Fifth Louisiana Levee District

February 13, 2013

The Board of Commissioners for the Fifth Louisiana Levee District met in regular session on Wednesday, February 13, 2013, at the Levee Board Office, 102 Burnside Drive, Tallulah, LA at 9:00 a.m. Vice-President James Kelly called the meeting to order. Commissioners Sam Hill, Barry Maxwell, Jack Varner, and Pat Mabray answered roll call.

Visitors included Andy Anders, Louisiana State Representative; Laura James, Legislative Aid; Paul Colquette, LA DOTD; Rick Shelton, USACE; and Yvonne Lewis, Madison Journal.

On motion by Commissioner Maxwell, 2nd by Commissioner Hill, the Board approved minutes from the January 9, 2013, meeting. Commissioners reviewed and approved claims submitted for January, on motion by Commissioner Maxwell, 2nd by Commissioner Mabray. Commissioners reviewed financial statements for January.

The Board heard comments from State Representative Andy Anders concerning drainage issues with two separate landowners in Concordia Parish. The Levee District Office will follow up with letters to the United States Army Corps of Engineers. No action needed.

On motion by Commissioner Varner, 2nd by Commissioner Maxwell, the Board approved to pay Board Expenses for Board President to attend Spring Meeting of MVFCA in Washington D.C.

The Board considered a request from Ford, Bacon & Davis seeking permission to perform geotechnical borings up to a depth of 40 feet for field investigation in Concordia Parish. On motion by Commissioner Maxwell, 2nd by Commissioner Varner, approval was granted subject to USACE and DOTD approval.

On motion by Commissioner Varner, 2nd by Commissioner Hill, the Board approved a permit request from Pittman Hogue, LLC to install a 2 inch water line over the Mainline Mississippi River Levee in East Carroll Parish. Approval was granted subject to USACE and DOTD approval.

On motion by Commissioner Kelly, 2nd by Commissioner Varner, the Board approved a permit request from Hall Schneider allowing the following: new fencing along the toe, cross-fencing, permission to graze cattle, and permission to cut hay near the Mainline Mississippi River Levee in East Carroll Parish. Approval was granted subject to USACE and DOTD approval.

On motion by Commissioner Maxwell, 2nd by Commissioner Hill, Board approved resolution to appropriate rights-of-way required for construction in conjunction with Flood Control/Mississippi River and Tributaries, West Bank Mississippi River Levees Item 466-R, Ice Box Hole, Seepage Control East Carroll Parish, as shown on USACE Map File No. M-15-1070.

The Board reviewed resolution giving George Fox, attorney, right to expropriate rights-of-way required for construction in conjunction with Flood Control/Mississippi River and Tributaries, West Bank Mississippi River Levees Item 464-R, Henderson, Seepage Control East Carroll Parish, as shown on USACE Map File No. M-15-1070. The Board approved the resolution on motion by Commissioner Maxwell, 2nd by Commissioner Hill, with Commissioner Varner abstaining.

The Board reviewed resolution giving George Fox, attorney, right to expropriate rights-of-way required for construction in conjunction with Flood Control/Mississippi River and Tributaries, West Bank Mississippi River Levees Item 397-R, Botany Bay, Seepage Control Tensas Parish, as shown on USACE Map File No. M-15-1070. The Board approved the resolution on motion by Commissioner Hill, 2nd by Commissioner Varner.

The Board reviewed resolution giving George Fox, attorney, right to expropriate rights-of-way required for construction in conjunction with Flood Control/Mississippi River and Tributaries, West Bank Mississippi River Levees Item 397-R, Lake Bruin, Seepage Control Tensas Parish, as shown on USACE Map File No. M-15-1070. The Board approved the resolution on motion by Commissioner Varner, 2nd by Commissioner Hill.

There being no other business to consider, the meeting was adjourned on motion by Commissioner Varner, 2nd by Commissioner Maxwell.
