ARESOLUTION OPPOSING HOUSE BILL NO. 200 OF THE 2017 REGULAR SESSION OF THE LEGISLATURE OF THE STATE OF LOUISIANA RELATIVE TO THE PERSONNEL DIRECTOR OF THE CITY OF MANDEVILLE POLICE EMPLOYEES CIVIL SERVICE SYSTEM OR ANY OTHER LEGISLATION WHICH ATTEMPTS TO REMOVE THE PERSONNEL DIRECTOR FROM THE CITY OF MANDEVILLE POLICE EMPLOYEES CIVIL SERVICE SYSTEM
WHEREAS, the Administration for the City of Mandeville has sought the introduction of House Bill No. 200 of the 2017 Regular Session of the Legislature of the State of Louisiana;and
WHEREAS, House Bill No. 200, if enacted, would amend Act No. 164 of the 1984 Regular Session of the Legislature, as amended by Act No. 418 of the 2009 Regular Session of the Legislature, to provide that the human resources director for the classified civil service system established by the Home Rule Charter for the City of Mandeville shall be the personnel director for the City of Mandeville Police Employees Civil Service System; and
WHEREAS, the Mayor of the City of Mandeville has publically indicated that if House Bill No. 200 is enacted, his intent is to then amend the Home Rule Charter to provide that the human resources director is no longer within either the City of Mandeville Police Employees Civil Service System or the City of Mandeville Municipal Employees Civil Service System; and
WHEREAS, the human resources/personnel director of both the City of Mandeville Police Employees Civil Service System and the City of Mandeville Municipal Employees Civil Service System is also the director of civil service for both civil service systems; and
WHEREAS, as the director of civil service for both civil service systems, the human resources/personnel director is responsible for implementing and administering both civil service systems; and
WHEREAS, in carrying our those responsibilities and duties it is imperative that the human resources/personnel director be within the classified civil service systems and under the direction and control of the Boards of both the City of Mandeville Police Employees Civil Service System and the City of Mandeville Municipal Employees Civil Service System; and
WHEREAS, if the human resources/personnel director were under the direction and control of the Mayor, the Mayor would then have the power to directly influence both civil service systems by directing the human resources/personnel director, also the director of civil service, to take certain actions contrary to the principles of civil service; and
WHEREAS, in order to effectively carry out the purposes and intent of the City of Mandeville Police Employees Civil Service System and the City of Mandeville Municipal Employees Civil Service System, it is imperative that the human resources/personnel director be within the classified civil service systems and under the authority of and responsible to the City of Mandeville Police Employees Civil Service Board and the City of Mandeville Municipal Employees Civil Service Board; and
WHEREAS, at a joint meeting of the City of Mandeville Police Employees Civil Service Board and the City of Mandeville Municipal Employees Civil Service Board, the Boards unanimously adopted a resolution opposing any legislation which would attempt to remove the human resources/personnel director from the City of Mandeville Police Employees Civil Service System and/or which would place her under the direction and control of the Mayor and also urging the Mandeville City Council to adopt a similar resolution.
NOW THEREFORE BE IT RESOLVED that the City Council for the City of Mandeville hereby opposes House Bill No. 200 or any legislation which would attempt to remove the human resources/personnel director from the City of Mandeville Police Employees Civil Service System and/or which would place her under the direction and control of the Mayor.
BE IT FURTHER RESOLVEDthatcopiesofthisresolutionshallbetransmittedtothe members of the House of Representatives and of the State Senate representing the Parish of St. Tammany.
With the above resolution having been properly introduced and duly seconded, the votewas as follows:
