INSTRUCTIONS

GENERAL COMMENTS

A contracting authority shall prepare all tender dossiers, notices, invitations and other documents published or provided to economic operators during the conduct of a procurement activity leading to the award of a minimal, low or medium value contract or design contest in the Albanian and the Serbian languages which shall be equally authentic. A contracting authority may also prepare such documents in the English language. (Section 12.1 PPL)

12.2A contracting authority shall prepare all tender dossiers, notices, invitations and other documents published or provided to economic operators during the conduct of a procurement activity leading to the award of a large value contract or design contest in the Albanian, Serbian and English languages.(Section 12.2 PPL)

INDICATIVE NOTICE

When a contracting authority has the intention of awarding, over a future 12-month period, (i) one or more supply contracts having an estimated value, alone or in the aggregate, of 250,000 Euros, (ii) one or more service contracts having an estimated value, alone or in the aggregate, of 250,000 Euros, or (iii) one or more works contracts having an estimated value, alone or in the aggregate, of 250,000 Euros, the contracting authority shall prepare an indicative notice that specifies:

  1. in the case of anticipated supply contracts, the total procurement by product area that the contracting authority intends to procure over such 12-month period;
  1. in the case of anticipated service contracts, the estimated aggregate value of each category of service that the contracting authority intends to procure over such 12-month period; and
  1. in the case of anticipated works contracts, the essential characteristics of the works contracts that the contracting authority intends to award over such 12-month period.

An indicative notice shall be prepared in the Albanian, Serbian and English languages. The contracting authority shall ensure that all language versions of an indicative notice comply with the present law and contain materially identical information.

In the case of an indicative notice referred to in Section 37.1.a or b, the contracting authority shall prepare such indicative notice as soon as possible after the beginning of the concerned fiscal year.

In the case of an indicative notice referred to in Section 37.1.c, the contracting authority shall prepare such indicative notice immediately after the decision approving the planning of the concerned works contracts. (Section 37 of the Law No. 02/L-99, Law for Public Procurement in Kosova promulgated with Regulation No.2007/20).

PUBLICATION OF INDICATIVE NOTICE

According to section 40.1 of PPL, all language version of Indicative Notice shallimmediately submit to the PPRC, and in accordance with section 40.2 of the PPL, PPRC shall include those in the Public Procurement Register and shall publish in the PPRC’s website.

As well, the contracting authority shall publish Indicative Notice prepared in the required languages, according to section 40.3 of the PPL. The short version of the notice should be prepared, in order to reduce the costs of notice so that contracting authority can publish more than is the minimum required.

According to section 40.5 of the PPL, no information in the Indicative Notice may be made public or disclosed to any person prior to its publication of the mentioned Notice according to section 40.2 or 40.3 of the PPL.

CONSECUENCES OF THE INDICATIVE NOTICE FOR MINIMAL TIME LIMITES

According to section 43.1, the publication of Indicative Notice has the effect, that minimal time limits for the receipt of tenders in open and restricted procedure for contract award with large value be reduced to 24 calendar days ( instead of 40 days, respectively).
