upon the window sills of the property.
  4. No bicycles, scooters, baby carriages, or similar vehicles or toys or other personal articles shall be allowed to stand in any of the common areas.
  5. No owner shall make or permit any noises that will disturb or annoy the occupants of any of the townhouses in the development or do or permit anything to be done which will interfere with the rights, comfort, or convenience of other owners. Any disruptive noise from within or without a unit between the hours of 10 p.m. and 6 a.m. shall be considered excessive.
  6. Each owner shall keep such owner's townhouse and limited common area in a good state of preservation and cleanliness. No birdbath or bird feeders shall be erected in any of the common or limited common areas or hung from any part of the townhouses; nor shall any owner or their guests litter the common areas or walkways of the complex.
  7. No exterior shades, awnings, window guards, ventilators, or air conditioning devices shall be used in the townhouses except such as shall have been approved by the Board of Directors. During the summer months, small, unobtrusive interior window fans may be used in the rear of units only. Such fans are to be inside the screen and shall in no way project out the window. Residents availing themselves of this policy shall remove the fans during daylight hours whenever possible.
  8. No sign, notice, or advertisement shall be inscribed or exposed on or at any window or other part of the townhouses, except such as shall have been approved in writing by management, nor shall anything be projected out of any window in the townhouses without similar approval.
  9. All recyclables and refuse from the townhouses shall be deposited in the bins and Dumpsters intended for such purpose at such times and in such manner as management (or the Board of Directors) and the town may direct. Wet garbage shall be deposited in the owner's disposal rather than in the Dumpsters whenever possible.
  10. Toilets and other water apparatus in the buildings shall not be used for any purposes other than those for which they were constructed, nor shall any sweepings, rubbish, rags, paper, ashes, or any other article be thrown into the same. Any damage resulting from misuse of any toilets or other apparatus shall be paid for by the owner in whose townhouse it shall have been caused.
  11. Dogs and other pets shall not be permitted in any of the common or limited common areas of the property unless carried or on leash. Owners whose pets accidentally defecate on such property or who allow their pets to defecate on any area of the property shall be required to dispose of the waste immediately. The owner shall indemnify management and hold it harmless against any loss or liability of any kind or character whatsoever arising from or growing out of having any animal in the development. If a dog or other animal becomes obnoxious to other owners by barking or otherwise, the owner thereof must cause the problem to be corrected or if it is not corrected, the owner, upon three days written notice by the Board of Directors, will be required to remove the animal from the premises permanently.
  12. No television aerial or dish shall be attached to or hung from the exterior of the townhouses without written approval of management or the Board of Directors.
  13. The agents of management, and any contractor or workman authorized by management, may enter any townhouse, patio, or garage at any reasonable hour of the day for any purpose permitted under the terms of the Declaration of Covenants, Conditions and Restrictions, By-laws or Agreement. Except in case of emergency, entry will be made by prearrangement with the owner.
  14. No vehicle belonging to an owner or to a member of the family or guest, tenant, or employee of an owner shall be parked in such a manner as to impede or prevent ready access to another owner's garage. The owner's family and guests will maintain a reasonable speed (5 to 10 mph) on the drives and will obey the parking regulations and any other traffic regulations promulgated for the safety, comfort, and convenience of the owners.
  15. The owner shall not cause or permit the blowing of any horn from any vehicle of which his guests or family shall be occupants, approaching or upon any of the driveways or parking areas serving the development.
  16. An owner must not permit his guests, tenants, or members of his family to use garages owned by other owners.
  17. The use of garages and other parking spaces shall be restricted to registered vehicles in use by residents or their guests. Such spaces shall not be used for long-term storage of vehicles.
  18. All damage to the property caused by the moving or carrying of any article therein shall be paid by the owner responsible for the presence of such article.
  19. Water shall not be left running for any unreasonable or unnecessary length of time.
  20. No owner shall use or permit to be brought into the property any inflammable oils or fluids such as gasoline, kerosene, naphtha, or benzene, or other explosives or articles deemed extra hazardous to life, limb, or property, without in each case obtaining written consent of management.
  21. The owners shall not be allowed to put their names on any entry of the townhouses, except in the proper places provided for such purpose.
  22. The owners shall close all windows when necessary, to avoid possible damage from storm, rain, or freezing.
  23. No owner shall do any painting of the exterior of the townhouses or garage, except as shall be required on trim by the replacement of doors or windows to the townhouse. In such instances the owner shall contact management regarding purchase of the identical stain.
  24. Any owner wishing to plant trees or shrubs in his limited common area must obtain written permission from the Board of Directors before doing so. No prior approval is necessary for planting flowers or ground cover in this area, but vegetable gardens are not permitted.
  25. The owners shall keep the interior of the garages clean and free from obstructions. Garage storage shall be limited to items associated with vehicles; garages shall not be used for storage of bulky items. Management assumes no liability for loss or damage to articles stored in the garages.
  26. Any damage to buildings or common areas caused by children or their guests shall be repaired at the expense of the parents or associated responsible party.
  27. Parents shall be held responsible for the actions of their children and their guests.
  28. Children shall be allowed to play in their own private patio only. They shall not be allowed to play in the driveways, in the entranceways in front of the townhouses, or on any portion of the common area.
  29. Complaints regarding the management of the townhouses and grounds shall be made in writing to the Board of Directors. Complaints regarding actions of other owners shall be made to management or to the Board of Directors, in writing whenever possible.
  30. Any consent or approval given under these Community Rules by management shall be revocable at any time.
  31. These Community Rules may be added to or repealed at any time by the Board of Directors.
