MINUTES OF THE SPRINGDALE TOWN BOARD MEETING – March 21, 2011

IN ATTENDANCE:Town Board Chair Supervisor I Wayne Hefty, Supervisor II Richard Schwenn and Clerk Vicki Anderson.

CALL TO ORDER: by Supervisor Hefty, 7p.m.

NOTICE OF THE MEETING: pursuant to Wisconsin Open Meeting Law was confirmed.By 3/17/11 the agenda was posted in the three customary locations in the Town of Springdale as required by law. As an additional service to the citizens, a tentative agenda of the meeting was published in the “Mt. Horeb Mail” and Town and Country Shopper on 3/17/11.

MINUTES: Motion by Schwenn/Hefty to approve the TB minutes of 2/21/11asdistributed. Motion carried 2-0.

PUBLIC INPUT: Mt. Horeb Area Joint Fire District (MHAJFD) Commissioner Mike Lamberty presented the Town Board with two sample ordinance for fire safety inspections and enforcement. The MHAJFD requests that the member municipalities adopt an ordinance giving the fire safety inspectors the authority to inspect businesses open to the public for compliance with fire safety codes and to issue citations for fire safety code violations.

No costs would be incurred by the town for the fire safety inspections. Additionally, Lamberty informed the Town that Craig Brinkman, a member of the MHAJFD, has been named the interim fire chief. No additional costs will be incurred.

CRAIG JUDD/MT. VERNON PARK ASSOCIATION/ANNUAL UPDATE/INFORMATION ONLY: President Judd attended the meeting to provide the annual report of 2010 park board activities to the town and to express appreciation for the town’s continued annual financial support of $2000.

The 2011 Mt. Vernon Park Board is: President Craig Judd, Vice President James Graham, Secretary Linsay Jenson, Treasurer/Park Scheduler Anita Nesheim, Park Grounds Keeper Jack Northrop and Scott Austin, Directors: Honorary Member Ben Goebler, 1 Year Larry Johnson, 2 Year Dan Michaels, 3 Year Terry Pankow.

2010 overview included, but was not limited, to the following points:

**2010 ending balance - $4,779.08, **2010 donations: Town of Springdale $2000, Zwingli Chicken BBQ $296.96, Bob Tramburg $1000. **Special project completed in 2010 - gazebo foundation, **Calendar for 2011: Park Spring Clean up-April 15 at 4:30 p.m. (raindate April 22) 60th Annual Ball Tournaments on Aug. 27-28, Sept. 3-4, Sept. 10-11, Annual Meeting of Association Feb. 7, 2012. **Day-long park rental is $65.

PLAN COMMISSION: JOAN MRKVICKA/CUP #2165 DAY CAMP SCHOOL/2418 DAHLK CIRCLE/SEC. 25:

MOTION by Hefty/Schwenn to approve the CUP with the following conditions:

1. Hours of operation of the day camp school shall be limited to: 7 a.m. to 6 p.m., Monday through Friday.

2. Dates of operation of the day camp school shall be limited to June 1 through Sept. 15.

3. Capacity of the day camp school shall be limited to 15 children.

4. Signage shall conform to all pertinent ordinances in the Town of Springdale, county and state.

MOTION by Hefty/Schwenn to amend the motion by including the following condition:

5. Adequate off-street parking shall be installed on site to accommodate vehicle parking as required under Dane County Code of Ordinance section 10.18. Motion to amend carried 2-0. MAIN MOTION to approve with five conditions carried 2-0.

OPERATOR’S LICENSE: MOTION by Schwenn/Hefty to approve an operator’s license for March 21, 2011 through June 30, 2011 for Barb Johnson, Marcine’s LLC./Davis St./Sec. 34. Discussion: The paperwork, fee and criminal record check has been satisfactorily completed. Motion to approve carried 2-0.

OUTDOOR CONSUMPTION AREA AND SIGN/MARCINE’S LLC/SEC. 34/DAVIS ST.:

Outdoor consumption area: In a general discussion, no action, Lanny Gilberston discussed the intent to establish an outdoor consumption area at Marcine’s for patrons who wish to go outside to smoke with their alcoholic beverage. Since the area between the front of the building and CTH G is within the right-of-way of the county highway, this area cannot be identified as the outdoor consumption area. Gilbertson will research the actual area owned by Marcine’s LLC to determine whether an enclosed deck could be located at the side of the building, accessible from the bar by a door. A copy of the town’s ordinance for outdoor consumption areas has been mailed to the Gilbertsons. In response to Gilbertson’s inquiry about outdoor entertainment in the outdoor consumption area, it was explained that a conditional use permit would be required from Dane County/Town.

Beer sign: Gilbertson also discussed whether a beer sign could be located on the front of Marcine’s. At a future meeting he will bring in the dimensions of the sign. The Town Board will then review the application for consistency with the Town of Springdale sign ordinance.

REPAIRS TO WINDOWS/HISTORICAL TOWN HALL, REPAIRS AND PAINTING TO THE CEILING/CURRENT TOWN HALL AND PAINTING BATHROOMS: Before the April Town Board meeting the Town Board will solicit cost estimates for these projects to be discussed at the April meeting.

BILLS: MOTION by Schwenn/Hefty to approve the bills as submitted. Motion carried 2-0.
