6.  DIRECTOR’S REPORT

§  Clerk position is included with next year’s budget proposal being presented to the Board of Supervisors;

§  Work Program; Staffing issues, lost two Planners in the last two weeks and two new ones coming on board soon;

§  General Plan – Board of Supervisors extended Comment period to 60 days – ending June 18th, Board suggests the Steering Committee continue their work, Two additional public hearings will be held – one will be at the regular meeting of the Steering Committee on May 30th @ 1:00 p.m. – request that the Planning Commission hold one on an evening during the week of June 11th. Hillary will look at schedule and get back to Commission with final date, will be starting this meeting at 6:00 p.m.;

§  Matrix has been redrafted and will be made available.

9.  ROBERT D. FOLEY JR. & KELLI L. KEHOE TRUST / ROBERT FOLEY VINEYARDS WINERY – USE PERMIT REQUEST # P06-01275-UP
CEQA STATUS: Mitigated Negative Declaration Prepared. According to the Mitigated Negative Declaration, the proposed project would have, if mitigation measures are not included, potentially significant environmental impacts in the following areas: biological and cultural resources.
REQUEST: Approval of a Use Permit to establish a new 30,000 gallon per year winery with: (1) a winery totaling 12,350 square feet located inside a cave; (2) a 7,600 square foot uncovered crush pad; (3) one full-time employee and one additional employee at harvest; (4) two parking spaces; (5) construction of waste disposal systems requiring permits; (6) staging and removal of cave spoils from the property; (7) removal of approximately 26 trees; and, (8) installation of a new 12,500 gallon water tank for fire suppression. No tours and tasting or marketing activities have been proposed. The project is located on a 13.04 acre parcel on the north side of Summit Lake Drive approximately 3,200 feet northwest of its intersection with North White Cottage Road within an AW (Agricultural Watershed) zoning district. Commission voted for adoption of mitigated negative declaration and the attached amended mitigation monitoring and reporting plan based on environmental findings 1 through 6.

10.  LEWIS AUTO DISMANTLING USE PERMIT #U-5-68

9:30 am. REQUEST: Revocation, suspension or modification of Use Permit No. U-5-68 is requested on the grounds that a person making use of the use permit is violating or has violated conditions thereof; the use for which the use permit was granted is being, or has been, exercised contrary to the terms or conditions of such approval; the use for which the approval was granted is being exercised as to be detrimental to the public health, safety or general welfare; the use for which the approval was granted is being exercised in such a manner as to constitute a nuisance. Court Reporter present and took all statements and swore in all potential speakers.
Commission voted to revoke Use Permit #U-5-68 as revised September 20, 2006 based on today’s testimony and items 3 thru 9 of staff report and those items constitute findings 2 thru 5 as listed on page 3 which find that the conditions of the use permit have been violated or exercised contrary to the terms of the condition of approval and the use of the permit has been exercised as to be detrimental to the public health, safety or general welfare and constitutes a nuisance.

11.  STATUS REVIEW, DISCUSSION AND POSSIBLE ACTION REGARDING COMPLIANCE WITH USE PERMIT FOR JAYSON WOODBRIDGE / ONE TRUE VINE #P04-0551-UP, 565 CRYSTAL SPRINGS ROAD, ST. HELENA CA. APN #021-072-044-000. JMc
John McDowell presented quarterly report. Project seems close to being wrapped up. Applicant has submitted modification last August to get the bridge taken care of and adjust the conditions of approval. Discussion covered the charitable donations. There will be three years worth of quarterly reports to do, can switch to 6 months reports when they reach full compliance and maintain full compliance for a full year. No action taken by Commission.

12.  ANNUAL REVIEW AND DISCUSSION OF THE STANDARD USE PERMIT AND VARIANCE CONDITIONS OF APPROVAL IMPOSED ON DEVELOPMENT PROJECTS. (Continued from January 17, February 7, and March 7, 2007 Meeting). JMc

15.  DEPUTY DIRECTOR’S REPORT

§  DISCUSSION OF ITEMS FOR THE APRIL 18, 2007 MEETING – Five public hearing items currently scheduled – Hour Glass Winery, Frank Family Vineyards, Aetna Springs Club House, Silverado Hills Major Modification and Toad Hall Winery; Simplified Staff Report format to be presented also.

§  CODE COMPLIANCE REPORT – No Code Compliance to report.

§  ZONING ADMINISTRATOR ACTIONS – Westin Residence Viewshed.
