Mayor Moslowski Jr. called the meeting to order at 7:05 p.m. and requested the Clerk to call the roll. The following Committee Members were present: Mr. Alexander, Robert Faber, Dr. Robert A. Frascella, Ms. LoriSue H. Mount (arrived 7:15), and Mayor Stanley Moslowski Jr. Also present at the dais: Dana L. Tyler, Municipal Clerk, Dianne Kelly, CFO/Administrator, Dennis A. Collins Esq., Township Attorney.

Following the Flag Salute, the Clerk announced that the Notice requirements of R.S. 10:4-18 for an "Annual Notice" had been satisfied by the publication of the required advertisement in the Asbury Park Press and the Messenger Press January 15, 2015, posting the notice on the Board in the Upper Freehold Township Municipal Building and filing a copy of said notice with the Municipal Clerk.

2015 BUSINESS: THE WORKSHOP MEETING OF DECEMBER 09, 2015 WAS RECESSED PENDING ANY OPEN 2015 BUSINESS ON WHICH ACTION MAY BE TAKEN.

REPORTS: Committee Liaisons will each provide reports on their respective departments, monthly reports prepared by Department Heads, listed herein, are on file in the office of the Municipal Clerk.

·  Eatontown Borough – Adopted a Resolution advising the Monmouth County Board of Taxation that the Borough of Eatontown is Opting Out of the Monmouth County Board of Taxation Assessment Demonstration Program

·  Municipal Excess Liability Joint Insurance Fund – Cyber Liability

·  Borough of Little Silver – Adopted a Resolution in support of the Assessment Demonstration Program

·  Monmouth County Board of Agriculture Development Board – Adopted a Resolution approving the Request of Reed Sod Farm to Divide Deed-Restricted property known as Block 24, Lots 22.01 and 23 in Upper Freehold Township and Resolution of the Monmouth County Agriculture Development Board Authorizing Installation of Irrigation Pond

·  Cablevision Systems Corporation filed a petition with the New Jersey Board of Public Utilities seeking approval of the transfer of control of all of Cablevision’s subsidiaries that hold cable television franchises in New Jersey.

·  Borough of Allentown – Adopted Resolution authorizing Mayor Fierstein to comply with the court order from Judge Perri

·  Borough of Manasquan – Adoption of Resolution advising the Monmouth County Board of Taxation that the Borough of Eatontown is opting out of the Monmouth County Board of Taxation Assessment Demonstration Program

·  Township of Chesterfield – Adopted a Resolution Supplementing and Amending Resolution 2015-4-2, which Resolution Opposed the “Installation of the ‘Southern Reliability Link’ Natural Gas Pipeline along County Route 528 through Chesterfield Township,” and Specifically, to now Oppose the Pipeline in it’s entirety – copy attached

·  Millstone Township – Adoption of a Resolution Advising the Monmouth County Board of Taxation that the Township of Millstone is Opting out of the Millstone County Board of Taxation Assessment Demonstration Program

·  Township of Wall – Adopted a Resolution Advising Monmouth County Board of Taxation that the Township of Wall is Opting out of the Monmouth County Board of Taxation Assessment Demonstration Program

·  JCP&L - The Haverfield Corp. will be performing Comprehensive Visual Inspections (CVI's) on the 230kV transmission lines in the JCP&L Region starting January 4th 2016.

·  ****Monmouth County 2015 Planning Merit Awards***** Screamin’ Hill Brewery, located on Emleys Hill Road in Upper Freehold Township for promotion of agri-tourism historic preservation, and sustainable initiatives. The unquie brewery utilitzed adaptive reuse by transforming a portion of an agriculture farm into a farm brewery. The brewery combined historic preservation of a sixth generation owned farm, along with intergovernmental cooperation to properly ensure compliance with the Deed of Easement, while obtaining proper micro-brewing licenses. It also generates the five categories of agri-tourism activities: direct consumer sales, educational tourism, entertainment, accommodations, and outdoor recreation. It promotes Monmouth County’s Economic Development’s new “Grown in Monmouth” program and is consistent with related stakeholder strategies in the Monmouth County Draft Master Plan. The brewery is a prime example of how craft breweries can work with New Jersey’s agriculture industry to produce products in great demand, with a unique “farm-to-glass” approach.

MINUTES APPROVED: A motion was offered by Ms. Mount, moved and seconded by Dr. Frascella, the Regular and Executive Session Minutes of December 9, 2015 be approved. The motion was approved by the following vote: Mr. Faber, aye; Ms. Mount, aye; Dr. Frascella, aye, and Mayor Moslowski aye.

