INTRODUCTION

1.1  INTRODUCTION

The National Institute of Science Communication and Information Resources (NISCAIR) is constituent units of the Council of Scientific & Industrial Research (CSIR). The R&D programs being undertaken are geared towards meeting the information needs of the different segment of the society. Apart from bringing out a variety of scientific and technical publications and providing information services and training in Science Communication, we undertakes consultancy work in designing, editing and publication of journals, books, reports, training etc.

1.2  SCOPE OF WORK

Supply of Copier Paper A – 4 size 80 GSM costing around Rs. Five Lakhs required for day to day official use.

Reputed firms are, therefore, invited to submit their rates.

1.2.1  REQUIREMENT

Bids may be submitted for Copier – Paper A-4 size 80 GSM

2. INVITATION FOR THE BIDS/TENDERS

Supply of Copier Paper A – 4 size 80 GSM

2.1  Sealed Tender under single bid system are invited alongwith tender document fee of Rs 500/- (Rupees five hundred only) and EMD of Rs. 10,000/- (Rupees Tend thousand only) valid for 90 days are invited from the reputed Firm. Financial bid alongwith EMD should be submitted in single envelop duly sealed/taped and clearly marking the type of content, bidder’s name & address on the top of the sealed envelopes. If the tender down loaded directly from our website, vendors are requested to also submit tender document fees of Rs. 500/- (Rupees Five Hundred only) alongwith Financial bid.

2.2  The details of the material required are given in the Schedule attached as Annexure- 1.

2.3  The bids complete in all respects and addressed to the DIRECTOR, NISCAIR, should reach at the following address latest by 14.30 hours on 09.01.2006.

2.4 Financial Bid will be opened in the Conference Hall of NISCAIR on the same day at 15.00 hours in the presence of bidders or their authorized representatives who choose to be present and whose EMD is in order.

3. INSTRUCTIONS TO BIDDERS/TENDERERS

3.1 ELIGIBILITY CONDITIONS:

1. Reputed firms/suppliers dealing in concerned items for the last

three years or more.

2.  Valid Registration of Central/State Vatt.

3.  Proof of manufacturing unit/dealership.

4.  Audited Balance sheet of 2004-2005

NOTE: 1. Vendor should furnish the documentary proof of all 4 conditions.

2.  Financial bid of those bidders should be considered who fulfill the above eligibility conditions.

3.2 COST OF BIDDING

The bidder shall bear all costs associated with the preparation and submission of its bid. NISCAIR will in no case be responsible or liable for these costs, regardless of the conduct or the outcome of the bidding process.

3.3.  THE BIDDING DOCUMENTS

3.3.1 The services required, bidding procedures, bid form, contract terms and instructions are prescribed in the bidding documents.

The bidder is expected to examine all instructions, forms, terms and conditions, specifications, schedule to Tender, and other documents before quoting. Failure to furnish all information required or submission of bid not substantially responsive to the bidding documents in every respect will be at the bidder’s risk and may result in rejection of its bid.

3.4  PREPARATION OF BIDS

3.4.1 Earnest Money Deposit (EMD) of Rs. 10,000.00 may be submitted either in the form of DD or Bank Guarantee valid for 03 months as per annexure 5. If the EMD is not received the bid will be rejected.

3.4.2  Financial Bid

The financial bid shall indicate the Unit prices for item indicated in the specifications.

(a) The prices quoted must be net per unit as shown in the Schedule and must include all charges for delivery at the Stores of NISCAIR at New Delhi.

(b) The rate must be stated for each item separately both in words and figures. If there is discrepancy between the price quoted in word and figures the higher price quoted will be treated as final.

(c) Quoted prices should be firm and inclusive of Vatt, octroi, freight and forwarding charges, handling charges, loading and unloading charges, insurance charges, any other tax/charges.

(d) The prices once accepted by NISCAIR shall remain valid till the successful execution of the order and till supplies are fully effected and accepted . NISCAIR shall not entertain any increase in the rates during the period. The quantity given in the schedule is approx annual requirement, which can be reduced or increased by 30%.

(e) Rate should be valid for 90 days from the date of opening of the financial bids.

3.4.3 Terms of Delivery

The delivery of STORE is required in single instalment to be made as and when ordered.

3.5 SUBMISSION OF BIDS

3.5.1  Deadline for Submission of Bids

(a)  Bids must be received by NISCAIR not later than the time and date specified on the cover page. In the event of the specified date for the submission of bids being declared a holiday for NISCAIR, the bids will be received up to the appointed time on the next working day.

(b)  The Director, NISCAIR may, at his discretion extend this deadline for submission of bids by amending the bid documents, in which case all rights and obligations of NISCAIR and bidders previously subject to the deadline will thereafter be subject to the deadline as extended.

3.5.2  Late Bids

Any bid received by NISCAIR after the deadline for submission of bids prescribed by NISCAIR will be rejected and/or returned unopened to the bidder.

3.6  EVALUATION AND COMPARISON OF BIDS

(a) Arithmetical errors will be rectified on the following basis: If there is a discrepancy between the unit price and the total price that is obtained by multiplying the unit price and quantity, the unit price shall prevail and the total price shall be corrected. If the Vendor does not accept the correction of errors, its bid will be rejected. If there is a discrepancy between words and figures, the higher price quoted will be treated as final..

