Procedure for Appealing the Denial of Release

A student athlete has the opportunity to appeal the decision made by our institution to deny a student-athlete’s request to contact another school about transferring. Should a student-athlete have their request for a release denied they will be notified via email by Gary Hyatt, Associate Athletic Director for Compliance and Academics, no later than 14 days after receipt of a student-athlete’s written request. As a part of the notification, the student-athlete will also be informed of their opportunity to appeal this decision.

To begin the appeal process the student must:

  1. Appeal to Director of Athletics –The student-athlete must email or drop off a letter of appeal to Gary Hyatt, Associate Athletic Director for Compliance & Student Services, no later than 10 days from the date of the cancellation notification. Gary Hyatt is located in Nicholson 101D and can be reached at . The Director of Athletics, Dr. Dennis Francois, will respond to the appeal letter within five business days.

If the appeal to the athletic director is denied

  1. Appeal to the Athletic Compliance Committee– If the student athlete still feels that the matter has not been resolved, he/she may ask for the appeal to be heard by the athletic compliance committee. The student-athlete must send a letter of appeal to Dr.Ethan Bergman, CWU’s Faculty Athletic Representative.Dr. Bergman will call committee members together to hear the appeal. The student-athlete must request an appeal and provide all necessary documents to be heard by the committee within 10 days of the notification of denial from the athletic director. In order to hear the appeal, the student athlete must provide the following information:

  1. A typed statementof the student-athlete’s reason for believing that the Athletic Department’s decision was unwarranted. This statement should include the names of institutional staff members with whom the student-athlete has discussed his/her aid.
  2. Documentation for the reason you are leaving (if applicable).
  3. Miscellaneous correspondence/documentation with Athletic Department (if applicable).

The athletic department will be asked to provide the following information to the committee:

  1. A letter from the athletic department discussing the reasons for the denial.
  2. Relevant correspondence/documentation
  3. Any Additional information requested by the committee.

The appeals committee will be made up of at least three members of the athletic compliance committee. Thissub-committee will make a decision regarding the student’s appeal within 15 days after all documentation has been collected. The Faculty Athletic Representative will notify the student in writing within five business days of the decision. A copy of the FAR’s correspondence will be sent to the Athletic Department. Both the Athletic Department and student athlete must adhere to the decision made by the committee. The decision is final and no other appeal is permitted.