RESOLUTION 169-15 A RESOLUTION AUTHORIZING THE TRANSFER OF FUNDS

The following Resolution was offered by Dr. Frascella, moved and seconded by Mr. Alexander.

RESOLUTION 173-15 A RESOLUTION AUTHORIZING OVERPAYMENT

OF TAXES BE APPLIED TO 1ST QTR 2016 ON BLOCK 50 LOT 4 DUE TO STATE TAX APPEAL 007049-2015

WHEREAS, the Tax Collector has certified that an overpayment has been created due to State Tax Court Docket #007049-2015 on Block 50 Lot 4 assessed to Bernice A. Lemack 12 Hill Road, Cream Ridge, NJ 08514. Old Assessment was for $1,163,200.00 and was reduced down to $883,600.00. Total Tax went from $27,300.30 to $20,738.09 which caused an overpayment of $6,562.21

WHEREAS, the collector is requesting to apply the above amount of $6,562.21 to 1st qtr 2016.

THEREFORE, BE IT RESOLVED, by the Township Committee of Upper Freehold Township that the Tax Collector be and hereby authorized to apply said overpayment to 1st qtr 2016.

BE IT FURTHER RESOLVED, that a certified copy of this Resolution be forwarded to the Upper Freehold Tax Collector

RESOLUTION 174-15 A RESOLUTION AUTHORIZING OVERPAYMENT

OF TAXES BE APPLIED TO 1ST QTR 2016 ON BLOCK 33 LOT 4.27 DUE TO STATE TAX APPEAL 51-1500074AA

WHEREAS, the Tax Collector has certified that an overpayment has been created due to County Tax Court Docket #51-1500074AA on Block 33 Lot 4.27 assessed to Frank & Madelyn D'Adamo, 26 Weathervane Circle, Cream Ridge, NJ 08514. Added Assessment was for $600,508.00 and was reduced down to $581,717.00. Total Tax went from $14,093.92 to $13,652.89 which caused an overpayment of $441.03.

WHEREAS, the collector is requesting to apply the above amount of $441.03 to 1st qtr 2016.

THEREFORE, BE IT RESOLVED, by the Township Committee of Upper Freehold Township that the Tax Collector be and hereby authorized to apply said overpayment to 1st qtr 2016.

RESOLUTION 175-15 A RESOLUTION AUTHORIZING THE REFUND OF A BUILDING PERMIT FEE – BLOCK 47.01, LOT 47

WHEREAS, an application and $133.00 permit fee was received by the Upper Freehold Township Building Department from A.J. Perri for a furnace and hot water heater replacement to be done on Block 24, Lot 25, 42 Bunker Hill Drive in Upper Freehold Township and subsequently issued Permit #15-00252; and,

WHEREAS, The Hoaglands did not proceed with construction of the furnace and hot water heater replacement; and,

WHEREAS the applicant has requested that the permit #15-00359 be voided and the permit fee refunded; and.

NOW, THEREFORE, BE IT RESOLVED that the Treasurer/CFO be and is hereby authorized to refund $115.00, which represents the original application fee less the non-refundable fee paid to the New Jersey Department of Community Affairs in the amount of $18.00, to A.J. Perri, 1162 Pine Brook Road, Tinton Falls, NJ 07724.

BE IT FURTHER RESOLVED, that permit #14-000359 issued September 8, 2015 be and is hereby-considered null and void.

BE IT FURTHER RESOLVED, that a copy of this resolution be forwarded to the Chief Finance Officer, Construction Department, The Hoagland’s and A.J. Perri.

Mr. Alexander thanked Mr. Murphy for judging the Holiday Lighting Contest. Upper Freehold Township is 47 square miles and it takes some time. Thank You! It is appreciated.

PRIVILEGE OF PUBLIC:

David Horsnall, Burlington Path Road – Mr. Horsnall thanked the Committee for their energy and time, and thinks they do a wonderful job. He also thanked 1st responders, career firefighting staff and the volunteers who are involved with the community to help make it a better place to live. Mr. Hornsall wanted to make the Township Committee aware of some increased traffic areas, at Burlington Path Road and Route 539, Ellisdale Road, Main Street and New Street Intersection along with Polhemustown Road. Please look at the budget, there is a need for some replacement apparatus.

The Committee Thanked Mr. Horsnall for his past service and informed him that the traffic locations are being watched for the locations he mentioned. Monmouth County has been monitoring these areas.
