DWR Requests Qualification Proposals for Funding SB xx1 Projects

Sacramento - The Department of Water Resources announces its request for proposals from local agencies within the Delta region that have water projects which qualify for the funding appropriated in Senate Bill xx1 (SB xx1) (Perata,Stats. 2008, Ch. 1) California Water Code (CWC) Division 33 Section 83002.(b)(3)(A)(iii). Ten million dollars is provided to fund water projects that meet the requirements of CWC Division 33 Section 83002.(b)(3)(A)(iii), as cited below:

“…not less than ten million dollars ($10,000,000) shall be made available for expenditure to interconnect municipal and industrial water supply aqueducts that cross the Delta and that are vulnerable to flood damage, including the design and construction of interties among aqueducts that provide at least 90 percent of a regional water supply that would be threatened in the event of levee failure or other disaster, and that support an integrated regional emergency water supply system.”

DWR has determined that funding eligibility under SB xx1may not be exclusive to one agency. In addition, the $10 million in appropriations within this Section of SB xx1 can be directly expended and are not mandated to be competitively granted. Since the legislative language of this section of SB xx1is not specific as to the intended recipient of the allocation, DWR has decided to solicit qualification proposals to ensure that the Delta Aqueduct Intertie funding is fairly and properly awarded to an agency that meets the intent of the law.

Local public agencies that believe they qualify for this SB xx1 allocation, must notify DWR within 30 days of this announcement. An agency submittal in response to this request shall include a justification letter with supporting documentation to DWR Integrated Regional Water Management Division - Financial Assistance Branch. DWR will review all submittals and rank submittals based on the following two pass/fail criteria:

  1. The proposed project meets all of the requirements of CWC Division 33 Section 83002.(b)(3)(A)(iii); and
  2. The proposed Delta Aqueduct Intertie Project has completed environmental compliance review, obtained necessary regulatory agency permits, acquired right of way (if necessary), has complete design with Plans and Specifications, and can begin construction on at least one phase of the project within six (6) months of submitting their proposal to DWR.

The Department of Water Resources operates and maintains the State Water Project, provides dam safety and flood control and inspection services, assists local water districts in water management and water conservation planning, and plans for future statewide water needs.
