Regular Meeting
November 8, 2010
The Village of Ashton Board of Trustees met at 7:30 P.M. on November 8, 2010 in the Village Hall with President Martinez presiding. Trustees in attendance were Balch, Bolen, Emmons, Henert, Kida and Russell. Motion was made by Kida, seconded by Henert to approve the October Regular Meeting minutes and the Public Hearing minutes with the correction speaker number 10 from Neil Henert to Neil Miller. Voice votes, 6 ayes, 0 nays, motion carried.

It was noted that Northwest Illinois Construction in the amount of $50,842.13 had been entered twice. Motion was made by Bolen, seconded by Balch to draw upon the treasury as corrected to pay the monthly bills and payroll in the amount of $112,833.07. Voice votes, 6 ayes, 0 nays, motion carried.

Being no citizens to be heard, Martinez opened discussion pertaining to wind generating turbines within the one and a half mile jurisdiction of the Ashton village limits. AFC School Superintendent John Zick clarified some points that the school board president Bob Colwell had made at the Franklin Grove public hearing concerning the income it would generate for the school. Neil Miller said that the Lee County Treasurers office said the amount paid was $9,000 per mega-watt and that it would not be much compared to the schools $7,000,000 budget. Martinez said as far back as Forney’s terms a lot of ground work in infrastructure development had been laid for future growth and that he would like to see the area around Ashton protected.
Being no more comments, Martinez asked for a motion on the proposed ordinance. Motion was made by Kida, seconded by Emmons to pass ordinance number 110810, an Ordinance Amending the Village of Ashton Zoning Code. Kida said that the state authorizes us to enforce the 1.5 mile radius surrounding its zoning jurisdiction. Russell asked if there would be a problem if we did a 3/4 mile instead of 1.5 mile radius. Roll call votes, 3 ayes, 3 nays, motion carried. Martinez was called on to break the tie vote making it 4 ayes and 3 nays.

Martinez introduced the first read of Amendment Number 13 to an Intergovernmental Agreement between the City of Dixon, City of Amboy, Village of Ashton, Village of Franklin Grove, Village of Paw Paw, City of Rochelle and Counties of Lee and Ogle Regarding Administration of an Enterprise Zone Dated December 23, 1986 and an Ordinance Amending Ordinance No. 3.20 an Ordinance Amending the Boundaries of the Lee County Enterprise Zone.
Andrew Kida announced that the American Legion was holding the Veterans Day ceremony on November 11th at 10:30 A.M.
Bolen reported scheduled a Water and Sewer Committee meeting for November 15, 2010 at 6:30 P.M. at the Village Hall to go over the proposed overdue bill policy ordinance.
Chief Hetland’s monthly police report listed 242 hours worked, 1260 miles, 93.44 gallons fuel, 2-adult arrests, 0-juvenile detained, 3-criminal offense reports, 8-public services, 35-traffic enforcements and $910.39 in paid fines.
Russell reported that the Mills Petrie work was going well.
Manheim reported that a certified letter had been sent to Rick Roberson on violations at 609 Richardson. Tess told Manheim to let him know when the 10 days were up and he would try to work it into his court day in next month.
Following discussion, Russell made a motion, seconded by Emmons to pass the Landscape Waste Collection Ordinance as amended. Voice votes, 6 ayes, 0 nays, motion carried.

Tess informed the board that he had heard form the attorney for the bank on 604 Brown Avenue. Tess told the board that Freddie Mac had been here to look at the building and was getting an estimate to take the building down but didn’t know how long it would take.
Tess told the board that the court had ruled that we must open the estate to get a clear title on the 804 & 806 Main Street properties and said the paper work is ready but several members are deceased. He has filed to get the names and addresses of their children but has not gotten them. Tess reported that the potential owner is continuing to make the buildings water tight.
Kida made a motion, seconded by Emmons to adjourn. Voice votes, 6 ayes, 0 nays, motion carried.
