TERMS AND CONDITIONS GOVERNING THE COMPETITION

  1. Anugerah is a Malay talent competition (the “Competition”) organised by Mediacorp Pte Ltd

(the “Organiser”).

  1. There will only be ONE category in this Competition i.e., VOCAL SOLO CATEGORY.
  1. There will be one champion in this Competition.
  1. The Competition is open to all Singapore citizens and Singapore permanent residents. Contestants entering the Competition must be within the age range of 16 – 29 years (both ages inclusive) as of 31stDecember 2016.
  1. The following persons are not eligible to enter the Competition:
  2. Current permanent full time or part time employees of any one of the Mediacorp group of companies; and/or the immediate families of such staff.
  3. Individuals working for any of the Mediacorp group of companies on contract (not being full time or part time employment); and/or the immediate families of such staff.
  4. Individuals who have professionally recorded and commercially distributed their music, songs or performances in the form of a single or an album, including but not limited to mini album and compilation album) and/or are recording artistes.
  5. Individuals who are currently signed or contracted to an artiste management company and/or entertainment company and/or companies of such nature.
  6. Previous finalistsin any vocal categories of any Malay talent contest organized by the Organiser or any Mediacorp group of companies or their predecessors, from the year 2000.
  7. Undischarged bankrupt, persons currently under police investigation or are involved in any legal entanglements, and persons under probation with curfew imposed.
  1. Each contestant must complete the registration form and submit the same in person during registration

at the audition venue on 3rdDecember 2016 between 9 am to 4 pm.

  1. Registration is free.
  1. The audition shall be held at a time and venue to be determined by the Organiser.
  1. Any contestant below 18 years of age is also required to complete PART 6 of the registration form,

indicating parent’s/guardian’s consent to the applicant participating in this Competition and to be bound by these terms and conditions.

  1. Any contestant with full time employment is required to complete PART 7 of the registration form,

indicating his / her employer’s consent to the contestant participating in this Competition in accordance

with these terms and conditions.

  1. The Organiser has the right at any time to require proof of identity and/or eligibility. Failure to provide

such proof within a reasonable time shall, at the discretion of the Organiser, result in disqualification from the Competition. All personal details and information requested by and supplied to the Organiser by each contestant must be truthful, accurate and in no way misleading. The Organiser reserves the right to disqualify any contestant from the Competition or auditioning process in its sole discretion, should the contestant at any stage supply untruthful, inaccurate or misleading personal details and/or information.

  1. It is a condition of entry and participation in the Competition that each contestant:
  2. Confirms and undertakes that he/she shall not drop out of any stage of the Competition. In the event that the Organiser deems it necessary to re-record any part of the Competition, the contestant in question agrees to perform again for such re-recording.
  3. Contestants shall participate in any promotional and/or publicity activities as may be required by the Organiser, including without limitation, photoshoots, interviews, press conferences which does not interfere with the production schedules.
  1. Contestants who fail to attend rehearsals and/or recordings on time will be disqualified from the

Competition.

  1. The Organiser reserves the right to bar any contestant from appearing in the Competition on the

grounds of undesirable conduct and/or appearance. All contestants are advised to be suitably dressed

and made-up.

  1. It is a condition of entry and participation in the Competition that the contestant has not entered into

any contractual, commercial, sponsorship or other arrangement in respect of his / her name, likeness,

image or biography which might be in breach of these terms and conditions or otherwise prevent the

contestant from participating in the Competition or the broadcast, promotion, exploitation or

sponsorship thereof. Each contestant is also required to refrain from wearing any clothing items bearing

designer or sports logos or bearing the name or likeness of a celebrity, living or dead, during any part of

the Competition.

  1. The Organiser reserves the right to publish/use any photographs taken of the contestants during the

Competition and to use the name and likeness of any contestant, including friends, family or any other

individual accompanying the contestants.

  1. Each contestant consents and agrees to the Organiser recording his/ her performance(s) at all stages of

the Competition, including any live audition(s), whether such recording be audio, audio-visual or in the

form of photographs and further acknowledges that the Organiser has the right to edit, telecast or

choose not to telecast any such recording. All copyrights or other rights in or to the performance by the

respective contestants shall be vested in the Organiser and each such contestant agrees to assign

present, contingent and future rights in his/her performance(s) at any stage of the Competition to the

Organiser absolutely. All contestants agree to complete any formalities or sign any documents

necessary to perfect this assignment.

  1. By taking part in the Competition, the contestants each and all irrevocably give all consents and waivers

necessary for the Organiser to record and use their performances in any manner, for any purpose (commercial or otherwise) and in any part of the world as the Organiser deems fit. The contestants agree that the Organiser and any of the Mediacorp group of companies may use any recording made by the Organiser, including but not limited to, audio recordings, visual recordings, and photographs, for the promotions and publicity of the Competition.

  1. Each contestant expressly waives any and all rights which he/she may have, either in law, in equity or

otherwise, which or claim to have as a result of any alleged infringements of the contestant’s “moral

rights of authors”.

  1. All contestants shall be responsible for their own transportation, food and drinks or lodging required by

them during or in connection with the Competition and no reimbursement may be sought from the

Organiser.

  1. The Organiser shall not be liable to the contestants or to their legal representatives for any loss,

damage or injury to their person or property during or in connection with the Competition.

