Default having been made in the payment of a certain note datedJanuary 30, 2017executed byCrescent Building Group, Inc., payable to Carter County Bank, a division of Bank of Tennessee, and being the note described in a Deed of Trust dated January 30, 2017, executed byCrescent Building Group, Inc., of record in Book 3232, page 1116, Register of Deed’s Office for Sullivan County, Tennessee, (the “Deed of Trust”),wherein the said Crescent Building Group, Inc.,conveyed the property therein described to Roy L. This property is subject to a Federal Tax Lien against Crescent Building Group, Inc. dated August 20, 2017 and filed of record on August 22, 2017 in Book 3255, page 2231 in said Register’s Office. The notices required by 26 U.S.C. 7425(c) have been timely given to the Internal Revenue Service. The sale of the property will be subject to the right of the Internal Revenue Service to redeem the property as provided in 26 U.S.C. 7425(a)(1).

This property is further subject to a Deed of Trust from Crescent Building Group, Inc., to James N. Point, Trustee, dated September 22, 2017, and securing Integrity Building Group, LLC, the payment of the principal sum of $126,000.00, recorded in Book 3260, page 2486 in said Register’s Office.

This property is further subject to a Deed of Trust from Crescent Building Group, Inc., to James N. Point, Trustee, dated October 27, 2017, and securing Karla Karst, the payment of the principal sum of $592,000.00, recorded in Book 3264, page 1054 in said Register’s Office.

This property is further subject to a Notice of Lien against Crescent Building Group, Inc., in favor of Builder Services Group Inc., d/b/a All Seasons Insulation, in the amount of $1,870.00 of record in Book 3256, page 804 in said Register’s Office.

This property is further subject to a Notice of Lien against Crescent Building Group, Inc., in favor of Builders First Source-Southeast Group, LLC, in the amount of $30,833.51 of record in Book 3262, page 1730 in said Register’s Office. As Amended by Amended Notice of Lien changing the amount to $28,722.40, of record in Book 3265, page 369 in said Register’s Office.

This property is further subject to a Claim of Lien against Crescent Building Group, Inc., in favor of Jeffrey Michels in the amount of $2,722.00 of record in Book 3265, page 2146 in said Register’s Office.

To the extent the proceeds from the sale of the property exceed the amount necessary to pay all principal, interest, foreclosure expenses and other sums secured by the Deed of Trust, the Substitute Trustee will hold such excess proceeds for the benefit of any junior encumbrances as their interests may appear.

TERMS OF SALE: CASH. A deposit of ten percent (10%) of the final sales price will be required from the highest bidder at the conclusion of the foreclosure sale. The entire remaining amount of the final sales price must be paid in full in cash to the Substitute Trustee within fifteen (15) days after sale. The purchaser shall pay all recording fees, title examination fees, and settlement fees.

The foreclosure sale of the foregoing property is made without warranty as to the title or physical condition of the property and improvements thereto, if any, and is expressly made subject to any and all unpaid taxes and any other prior claims, liens, any possible superior rights arising from mechanic’s liens and materialmen’s liens (filed or unfiled), conditions, restrictions, rights-of-way, easements, and reservations contained in the Deeds and instruments forming the chain of title to the property, and such additional matters as an updated survey and physical inspection of the Premises would reveal. The foreclosure sale is also made without warranty as to the exact acreage of any of the property.

It will be the responsibility of the successful bidder to obtain possession of the property at his expense. The successful bidder shall be responsible for any damage, vandalism, theft, destruction, or other loss or damage to the property occurring subsequent to the date of sale.

THE SUBSTITUTE TRUSTEE RESERVES THE RIGHT: (i) to act as agent on behalf of the holder of the indebtedness described herein for the purpose of entering bid(s) or otherwise representing the interests of the holder of the indebtedness or any other party; (ii) to waive the deposit requirement; (iii) to extend the period of time within which the successful bidder is to make full settlement; (iv) to withdraw the property from sale at any time prior to the termination of the bidding; (v) to keep the bidding open for any length of time; and (vi) to postpone or set over the date of sale in the event the Substitute Trustee deems it best for any reason at the time of sale to postpone or continue this sale from time to time, with such notice of postponement or setting over to be in a manner deemed reasonable by the Substitute Trustee.

In the event the highest bidder at such sale fails to complete his purchase of the subject real property within the applicable time allowed, the undersigned Substitute Trustee reserves the right to complete the sale of the subject real property, without further notice or advertisement, to the next highest bidder who is able to consummate his purchase of the property within the time permitted by the Substitute Trustee.