(b) If there is any discrepancy between the price quoted in figures & words, whichever is higher of the two shall be taken as the bid price.

(c)  Bidders shall state their bid price for the payment schedule outlined in the Clause 4. Bids will be evaluated on the basis of this base price. Bidders are, however, permitted to state an alternative payment schedule and indicate the reduction in bid price they wish to offer for such alternative payment schedule. NISCAIR may consider the alternative payment schedule offered by the selected Bidder but it may not be binding on NISCAIR.

3.7 AWARD OF CONTRACT

3.7.1  NISCAIR’s Right to accept any Bid and to Reject any or all Bids

Director, NISCAIR reserves the right to accept or reject any bid in part or full, and to annul the bidding process and reject all bids at any time prior to award of Contract, without thereby incurring any liability to the affected Bidder or Bidders or any obligation to inform the affected Bidder or Bidders of the grounds for NISCAIR’s action.

3.7.2 Notification of Award

(a) Prior to the expiration of the period of bids validity, NISCAIR will notify the successful Bidder in writing by letter or by fax, to be confirmed in writing by speed post or hand delivered letter, that its bid has been accepted.

(b) The notification of Award will constitute the formation of the Contract.

3.8 FACTOR AFFECTING THE AWARD OF CONTRACT

(1) In case the first tenderer is debarred, the tender can be awarded to the next lowest bidder. Director, NISCAIR reserves the right to cancel the tender or call a fresh bid.

(2) All the goods to be supplied must bear reputed brands if the bidder does not manufacture goods bidder must submit proof of authorization from the manufacturer.

(3) The bidders must have executed similar orders, for which the bidder is quoting, as indicated in Section I, in Govt./Semi-Govt./Autonomous Organizations or other reputed Institutions.

(4) The cost and the discount offered, if any.

(5) All other things equal, preference will be given to the established well-known manufactures of high quality directly selling to the purchaser.

(6) As and when there is a downward revision in prices, the firm will provide revised pricing details.

4. PAYMENT

100% payment will be made within 20 days of receipt of material in

good condition.

GENERAL TERMS & CONDITIONS

TO THE TENDER

AS PER SCHEDULE ATTACHED

1. GENERAL CONDITIONS APPLICABLE TO CONTRACT

(a) ADDRESS OF THE CONTRACTOR AND NOTICES AND COMMUNICATIONS ON BEHALF OF THE PURCHASER

(i) For all purposes of the contract, including arbitration thereunder, the address of the Contractor mentioned in the tender shall be the address to which all communications addressed to the Contractor shall be sent, unless the Contractor has notified a change by a separate letter containing no other communication and sent by registered post, acknowledgement due. The Contractor shall be solely responsible for the consequences of any omission to notify a change of address in the manner aforesaid.

(ii) Any communication or notice on behalf of the Purchaser in relation to the contract may be issued to the contractor by the Director or any other officer authorized by him on his behalf and all such communications and notices may be served on the Contractor either by Registered Post or speed post or by ordinary post or by hand delivery at the option of such officer.

2. RESPONSIBILITY OF THE CONTRACTOR FOR EXECUTING THE CONTRACT

(i) The Contractor shall perform the contract in all respects in accordance with the terms and conditions thereof. The STORES and every constituent part thereof, whether in the possession or control of the Contractor, his agents or servants or a carrier or in the joint possession of the Contractor and the Purchaser, his agent or servants shall remain in every respect at the risk of the Contract until their actual delivery to the Purchaser at the stipulated place or destination on where so provided in acceptance of tender until their delivery to a subordinate office of the NISCAIR. The Contractor shall be responsible for all loss, destruction, damage or deterioration of or to the Stores from any cause whatsoever while the Stores after their approval are awaiting dispatch of delivery or are in the course of transit from the contractor to the Purchaser, or as the case may be to any of its subordinate offices.

(ii) Purchaser’s Right of Rejection

It shall be lawful for the Purchaser to reject the STORES or any part, portion of supply thereof within reasonable time after actual delivery thereof to him at the place of destination specified in the Schedule if such STORES or part, portion of supply thereof is not in all respects in conformity with the terms and conditions of the contract and the prescribed specifications.

(iii) Changes in Firm

Where the Contractor is partnership firm, a new partner shall not be introduced in the firm except with the previous consent in writing of the Director, NISCAIR, which may be granted only upon execution of a written undertaking by the new partner to perform the contract and accept all liability incurred by the firm under the contract prior to the date of such undertaking.

(iv) Consequence of Breach

(a) Should the Contractor or Partner in the Contractor firm commits breach of either of the conditions (i) to (iii), it shall be lawful for the Director, NISCAIR, to cancel the contract and purchase or authorize the purchase of the STORES at the risk and cost of the Contractor.

(b) The decision of the Director, NISCAIR, as to any matter of thing concerning or arising out of this sub-clause or on any question whether the Contractor or any partner of the Contractor firm has committed shall be final and binding on the Contractor.

(c) The conditions beyond its control such as but not limited to, war, strike fire, flood, power failures, Govt. restrictions etc. shall not be deemed a breach of the Contract.