  1. The stages of the Competition are as follows:
  2. Auditions (1st, 2nd & 3rd Rounds)
  3. Masterclass (Skills Preparation)
  4. Preliminaries
  5. Quarterfinals
  6. Wildcard Round
  7. Semi Finals
  8. Finals
  1. The Organiser reserves the right to cancel, drop, and restructure any part of the Competition for whatever reason, without incurring any liability to the contestants and without having to provide any reasons.
  1. For the 1st audition, contestants are expected to sing any Malay song acapella (i.e., without musical accompaniment).
  1. If a Contestant qualifies for the 2nd and 3rd Auditions, such contestant must provide his own CDs, DVDs, or thumb drive of their selected song and sing along to the playback of the selected song.
  1. The final 16 selected for the competition rounds will have an equal number of male and female contestants who will be eliminated each week.
  1. During the Competition, the contestants will be required to perform songs pre-determined by the Organiser in solo, duet and/or groups.
  1. Contestants must submit for approval by the Organiser the titles, lyrics and the CD of the song to be sung as and when required. The Organiser has the right to reject the choice and to request a contestant to choose another song where appropriate. When the song/items have been submitted, no change can be made.
  1. All performances must not infringe the rights (including copyrights) of, or defame or embarrass any person, firm or company, and each contestant shall indemnify the Organiser from and against all claims arising from a breach of this term. Each contestant shall indemnify and keep the Organiser, its officers, agents and employees fully indemnified against any and all loss, damage, claims and costs (including costs on a full indemnity basis) suffered and/or incurred as a result of claims and costs (including cost on a full indemnity basis) suffered and/ or incurred as a result of the contestant’s infringement of copyright or breach of any of these terms and conditions.
  1. The selection and number of judges shall be at the Organiser’s sole discretion. The decision of the judges (or, where appropriate, the decision of the voting public, as recorded by the voting service provider) is final and no inquiries or appeals, verbal or written, will be entertained.
  1. The Organiser reserves the right to add, delete and/or alter the list of prizes offered for this Competition.
  1. The Organiser has the sole discretion to decide when or whether to broadcast part of all of the Competition, postpone or change the timing of any such broadcast without incurring any liability to the contestants.
  1. Contestants shall not give, provide, grant and/or make any interviews, comments and/or share/disclose any information (whether in written, audio and/or video form) relating to the Competition, themselves or other contestants to:
  1. any press or other media without the prior written consent of the Organiser; or
  2. on any other platform or media, including but not limited to any social networking sites, for example, Instagram, Facebook, Snapchat and Twitter.
  1. Contestants shall not at any time (whether during or after the Competition) make any personal appearance, give any interview or allow publication in any media (be it online, print, visual or audio) in any capacity in relation to the Competition, nor disclose any information or details whatsoever concerning the Competition, other finalists and participants, prize winners, the Organiser or its related companies, officers, licensees and/or agents without the prior written consent and approval of the Organiser. Without prejudice to the generality of the foregoing, contestants shall not make any disparaging remarks or any comments about the Competition or the Organiser which may adversely affect the reputation of the Competition or the Organiser.
  1. Contestants shall not enter into any agreement as a recording artiste, while participating in the Competition.
  1. Contestants may not participate in any other programmes produced for broadcast in Singapore during the period of the Competition, unless the Organiser’s prior written consent is obtained.
  1. In the event that any of the top 16 contestant are managed by a talent agency or recording company after the Competition, they shall promptly informthe Organiser in writing.
  1. The finalists and winner of the Competition may be required to commit to the recording and publicity and promotion campaign for the promotion of certain products/services.
  1. The top 4 contestants shall not release any album, single or EP whether for commercial or non-commercial purposes, within 6 months from the date of the finals of the Competition, without the prior written consent of the Organiser.
  1. All contestants must abide by the applicable terms and conditions as stated in English only. Only the English version of these terms and conditions shall prevail and apply to all the contestants: any translation thereof into other language(s) is for the convenience of the contestants only. Non-compliance with or breach of the applicable terms and conditions shall immediately disqualify the contestants from further participation in the Competition and any prizes won shall be forfeited.
  1. These terms and conditions may from time to time be made or amended by the Organiser. All such rules shall be solely interpreted by the Organiser and the Organiser’s interpretation shall be final at all times.
  1. The Organiser may freely assign any of its rights or transfer any of its rights and obligations hereunder to a related company within the Mediacorp group of companies.

43.Contestants agree that their personal data may be used by the Organiser and the Mediacorp Group (collectively “Mediacorp”):

a. For Mediacorp or its designated representatives or business partners to provide goods and services to the contestants and matters ancillary thereto.

b. To verify and process payment when the contestants purchase goods and services from Mediacorp.

c. For verification and record of the contestants’ personal particulars including comparing it with information from other sources and using the information to communicate with the contestants.

d. For research and analysis, including surveys and polls.

e. For publicity and promotional purpose.

f. To contact the contestants for future casting opportunities.

g. To send the contestants notices, information, promotions and updates including marketing and advertising materials in relation to Mediacorp’s goods and services and those of third party organizations selected by Mediacorp.

h. To comply with any request from any third party or any order of court or directive from authorities investigating any alleged offence or misconduct or for the purposes of taking legal action against the participants.

  1. By participating in this Contest, each contestant consents to MPL collecting, using, disclosing and/or processing his/her personal data for the purposes as described in the clause above. The contestant further agrees that Mediacorp can transfer his/her personal data out of Singapore to Mediacorp’s third party service providers or agents for the purposes as described in the clause above.
